Code Officer Sterling testified he has been in contact with the property owner, Mr. Martin, who lives in Canada. The owner
stated he talked to the tenant who constructed the shed and told him he must get the proper permit. In addition, Mr. Martin said
if the tenant does not get the permit he will remove the shed. Member Huckabee moved to find Case 11-035, J. L. Martin
Investments Inc., 520 NE 91h Avenue, in violation of Ch 70 Sec 70-302 Permit, based on the testimony of Code Officer Sterling,
imposing a twenty-five dollar per day fine beginning February 5, 2012 if the permit has not been applied for or the shed removed
by that date; seconded by Member Conrad.

Code Officer Sterling testified property owners, Kurt & Jacqueline Keplinger, had abandoned the property which is now very
overgrown. Mr. Sterling said he made contact with the bank that holds the mortgage, but the bank could not find any record
of the mortgage. Also, Mr. Sterling informed the board that the property owners are repeat violators and a lien is already filed
for $5,725,00. Member Huckabee moved to find Case 11-113, Kurt & Jacqueline Keplinger, 509 NE 91 Avenue, in violation
of Ch 30 Sec 30-43 Public nuisance and Sec 30-44 General cleaning and beautification, based on the testimony of Code Officer
Sterling this is a repeat violation, imposing a fine of five hundred dollars per day beginning October 28, 2011 when property
was posted with the notice of violation, any additional fees incurred by the City for bringing the property into compliance will be
included with the fine; seconded by Member Close.

2011 so he is a repeat violator. Member Conrad moved to find Case 11-116, N & A Construction, Inc., 406 NE 4tn Street, in
violation of Ch 30 Sec 30-44 General cleaning and beautification, based on the testimony of Code Officer Sterling this is a repeat
violation, imposing a fine of fifty dollars per day beginning on November 9, 2011, date notice of violation was received; seconded
by Member Close.
