There were none. Council briefly noted that the purpose of adopting this ordinance was explained in detail at the first reading by the Planning Consultant. This is the final step for the City to comply with adopting a 10-year water supply plan through the Comprehensive Plan. E. Consider holiday meeting schedule - City Clerk (Exhibit 6). ITEM ADDED TO THE AGENDA: Update on water issues by Gary Ritter, SFWMD. Council Member Watford moved to adopt the holiday meeting schedule as presented (in Exhibit Six, only one meeting per month and those will be November 1s' and December 61h); seconded by Council Member O'Connor. Mr. Gary Ritter, of SFWMD briefly addressed the Council to give them an update and answer their questions on the water levels due to the recent rains. We finally have water to manage, due the amount of rain fall from Orlando, south to Palm Beach, the locks along the Kissimmee River are closed for at least another week to move water south. The Lake is now at 12 feet, therefore the locks along the rim canal are back in operation. This still puts the lake at three - feet below normal. Models are indicating that by January 2012 the lake should be at its normal levels. However, we are not out of the woods within all our service counties, and are still asking citizens to continue to conserve water and continue the 2-day a week watering schedules. The Mayor and Council thanked Mr. Ritter for keeping them informed. �3a OCTOBER 18, 2010 - REGULAR MEETING - PAGE 5 OF 6 AGENDA VIII. NEW BUSINESS CONTINUED. F. Discussion pertaining to a proposed park at Southeast 61h Avenue and 71h Street and park committee appointments - City Administrator. COUNCIL ACTION - DISCUSSION - VOTE At the October 4, 2011 regular meeting, the Council approved the formation of a Park Committee and instructed the Clerk to advertise for citizens to apply in order to be considered for appointment to the committee. The Clerk's Office received the following applications completed by: Phil Baughman, Jimmy Causier, John Creasman, Frank DeCarlo, Toni Doyle, Jamie Gamiotea, Albert Jacks, Patti Mullins, Bobbi Poole, Daryl Roehm, and Ray Worley. The Council originally decided to appoint seven members to the committee. However, after a tie vote twice, for the appointments, it was decided to appoint the following nine applicants: Phil Baughman, Jimmy Causier, John Creasman, Frank DeCarlo, Toni Doyle, Jamie Gamiotea, Patti Mullins, and Daryl Roehm. Council Member Maxwell distributed copies of a proposed task list for the Committee to use as a guide to help them with their discussions and recommendation for reporting to the Council. The consensus of the Council was to instruct the Committee to utilize the list which contained the following eight questions: 1. Is the parks/recreation a service that is demanded by the citizens? 2. Is the improvement of public spaces, including parks and streetscapes, important enough to include such improvements in the Capital Improvement Program? 3. Would it be appropriate to survey the citizens in order to gauge the level of satisfaction of all of the services that the City currently provides, and determine the public's opinion as to items one and two? 4. What type of improvements would best satisfy the demands for recreation and fitness opportunities, and in what priority? Is the Southeast 6`h Avenue-7`h Street property worthy of being improved, with such improvements included in the Capital Improvements Program? 6. Which types of recreation opportunities and improvements would best be suitable for the Southeast 6`h Avenue-71" Street property? 7. Which types of recreation opportunities and improvements are important for planning purposes, even if they are not suitable for the Southeast 6'h Avenue-7" Street property? WHEREAS, the City Council of the City of Okeechobee recognizes the need to plan for orderly growth and development; and WHEREAS, the City Council of the City of Okeechobee has adopted a Comprehensive Plan by Ordinance No. 635, as amended, in accordance with the Local Government Comprehensive Planning and Land Development Regulation Act; and WHEREAS, Chapter 163, Florida Statutes, and Rule 9-j-5, Florida Administrative 6ode provide for amendments to be adopted to Comprehensive Plans; and WHEREAS, the State Legislature of the State of Florida has mandated that all local governments draft and adopt include a 10-year Water Supply Facilities Work Plan based on the Regional Water Management District's Water Supply Facilities Work Plan, into their Comprehensive Plans to strengthen coordination of water supply planning and local land use planning; and WHEREAS, the South Florida Water Management District's Kissimmee Basin Water Supply Plan 2005-2006 Update was prepared and approved in accordance with Chapter 163, Florida Statutes; and WHEREAS, the City of Okeechobee recognizes the need for better integration of land use planning, development and water supply; and Ordinance No. 1076 Paae 1 WHEREAS, the Planning Board acting as the Local Planning Agency held its duly advertised public hearing on October 15, 2009, reviewed the proposed Amendment provided as Attachment A herein, and forwarded its recommendation to the City Council for transmittal to the State Land Planning Agency (DCA); and WHEREAS, City Council has agreed with the recommendations of the City's Planning Board, and at a duly advertised hearing on November 3, 2009, approved the proposed Comprehensive Plan Amendments, provided as AttachmentA herein; and WHEREAS, the City has received and responded to the Florida Department of Community Affairs' Objections, Recommendations and Comment (ORC) Report regarding the proposed Amendments; and WHEREAS, after notice of a Public Hearing being duly published, the City Council art approved the proposed Comprehensive Plan Amendments provided as Attachment A herein. WHEREAS, Ordinance No. 1056 as adopted but not transmitted requires an amendment pursuant to changes in Chapter 163 Florida Statutes during the interim between adoption and transmittal. NOW, THEREFORE, BE IT ORDAINED by the City Council for the City of Okeechobee, Florida; presented at a duly advertised public meeting; and passed by majority vote of the City Council; and properly executed by the Mayor or designee, as Chief Presiding Officer for the City: Section One. That the City of Okeechobee, Florida hereby adopts amendments to its current Comprehensive Plan dated March 19, 1991, as amended, which amendments consist of the pages which are identified as Attachment "A", and provided herein; a copy of the Amendments are on file at City Hall in Okeechobee, Florida. Section Two. That the City Clerk is hereby directed to transmit three(3) one 1 paper coy and two (2) electronic copies of the amendments of the current Comprehensive Plan to the State Land Planning Agency, along with one (1) copy to the Central Florida Regional Planning Council; Florida Depaftment of Education, Florida Department -of Environmental Protection, Office of intergovernmental ; Florida Department of State, Division of Historic Resources; Florida Department of Transportation, Office of Tourism, Tmde, and Economic Development" and the South Florida Water Management District, and to any other unit of local government who has filed a written request for a copyin accordanee with Section 163.3184(7), Florida , . Ordinance No.1076 -Page 2 Section Three. That all ordinances or parts of ordinances in conflict be and the same are hereby repealed. The effective date of this plan amendment if the amendment is not timely challenged, shall be 31 days after the state land planning agency notifies the City of Okeechobee Florida that the plan amendment package is complete. If timely challenged, this amendment shall become effective on the date the state land planning agency orthe Administration Commission enters a final order determining this adopted amendment to be in compliance. No development orders development permits or land uses dependent on this amendment may be issued or commence before it has become effective. If a final order of noncompliance is issued by the Administration Commission, this amendment may nevertheless be made effective by adoption of a resolution affirming its effective status a copy of which resolution shall be sent to the state land planning agency. Section Five. That to the extent language in this Ordinance conflicts with that set forth in Ordinance No. 1056, the language of this ordinance shall supercede that of Ordinance No. 1056. The City will also ensure that adequate water supplies and facilities are available and in place prior to issuing a certificate of occupancy or its functional equivalent. This determination will require the demonstration by the Okeechobee Utility Authority (OUA) at the building permit stage that a consumptive use permit has been issued to OUA with sufficient allocation available to serve the new development, given all other existing commitments for that allocation within the entire OUA service area. A-1 Policy 1.7: Utility connections mandatory for new development: All new development and redevelopment within the City of Okeechobee shall be required to connect to the public potable water and sanitary sewer systems in the following manner: (1) Where water and/or sanitary sewer service lines are in place immediately adjoining the property and service is available, the property shall be required to connect to the system(s) and no development permit shall be approved until such time as financial arrangements with OUA for the Payment of connection fees and capital outlay fees associated with required connection to the system(s) have been completed. (2) Where reuse water service lines are in place immediately adj ininq the property and service is available, the property shall be required to connect to the system(s) and no development permit shall be approved until such time as financial arrangements with OUA for the payment of connection fees and capital outlay fees associated with required connection to the system(s) have been completed. (3) Where reuse water service lines are not in place adjoining the property and reuse service is not available, the developer shall work to install a water reuse distribution system as feasible, and in coordination with QUA. Policy 1.8 Utility connections mandatory for existing development upon a change in ownership: (1) Where potable water and sanitary sewer service lines are in place and service is available immediately adjoining the property, any use not connected to the potable water and/or sanitary sewer system shall be required, at the time of a change in ownership to connect to the system(s). (2) No development permit shall be issued or other required approval granted, until such time as financial arranqements with OUA for the Payment of connection fees and capital outlay fees associated with required connection to the system(s) have been completed. Mr. Williams is still the mapping consultant for the Property Appraiser and we continue to share the same updated information, which in turn keeps the City's costs down. Since there is no other mapping company that works for the Property Appraisers Office conducting this type of work, I have requested that the City Administrator approve and recommend that this be considered a sole -source based on maintaining operational standards and serves as the best working relationship with the Property Appraiser's Office. In keeping with Code Book Sec. 2-288. Department Heads may recommend purchase of a specific brand if they feel, through experience or analysis, that only that brand will serve the best interest of the City. Factors which might warrant sole -source purchasing could involve compatibility with existing equipment, maintaining operational standard, or lesser serves requirements which reduce down -time and maintenance cost. Bell 607 SE Sixth Ave. Okeechobee, FL 34974 October 13, 2011 Okeechobee City Commissioners Mayor James Kirk Brian Whitehead, City Administrator 55 SE Third Ave. Okeechobee, FL 34974 Dear sirs; I am writing in regards to my concerns about the proposed city park on Sixth Ave. There are several reasons I am opposed to the park. First is the expenses of a park in these weak economic times. I understand much of the initial setup will be donated and that is admirable. Will maintenance costs be donated as well? Are you planning on having an attendant on premises to take care of the property? Public restrooms must be cleaned, wading pools must meet standards for sanitation. Are we going to pay for those services? Will it be fenced and gated to protect it from vandalism? We have several homeless people in close proximity to this area. What about liability insurance, especially right here on Taylor Creek? This is starting to sound rather costly. I believe the cost of maintenance will be a drain on our already slim coffers. Next, this is a quiet residential area. Many of the residents are retirees and/or widows. I myself am a widow and I am nervous about the increased traffic in this area. People walk for exercise around our quiet streets, you see people with baby strollers enjoying some fresh air. Increased traffic and activity would hamper these type of activities. Finally I have spoken to several residents in the area. Many were not even aware of the proposal. Most who knew did not understand what was going to be installed there. I agree, a nice city park would be an asset to our community. Put it where people have easy access, not in a quiet residential area. Many people I have spoken with don't even know where the property is located. I appreciate your time and service. Please take my concerns into consideration. Thank you, Ann S.
