1. Hear from Planning Staff. Mr.Brisson presented the Planning Staff Report recommending approval,stating the proposed project would replace
the existing 110 foot feed mill with a new, more efficient, 168 foot feed mill. Part of the original facility was recently
destroyed by a fire.The improvements will allow the operation to take place in a more vertical manner,reducing the need
to move feed,reducing the number of exterior storage silos from 16 to four,and hopefully reducing the number of hours
that the mill will be in operation.The building footprint will be reduced, therefore additional landscaping will not be
required.
2. Hear from the Property Owner or designee/agent. Mr.Gary Winsett,a Consultant on behalf of the property owner,addressed the Board to explain the complex operations
of feed mills and how the new vertical rise process will be more efficient.
3. Hear from the public for comment. Chairperson Hoover yielded the floor for public comment at this time.There were none.There were 20 notices mailed
to surrounding property owners and one was returned undeliverable.No replies were received to date.
4. Board Discussion. The floor was opened for Board discussion,there was none.
5. Consider motion and vote. Member Burroughs moved to approve Petition No. 12-002-SE for property located at 708 NW 2nd Avenue, Legal:
Blocks 59 and 60,with vacated alleys,and that part of NW 3`d Avenue bounded on the South by NW 7"Street and that

application requesting a Special Exception to allow the height of the replacement feed

United feed is replacing the existing 110-foot high feed mill with a new, more efficient
feed mill that will be 168 feet high. Part of the original facility, built in the 1960's was
recently destroyed by fire. The new facility will be more efficient in that the operation will
take place in a more vertical manner, reducing the need to move feed, reducing the
number of exterior storage silos from 16 to four, and hopefully, reducing the number of
hours the the mill will be in operation. The capacity of the operation will remain the
same as previous.

Section 70-373(b) requires that the Applicant address, during his/her presentation to the
Board of Adjustment, the following standards for granting a Special Exception. The
Applicant has submitted brief statements addressing these standards as part of the
Application. These are repeated herein in Times Roman typeface and are followed by the
Staff Comments.
(1) Demonstrate that the proposed location and site are appropriate for the use.
"The facility receives 95% of raw materials via railroad. The 8.6 acre site is in an
industrial area and located on a rail line, thus a desirable location."
We agree that the site is appropriate for the use.
(2) Demonstrate how the site and proposed buildings have been designed so they
are compatible with the adjacent uses and the neighborhood, or explain why no
specific design efforts are needed.
"This is an industrial area and has been used as a feed mill site for 42 years. A
portion of the facility not burned, ranges up to 105 feet in height. Also, across the
street on the East side is a cell phone tower. (Height is not known but believed to be
around 130 feet.) Also, the 8.6 acre site provides more than normal buffer.
Basically, except for height increase of the structure used for process, there are no
changes."
We agree, even the residential uses to the south of the property are
located over 450 feet from the site of the feed mill.
(3) Demonstrate any landscaping techniques to visually screen the use from
adjacent uses; or explain why no visual screening is necessary.
"In 2010 a storage building was added to the site. At that time, in accordance with the
City of Okeechobee's requirements, the site was landscaped. Since this is a build-back
within the original footprint, no change in landscaping is believed appropriate."

We agree. While the building will be higher, the building footprint is
being reduced and additional landscaping should not be necessary.
Additional landscaping will have no practical buffering effect in relation to
the increase in height.
(4) Demonstrate what is proposed to reduce the impacts of any potential hazards,
problems or public nuisance generated by the use or explain how the nature of
the use creates no such potential problems.
"The upper two thirds of the proposed structure is simply storage
compartments with vertical elevator equipment. There are no process
machines or noise generators on or outside the structure. The facility would have
a galvanized finish, and present a neat, impressive appearance.
The facility only proportions and mixes agricultural materials (Grains, proteins,
minerals, minor nutrients.) There is no processing or toxic effluents generated.
The structure would be a "lightning rod" to theoretically siphon off potential
strikes.
The structure of course would be protected with Lightning Protection in
accordance with Code."
We agree that there is no change in the basic operation as a result of the
increased height and therefore, as proposed in the Applicant's
explanation above, no increase in hazards or nuisance can be expected.
(5) Demonstrate how the utilities and other service requirements of the use can be
met.
"Again, since this is a build-back with no increased capacity, the demand for services
would stay the same. The only utility required is electricity. At this time it is
believed the existing electrical service and utility transformer are adequate."
We agree.

(6) Demonstrate how the impact of traffic generation will be handled off site and on-
site.
"No change from the previous operation. Again 95% of raw materials are received via
rail cars. Outgoing feed is hauled by two company trucks to the local dairies. There
would be a total of 12 to 15 trips per day, same as before."
We agree that traffic generation is rather minimal and the increased
height of the mill will not affect the number of trips. Discussion with the
Applicant indicated that with the increased efficiency plant operation may
be reduced and the number of truck trips might be compressed into the
somewhat shorter period of operation. This should have no appreciable
effect upon the roadway network.
When reaching a conclusion on a Special Exception request, the Board of Adjustment
shall consider and show in its record the following findings as set forth in Section 70-
373(c). The Applicant has submitted brief statements addressing these requirements
and they are repeated herein for ease of review by the Board. Staff comments follow
thereafter.
1. The use is not contrary to the Comprehensive Plan requirements.
"The proposed new facility is located in an area designated Industrial on the
Comprehensive Land Use Plan, thus the application is consistent with the Plan. (The
original facility that burned had existed on this site since 1969.)"
We agree the use and height associated with the new facility is not
contrary to the Comprehensive Plan.
2. The use is specifically authorized as a special exception use in the zoning
district.
"The requested exception for Height of structure is authorized in the City Zoning
regulations for Industrial."
We agree, height in excess of 45 feet is allowable as a special exception
in the Industrial zoning district.

3. The use will not have an adverse effect on the public interest.
"This is a build-back. The original facility had no known adverse effects on the public
interest. There are no noise or toxic effluents. The process is the proportioning and
mixing of agricultural commodities to make dairy animal feed."
We agree. There is no change in the basic operation as a result of the
increased height and therefore, as proposed in the Applicant's
explanation above, no adverse effect upon the public can be expected as
a result of the increase in height.
4. The use is appropriate for the proposed location, is reasonably compatible with
adjacent uses and is not detrimental to urbanizing land use patterns.
"The subject location is located on the local CSX main Railroad to the North. To the
Northwest and adjacent to the property, is the Walpole feed mill. Further to the West and
along the same rail line are the Dairy Feeds and Syfrett feed mills. To the East is an LP
gas facility and a cell phone tower. Thus, the facility is consistent with the previous land
use and the adjoining and nearby feed mill properties."
We agree, even the residential uses to the south of the property are
located over 450 feet from the site of the feed mill.
5. The use will not adversely affect property values or living conditions, nor be a
deterrent to the development of adjacent property.
"it is believed a new modern, clean structure will enhance the adjoining area for
Industrial use. The build-back puts forth a new and enhanced facility with industrial
appeal."
We agree, the new structure will only improve the appearance of the use and the
additional height should have no appreciable effect upon development of
adjacent properties.

6. The use may be required to be screened from surrounding uses to reduce the
impact of any nuisance or hazard to adjacent uses.
"The first 105 feet of the structure is internal compartments for stored bulk materials and
presents a smooth galvanized finish. The upper portion does consist of round 14"
diameter pipes arranged in a symmetrical pattern. Basically, it would be impossible to
"screen" the entire structure. Furthermore, while the structure is higher, most of the old
exposed storage bins and equipment are being removed. The new portion presents a more
enclosed streamlined appearance."
We agree. While the building will be higher, the building footprint is
being reduced and additional landscaping should not be necessary.
Additional landscaping will have no practical buffering effect in relation to
the increase in height.
7. The use will not create a density pattern that will overburden public facilities such
as schools, streets, and utility services.
"The main service required is electricity, which would be the same as the previous
facility, thus no new demands. There is no required water or sewer services except for
toilets for 6 employees."
We agree. Further, density is not a factor associated with industrial use.
8. The use will not create traffic congestion, flooding or drainage problems, or
otherwise affect public safety.
"95% of raw materials (Grains, protein meals, minerals) are received via rail, and thus no
traffic impact. Processed materials are hauled from the site by two company trucks with
12 to 15 Loads per day.
Again, this is the same as the previous operation up through August, 2011, and thus no
change, and no known traffic or public safety issues."
We agree. As stated in the response to item #6 relating to the standards
for granting a special exception, approval of the special exception for
height should have no appreciable effect upon traffic on the roadway
network.

STANDARDS FOR GRANTING A SPECIAL EXCEPTION [Sec. 70-373(b), LDR page CD70:19]
Applicants are required by Sec. 70-373(b)to address the following issues in his/her presentation before the
Board of Adjustment. Staff strongly recommends that the Applicant include, in his/her application, m--!erials
that address each of these issues in order to allow Staff and the Board of Adjustment sufficient time t=
adequately consider the Applicant's request.
'I. Demonstrate that the proposed location and site are appropriate for the use.
2. Demonstrate how the site and proposed buildings have been designed so they are compatible with the adjacent uses
and the neighborhood,or explain why no specific design efforts are needed.
3. Demonstrate any landscaping techniques to visually screen the use from adjacent uses;or explain why no visual
screening is necessary.
4. Demonstrate what is proposed to reduce the impact of any potential hazards,problems or public nuisance generated by
the use;or explain how the nature of the use creates no such potential problems.
5. Demonstrate bow the utilities and other service requirements of the use can be met.
6. Demonstrate how the impact of traffic generated will be handled,off site and on site.

City of Okeechobee - Request for Special Exception for Height
Background - United Feed Co-op has operated a Feed Mill in
Okeechobee for several years. The original facility was built in 1968.
United acquired it later, and is the second owner.
The warehouse/milling portion of the facility was destroyed by fire in
August, 2011 . While the outside storage silos and elevators were 50 to
105 feet in height, the building portion that burned was about 35 feet
high.
United proposes to build back the mill, and have done preliminary
designs on a modern efficient facility. The build-back would be within
the footprint of the original structure.
Since 1968, feed mills in the U.S. have evolved to more vertical,
compact, gravity flow efficient structures. Thus, the new mill that United
proposes to build back is taller, with the utmost highest portion, a
personnel elevator enclosure, at 168 feet above ground level. (The
highest work level is 150 feet.) Since this above the maximum allowable
height for a "building", a special exception is requested.
The following issues are addressed:
1 . Location - The facility receives 95% of raw materials via railroad. The
8.6 acre site is in an industrial area and located on a rail line, thus a
desirable location.
2. Site & Buildings - This an industrial area and has been used as a feed
mill site for 42 years. A portion of the facility not burned, ranges up to
105 feet in height. Also, across the street on the East side is a cell phone
tower. (Height is not known but believed to be around 130 feet.) Also,
the 8.6 acre site provides more than normal buffer.
Basically, except for height increase of the structure used for process,
there are no changes.
3. Landscaping - In 2010 a storage building was added to the site. At
that time, in accordance with City of Okeechobee's requirements, the
site was landscaped. Since this is a build-back within the original
footprint, no change in landscaping is believed appropriate.
4. Public Hazards - The upper two thirds of the proposed structure is
simply storage compartments with vertical elevator equipment. There
are no process machines or noise generators on or outside the structure.
The facility would have a galvanized finish, and present a neat,
impressive appearance.
The facility only proportions and mixes agricultural materials (Grains,
proteins, minerals, minor nutrients.) There is no processing or toxic
effluents generated. The structure would be a "lightning rod" to
theoretically siphon off potential strikes.
The structure of course would be protected with Lightning Protection
in accordance with Code.
5. Utilities & Services - Again, since this is a build-back with no increased
capacity, the demand for services would stay the same. The only utility
required is electricity. At this time it is believed the existing electrical
service and utility transformer are adequate.
6. Traffic Impact - No change from the previous operation. Again 95%
of raw materials are received via rail cars. Outgoing feed is hauled by
two company trucks to the local dairies. There would be a total of 12 to
15 trips per day, same as before.

The following eight (8) points from Findings page in application are addressed as
follows:
1. Adherence to Comprehensive Plan —The proposed new facility is located in an area
designated Industrial on the Comprehensive Land Use Plan, thus the application is
consistent with the Plan. (The original facility that burned had existed on this site
since 1969. )
2. Authorization for Zoning District—The requested exception for Height of structure
is authorized in the City Zoning regulations for Industrial.
3. Adverse Effect on Public—This is a build-back. The original facility had no known
adverse effects on the public interest. There are no noise or toxic effluents. The
process is the proportioning and mixing of agricultural commodities to make a dairy
animal feed.
4. Appropriate Use—The subject location is located on the local CSX main Railroad
to the North. To the Northwest and adjacent to the property, is the Walpole feed
mill. Further to the West and along the same rail line are the Dairy Feeds and
Syfrett feed mills. To the East is an LP gas facility and a cell phone tower.
Thus, the facility is consistent with the previous land use and the adjoining and
nearby feed mill properties.
5. Effect on Adjacent Property— It is believed a new modern, clean structure will
enhance the adjoining area for Industrial use. The build-back puts forth a new and
enhanced facility with industrial appeal.
- `6. Screening—The first 105 feet of the structure is internal compartments for stored
bulk materials and presents a smooth galvanized finish. The upper portion does
consist of round 14" diameter pipes arranged in a symmetrical pattern. Basically, it
would be impossible to "screen" the entire structure. Furthermore, while the
structure is higher, most of the old exposed storage bins and equipment are being
removed. The new portion presents a more enclosed streamlined appearance.
7. Density—The main service required is electricity, which would be the same as the
previous facility, thus no new demands. There is no required water or sewer
services except for toilets for 6 employees.
8. Traffic—95% of raw materials (Grains, protein meals, minerals.) are received via
rail, and thus no traffic impact. Processed materials are hauled from the site by
two company trucks with 12 to 15 loads per day.
Again, this is the same as the previous operation up through August, 2011, and
thus no change, and no known traffic or public safety issues.
