1985-06-25 Special Meeting3'755 THE CITY COUNCIL OF THE CITY OF OKEECHOBEE MET IN SPECIAL MEETING IN COUNCIL CHAMBERS, 55 SOUTHEAST THIRD AVENUE, OKEECHOBEE, FLORIDA, AT 2:00 P.M. CHAIRMAN OAKLAND R. CHAPMAN CALLED THE MEETING TO ORDER WITH THE FOLLOWING COUNCILMEN PRESENT: OAKLAND R. CHAPMAN, CHAIRMAN/MAYOR ANDY RUBIN, VICE-CHAIRMAN/VICE-MAYOR EDWARD DOUGLAS, COUNCILMAN OSCAR THOMAS, COUNCILMAN NICK COLLINS, COUNCILMAN OTHERS PRESENT WERE: BONNIE S. THOMAS, CITY CLERK L.C. FORTNER, JR., ADMINISTRATIVE ASSISTANT JERRY BRYANT, CITY ATTORNEY SUE OCHER, DEPUTY CLERK 85-32 THE PURPOSE OF THE MEETING IS TO DISCUSS THE RE -ZONING OF LOTS 1-20 INCLUSIVE OF THE FOLLOWING BLOCKS 1,2,3,4,5,6,7 AND 8 NORTHWEST ADDITION FROM HOLDING TO INDUSTRIAL. ADMINISTRATIVE DIRECTOR L.C. FORTNER READ THE OUTLINE FROM THE MAY 7, 1985, MEETING WHICH STATED THERE WERE OBJECTIONS FROM THE RESIDENTS OF DEANS COURT. MAYOR CHAPMAN REQUESTED A MOTION TO BE MADE THAT THE ORDINANCE BE READ BY TITLE ONLY AND THEN DISCUSSION TO FOLLOW BEFORE A FINAL VOTE. COUNCILMAN DOUGLAS MADE THE MOTION THAT THE ORDINANCE BE READ BY TITLE ONLY AND COUNCILMAN THOMAS SECONDED THE MOTION. MOTION CARRIED. THE MAYOR ASKED IF ANYONE FROM THE AUDIENCE WISHED TO ADDRESS THE COUNCIL. ATTORNEY LESTER JENNINGS ADDRESSED THE COUNCIL ON BEHALF OF THE RUCKS FAMILY. HE EXPRESSED THE FEELING THAT A FAVORABLE IMPACT ON THE COMMUNITY WOULD RESULT UPON APPROVAL OF THE PROPOSED REZONING REQUEST AND HOPED THAT THE CITIZENS OF THE COMMUNITY REALIZED THAT IT WOULD BE BENEFICIAL TO THIS COMMUNITY. MR. JACK HAINES, A MADRAY REPRESENATIVE, ASKED TO BE RECOGNIZED AND ALSO GAVE A FAVORABLE VIEW IN REGARD TO THE PROPOSED REZONING.HE ALSO MENTIONED THAT THE OPPOSITION HAS DWINDLED AND CITIZENS ARE NOW REALIZING HOW BENEFICIAL THE PLANS WILL BE FOR THE COMMUNITY. THE MAYOR READ THE ORDINANCE BY TITLE ONLY AND ASKED FOR DISCUSSION BY THE COUNCIL OR THE AUDIENCE. COUNCILMAN RUBIN ASKED IF MADRAY ENTERPRIZES WAS PLANNING TO CONSTRUCT A DAY CARE CENTER.MR. HAINES REPLIED THAT A PLAYGROUND HAD BEEN DISCUSSED AS A FUTURE PROJECT THAT MADRAY ENTERPRIZES MAY BE INVOLVED WITH BUT THERE HAD NOT BEEN ANY PLANS AS FAR AS A DAY CARE CENTER WAS CONCERNED. COUNCILMAN THOMAS MADE THE MOTION THAT THE PROPERTY BE REZONED FROM HOLDING TO INDUSTRIAL AND THE MOTION WAS SECONDED BY COUNCILMAN DOUGLAS. MOTION CARRIED. COUNCILMAN RUBIN REFRAINED FROM VOTING ON THE MOTION DUE TO CONFLICT OF INTEREST.MAYOR CHAPMAN ASKED COUNCILMAN RUBIN TO STATE THE REASON. COUNCILMAN RUBIN REPLIED THAT (HE PREFERRED NOT TO STATE) WHY HE WAS NOT VOTING. CITY ATTORNEY BRYANT EXPLAINED THAT THE REASON FOR COUNCILMAN RUBIN'S REFUSAL TO VOTE WAS NOT A CONFLICT OF INTEREST BUT BECAUSE OF MR. RUBINS INVOLVEMENT AT THE PLANNING BOARD MEETING. MOTION CARRIED. MAYOR CHAPMAN READ THE ORDINANCE CONCERNING THE STREET CLOSING. MR. FORTNER EXPRESSED CONCERN OVER NORTH FOURTEENTH STREET ALONG THE CITY LINE BECAUSE OF THE LARGE DRAINAGE DITCH ALONG THE LINE FOR FUTURE CLEANING ACCESSIBILITY BY THE CITY OR THE COUNTY.HE SUGGESTED THAT THE MAINTENANCE OF THAT DITCH BE CONSIDERED AT THIS TIME. SECTION THREE OF THE ORDINANCE WAS DISCUSSED AMONG THE I COUNCILMEMBERS AND THE CITY ATTORNEY AS TO ITS' INTERPRETATION. 3756 �/- 2 �f - ? MAYOR CHAPMAN ASKED DIRECTOR FORTNER IF HE NEEDED AN EASEMENT IN ORDER TO CLEAN THE DITCH IN QUESTION.ADMINISTRATIVE ASSISTANT L.C. FORTNER REPLIED THAT THE COUNTY COULD CLEAN THE DITCH FROM THE NORTH SIDE SINCE THAT PROPERTY WAS OWNED BY THE COUNTY. COUNCILMAN THOMAS MADE THE MOTION TO READ THE ORDINANCE IN ITS ENTIREITY WITH THE PROPOSED CHANGES INCLUDED. COUNCILMAN RUBIN SECONDED THE MOTION. MOTION CARRIED. ATTORNEY BRYANT READ THE ORDINANCE WITH PROPOSED CHANGES. COUNCILMAN COLLINS MADE THE MOTION TO ADOPT THE ORDINANCE AS READ BY CITY ATTORNEY BRYANT. THE MOTION WAS THEN SECONDED BY COUNCILMAN THOMAS.
