Specifically, the Applicant should provide in his/her application and presentation sufficient explanation and documentation to convince the Board of Adjustment to find that: 1. The use is not contrary to the Comprehensive Plan requirements.The use of the property as a non-conforming permitted use is not contrary to the Comprehensive Plan requirements because it is consistent with the future land use map. Such consistency is one of the stated "goals,objectives and policies"of the Future Land Use element of the Comprehensive Plan. The present road system is adequate for the proposed use and has actually supported this use without issue in the past. The requested special exception is not one that will change the use of the property from what it has been used for since at least 1999 according to a worker in the building department who remembers the car wash being there when she moved to Okeechobee. 2 The use is specifically authorized as a special exception use in the zoning district. Section 90-283.Special exception uses states"The following uses and structures are permiteed in the CIIV district after issuance of a special exception use petition...(2)Auto service station,car wash." 3. The use will not have an adverse effect on the public interest.The property has been a beneficial addition to the community for many years,providing a needed service.The pubic interest will benefit from the availability of this service, the investment of new capital into the community,and from the renovation of a property that has been vacated and fallen into disrepair. 4. When a nonconforming use has been discontinued or abandoned for a period of a year, any future use of the property shall be either, a permitted use within the district regulations, or after approval a special exception use permitted in the district. AAI..a1551_ The subject property was built in 2002 as evidenced by the Notice of Commencement attached and was operated as a self serve car wash since such time. The previous owner defaulted on his mortgage with First Peoples Bank and the bank commenced foreclosure. The expiration of the previous special exception was due to the fact that the property was owned and held by the bank for a period of approximately 1 year and 2 weeks and the bank did not operate the business during this time. The applicant purchased the property to be used as a car wash and was unaware of the pending expiration of the special exception due to passage of time. The closing was initially scheduled for June 22, 2011, but was delayed as a result of financing problems and title issues, neither of which were caused by the applicant. (The bank was in the process of being closed by the FDIC and sold and there was a issue regarding whether there was an encroachment of a 100' road right of way for a state road into the property). If the closing had occurred on time, the special exception would not have expired because the applicant would have opened the business immediately after closing. The lapse of this special exception is costing the applicant a considerable amount of money, not only in the expense related to the application for the special exception but in terms of the delay in getting the business opened and operating in order to generate cash flow to pay the mortgage and operating expenses. The applicant respectfully requests that he be granted a special exception in order to continue to run the business that has operated on this site for 9 years.
