0863 Exemption from Early Voting ORDINANCE NO. 863
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
• OKEECHOBEE,FLORIDA,EXEMPTING ITSELF FROM THE PROVISIONS
OF SECTION 101.657, FLORIDA STATUTES,SPECIFICALLY RELATED
TO EARLY VOTING; REPEALING ALL ORDINANCES OR PARTS OF
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the Florida Legislature has adopted revisions to Section 101.657 of the
Florida Statutes, said section relating to Early Voting; and
WHEREAS, State Law allows the City of Okeechobee to "opt our of the provisions of
Section 101.657, the Early Voting requirements, by adopting an ordinance stating
such intent; and
WHEREAS, the City of Okeechobee is contracting the Early Voting requirement to the
Okeechobee County Supervisor of Elections, as provided in State Law; and
WHEREAS, the City of Okeechobee feels that it is in the best interests of its citizens to
opt out of the early voting provision contained in Section 101.657 F.S.
NOW, THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF
OKEECHOBEE, FLORIDA; presented at a duly advertised public meeting; and
passed by majority vote of the City Council; and properly executed by the Mayor
or designee, as Chief Presiding Officer for the City:
SECTION 1. That the City of Okeechobee hereby exercises its right to exempt
itself from the provision of Section 101.657, F.S. and shall contract
with the Okeechobee County Supervisor of Elections to conduct early
voting for the City of Okeechobee at the Office of the Supervisor of
Elections and any other early voting sites the Supervisor may
establish in public libraries and/or city hall.
SECTION 2. If any provision or portion of this ordinance is declared by any court
of competent jurisdiction to be void, unconstitutional, or
unenforceable, then all remaining provisions and portions of this
ordinance shall remain in full force and effect.
SECTION 3. That this ordinance shall take effect immediately upon its adoption by
• the City Council of the City of Okeechobee, Florida.
