STANDARDS FOR GRANTING A SPECIAL EXCEPTION [Sec. 70-373(b), LDR page CD70:19] Applicants are required by Sec. 70-373(b)to address the following issues in his/her presentation before the Board of Adjustment. Staff strongly recommends that the Applicant include, in his/her application, materials that address each of these issues in order to allow Staff and the Board of Adjustment sufficient time to adequately consider the Applicant's request. '1. Demonstrate that the proposed location and site are appropriate for the use. The proposed location is adjacent to commercial to the south with residential in the general vicinity, which would be in keeping with the nature of the neighborhood. 2. Demonstrate how the site and proposed buildings have been designed so they are compatible with the adjacent uses and the neighborhood,or explain why no specific design efforts are needed. There are no proposed-buildings only a new use for existing buildings. 3. Demonstrate any landscaping techniques to visually screen the use from adjacent uses;or explain why no visual screening is necessary. Since this is an existing Church, this use would simply extend the hours of operation of the Church no screening is anticipated to be required since the existing parking is more that sufficient to meet this need. 4. Demonstrate what is proposed to reduce the impact of any potential hazards,problems or public nuisance generated by the use;or explain how the nature of the use creates no such potential problems. Since this is an existing Church, this use would simply extend the hours of operation of the Church and since ample parking is provided, no detrimental impacts are anticipated. 5. Demonstrate how the utilities and other service requirements of the use can be met. Since this is an existing Church, this use would simply extend the hours of operation of the Church and no additional utilities or services are anticipated. 6. Demonstrate how the impact of traffic generated will be handled,off site and on site. Since this is an existing Church and ample parking and driveways are available, negative traffic impacts are not anticipated. (Rev.04/11) Page 13 of 11 FINDINGS REQUIRED FOR GRANTING A SPECIAL EXCEPTION [Sec. 70-373(c), LDR pages 19&20] It is the Applicant's responsibility to convince the Board of Adjustment that approval of the proposed special exception is justified. Specifically, the Applicant should provide in his/her application and presentation sufficient explanation and documentation to convince the Board of Adjustment to find that: 1. The use is not contrary to the Comprehensive Plan requirements. This use is allowed by special exception in CLT zoning district. Obviously, if the rezoning is not granted the Special Exception will not be granted. 2. The use is specifically authorized as a special exception use in the zoning district. Yes. 3. The use will not have an adverse effect on the public interest. No, since there is commercial uses just south of the parcel, the pubic interest will not be adversely impacted. 4. The use is appropriate for the proposed location,is reasonably compatible with adjacent uses and is not detrimental to urbanizing land use patterns. Yes, there is heavy commercial zoning to the south of the Church where people will be entering and leaving the facility for this use. 5. The use will not adversely affect property values or living conditions,nor be a deterrent to the development of adjacent property. No, granting of this Special Exception will no be detrimental to property values or living conditions. With other commercial enterprises in the general vicinity, this use will blend in. 6. The use may be required to be screened from surrounding uses to reduce the impact of any nuisance or hazard to adjacent uses. The'proposed use will be of no more impact that the existing use, so additional screening would be require to mitigate any nuisance or hazard. 7. The use will not create a density pattern that will overburden public facilities such as schools, streets,and utility services. The proposed use will be of no more impact that the existing use, so overburden of existing public facilities is not anticipated. 8. The use will not create traffic congestion, flooding or drainage problems, or otherwise affect public safety. The proposed use will pose no more traffic impact than the existing use. There are no change to the drainage pattern so no flooding or drainage problems are anticipated. The City staff will, in the Staff Report, address the request and evaluate it and the Applicant's submission in light of the above standards and required findings and offer a recommendation for approval or denial. The Café will be in the northwest end of the building in some remodeled classrooms as shown on the attached exhibit. 2. How many seats are proposed? Approximately 15 seats are proposed for the Café. 3. What is the square footage of the café? We need this to determine what parking is required under the code for the café. Approximately 320 sf is set aside for the Café with 175 sf for seats and 145 sf as a working area 4. What is the seating capacity of the existing church upon which its parking requirements are based? The church currently has approximately 40 paved parking spaces and approximately 5 acres available for unpaved parking for the approximately 300 available seats in the sanctuary. Since there are no concurrent meeting in the sanctuary and the classrooms the sanctuary parking requirement is the ultimate requirement. 5. How many parking spaces are now provided on site, particularly how many are striped in the concrete parking lot and the asphalt area to the north? There are approximately 40 paved parking spaces available. 6. Assuming the Church wishes to use the provision in Sec. 90-482(6)to allow the café to count the church parking to meet the parking requirement for the café, please give the specific days and hours the café will be open and the specific days and hours the church operations would be using the parking areas.
