RECESS REGULAR MEETING AND OPEN WORKSHOP-Chairperson. CHAIRPERSON HOOVER RECESSED THE REGULAR MEETING AND OPENED THE WORKSHOP AT 6:03 P.M. For clarification,the purpose of this workshop,and those to follow,is to provide a platform for the Board,Planning Staff,property owners,and the public to discuss proposed Text and Map amendments to the Comprehensive Plan,all based on recommendations contained in the recently adopted Evaluation and Appraisal Report(EAR). Once all areas addressed in the EAR are reviewed, the proposed amendments will be forwarded to the City Council,accompanied with a Planning Board recommendation. A. Discuss the proposed Text Amendments to the Future Land Use Mr. Brisson presented a memorandum outlining the first item which addresses changes to the description of the Element Policy 2.1, d.) and adopting a Commercial Corridor and Commercial category, Future Land Use Element Policy 2.1, d), by adding sub-sections that identify a specific Transitional Commercial Overlay Areas Map-City Planner "Commercial Corridor,"two blocks along both sides of Parrott Avenue (US Highway 441) and North Park Street (SR 70) Then goes on to address what appropriate mixed-use opportunities can be included as well as a policy for expansion or infill of the corridor to allow a consistent approach and compatibility with existing development. The properties within the two block area that are not currently a commercial category or included in the mixed-used opportunities will be identified as the"Transitional Commercial Overlay."Both the boundary of the corridor and overlay will be identified appropriately on the Future Land Use Map series. The Board did not have any question, comments or state any objections on this proposed amendment. B. Discuss Future Land Use designation and Zoning district conflicts Mr. Brisson then turned to discussing how to resolve conflicts between the Future Land Use (FLU)designations and within the Southeast quadrant-City Planner Zoning districts within the Southeast quadrant.To easily identify specific parcels on both maps,each was assigned a conflict number. 1. Area between North East Park Street (SR 70 E) to SE 8'h No. 94, is the American Legion property, (Legal: Lots 2-6 of Block 253, 1"Addition to City of Okeechobee),with FLU Street, and from South Parrott Avenue (Hwy 441 S) to the as Commercial (C), and Zoning as Residential Multiple Family(RMF).The recommendation is to rezone the property West side of Taylor Creek. to Light Commercial (CLT),which allows a private club by Special Exception.There were no questions,comments or objections noted. I No. 95, is split into two sections, to the North, (Legal: Lot 1 of Block 253, 11`Addition to the City of Okeechobee), is vacant, but was previously a car sales lot. To the South, (Legal: Lots 7 & 8 of Block 253, 1"Addition to the City of Okeechobee), is a church. The FLU for both is C, with Zoning as Residential Single Family 1 (RSF-1). The recommendation is to rezone the North parcel to Heavy Commercial(CHV)and the South to CLT. However,following a brief discussion,Mr.Brisson agreed with the majority of the Board that both parcels should be recommended for CLT. This would keep the entire block with the same designation and should someone in the future wish to establish a car sales lot again on the North parcel, they could apply for a Special Exception. Should the Special Exception use that was previously granted fail to exist or fail to be used for a continuous period of 180 days,then such use shall lapse and the current owner would be required to reapply. Discuss Future Land Use designation and Zoning district conflicts No. 104,are the Hospice properties,a duplex,vacant parcels and single family homes,(Legal: Lots 1-12 of Block 204, continued. Lots 1-4 & 7-12 of Block 205, Lots 1-5&7-12 of Block 208, Lots 1-5 & 7-12 of Block 209, V Addition to the City of Okeechobee Subdivision and Lots 1-5 of Block B,Central Park Subdivision),with the FLU as Single Family(SF)and Zoning of RMF.The recommendation is to change the FLU designation of the Hamrick Hospice House,Lots 2-5 of Block B,Central Park Subdivision,to Multi-Family(MF)and rezone the balance of the properties to RSF-1.Discussion followed regarding the Hospice staff housing parcels,Lots 7-12, Block 209, 15`Addition to the City of Okeechobee Subdivision, and whether these should be rezoned to RSF-1 instead of RMF.The Planner explained that these were existing single family residences being utilized as"multiple rooms."Consensus of the Board was in agreement with the Planner. No, 105,are five single family homes and two duplexes,(Legal:Lots 1-9&16-20 of Block D,Central Park),with the FLU of SF and Zoning of RMF.The recommendation is to change the FLU for the duplexes,(Legal: Lots 1-6 of Block D),to MF and leave the single family homes, (Legal: Lots 7-9& 16-19 of Block D), SF.There were no questions,comments or objections noted. No. 106, is vacant property, (Legal: 1.95 Acres, Unplatted Lands of the City beginning at South West corner govt Lot 6 and running along West boundary of lot to West edge of Taylor Creek), with the FLU of SF and Zoning of Public Facilities (PUB). The recommendation is to change the FLU designation to Public Facilities (PF). There were no questions,comments or objections noted. a) Consider amending the Land Development To ensure that the approval in 2008 for a group home providing housing for staff of Hospice is not made nonconforming Regulations (Sec. 66-1) Definitions of Boarding as a result of the proposed rezoning to RSF-1, suggestion was made to modify the definition of Boarding house by house. adding a single family dwelling containing five(5)or fewer sleeping rooms without individual cooking facilities, owned and operated by a nonprofit organization, and providing living quarters for staff members of a hospice, group home, community residential home or assisted living facility operated by the nonprofit organization. Discussion followed regarding adding the word ONLY before staff members of a hospice, and so on. This discussion came about due to some ongoing concerns with the current arrangement with the staff housing at Hospice.Housing was approved for staff members although there is speculation that other family members are also residing there. 2. Area between North East Park Street(SR 70 E)to SE 9"Street,and No. 100, are single family residences, Lots 11-13, Taylor Creek Manor, with a FLU of SF and Zoning of RMF. Discussion followed regarding Lots 8-14,Brownings Addition.Board consensus was to actually change the FLU of these to MF due to these parcels buffering more intensive uses to the North and South. No. 103,are single family homes,(Legal:totaling approximately 0.94 Acres,Unplatted Lands of the City beginning 310 feet South to 610 feet South of&25 feet West of NE corner of government Lot 2),with a FLU of SF and C and a Zoning of RMF. The recommendation is to change the FLU to MF. Discussion followed regarding leaving these parcels as is due to some concern expressed in the past from one of the property owners. After a lengthy discussion it was the consensus of the Board to follow the Planning Staff's recommendation. No. 107,are five duplexes and four single family homes,(Legal:Lots 1-9,Block 5,Wilcox Shores),with a FLU of SF and Zoning of RMF. The recommendation is to change the FLU to MF.There were no comments,questions or objections noted. No. 111,is a vacant parcel,(Legal: Lot 8, Block E,Wrights Addition),with a FLU of SF and a Zoning of Industrial(IND). The recommendation is to rezone to RSF-1.Discussion followed regarding the property directly to the North,(Legal:Lots 1-7, Block E, Wrights Addition),with a FLU of SF and a Zoning of IND. Board Member Baughman expressed concern that since both of these parcels were owned by the same property owner that they should have the same FLU and Zoning designations in case they were ever to be sold. The Board consensus was to change the FLU to I (industrial). No. 112,are two vacant parcels,(Legal Lots 11& 12,Block E,Wrights Addition),with a FLU of SF and a Zoning of IND. The recommendation is to rezone to RSF-1.There were no comments, questions or objections noted. Planning , a & Management Services, Inc. • • _ 'Ftanwr..a��r Memorandum To: Planning Board Members From: Bill Brisson Date: March 16, 2012 Subject: Materials for April Planning Board Workshop Meeting As you are aware, there are a large number of conflicts between the Future Land Use Map FLUM and the Zoning Map. This was one of the major issues we discussed at length during the City's preparation of its Evaluation and Appraisal Report(EAR). Another major issue was the formulation of the Commercial Corridor and Transitional Commercial Overlay. Since the adoption of the EAR, there have been an increasing number of inquiries from owners about what can be done with their properties. A number of these have involved properties where there are conflicts between the FLUM and Zoning Map, and some have been located in the areas • envisioned to be within the Commercial Corridor or the Transitional Commercial Overlay. Therefore, we have begun concentrating certain areas in the City where these conflict are most prevalent. Attached are three sets of materials we would like to discuss at the upcoming Planning Board meeting. This will not be a public hearing and no official action will be taken. Rather, we wish to discuss these matters with you and take away with us, some consensus as to the direction that needs to be taken. We envision additional workshops over the coming months, until such time as we have a consensus on a sufficient number of properties or amendments to begin the formal public hearing process. Following are brief summaries and explanations of the three sets of materials: I. Recommended text and map changes to the Comprehensive Plan to implement the recommendations contained in the EAR pertaining to the Commercial Corridor and Transitional Commercial Overlay. These materials include proposed changes to the description of the Commercial Future Land Use category, based on the recommendations in the EAR. Our recommendations are generally based on the following criteria: A. Since Future Land Use designations take precedence over zoning, we initially assume that the Future Land Use designation is correct and will almost always recommend rezoning the property to be consistent with the FLUM. B. If we recommend changing the FLU designation, we will not generally recommend a change to the FLUM that will result in a land use designation that is more restrictive than presently applied. On occasion you may find a recommendation to change the FLU designation to a more intensive category to eliminate nonconformities, provided the change does not encourage an incompatible land use pattern or trend. Finally, we are providing these materials to you well in advance of the meeting so that you may call us beforehand if you have any questions. We look forward to seeing you at the meeting. I. RECOMMENDED TEXT AND MAP CHANGES FUTURE LAND USE ELEMENT OF THE COMPREHENSIVE PLAN Modify Policy 2.1, d), on page 1-5 of the Future Land Use Element, describing the Commercial Future Land Use Category, to read as follows: d) Commercial. Permitted uses include, office, retail, automotive wholesale, and related commercial activities. Also permitted are public facilities. Commercial development shall not exceed a floor area ration of 3.00 and the maximum impervious surface for development within this category shall not exceed 85%of the site. 1. In recognition of the importance of the SR 70 and US 441 as the city's primary commercial corridor roadways, the City has identified the Commercial Corridor as being that area within two blocks of each of these roadways and such area is so delineated in the Future Land Use Map Series 2. The City is interested in following a considered, limited, and consistent approach to allow expansion of commercial and mixed-use opportunities gradually outward from established commercial corridor roadways to eliminate uncertainty and foster infill and compatibility with existing development. To this end, the City has delineated the Transitional Commercial Overlay Future Land Use Subcategory on Map 1.2 in the Future Land Use Map Series. This category is intended to: a. Provide additional and varied commercial opportunities in locations in close proximity to the City's major arterials and adjacent to residential areas. b. Permit the continuation of a wide variety of existing residential, commercial, industrial and public and semi-public uses as allowed within the RSF1, RMF, CPO, CLT, CHV CBD, IND and PUB zoning districts. c. Limit rezoning of lands within this Future Land Use category only to the RMF, CLT, CPO, CBD or PUB zoning districts, thereby providing a transition from more intense development along the major arterials to lessen intensity closer to residential areas. d. Allow mixed residential and commercial uses on the same parcel.
