PROCLAMATIONS AND PRESENTATIONS - Mayor. A. Proclaim October 5, 2011 as "International Walk to School Day" continued. (Continued from page 1) that children face on their trip to school each day and the health and environmental risks related to physical inactivity and air pollution; and WHEREAS, children, parents and community leaders around the world are joining together to walk to school and evaluate walking and bicycling conditions in their' communities. NOW THEREFORE,1, James E. Kirk, by virtue of the authority vested in me as Mayor of the City of Okeechobee, Florida, do hereby proclaim October 5, 2011 as International Walk to School Day and encourage everyone to consider the safety and health of children today and everyday. " Ms. Sylvia Zenith of the Okeechobee County Health Department, and Mrs. Pat McCoy, Principal of North Elementary School (NES) were present to receive the proclamation. Mrs. McCoy remarked that all children attending NES will have the opportunity to walk to school, including those who ride buses, will be dropped off at Northwest 10'h Terrace and will walk. This is their third year NES has participated in this event to encourage safety and health for the children. B. Present Deputy City Clerk Melisa Jahner with her Certified Ms. Tracy Ackroyd, MMC, City Clerk of Clermont and Florida Association of City Clerks Central East Director presented Municipal Clerk accreditation by Tracy Ackroyd, Florida Association Deputy City Clerk Mrs. Melisa Jahner with her Certified Municipal Clerk accreditation certificate and pin. The Certified of City Clerks Central East Director. Municipal Clerk program is designed to enhance job performance and recognizes the professionalism of Clerks by requiring extensive education and pertinent experience to receive this certification. V. Council Member O'Connor moved to approve the first reading of proposed Ordinance No. 1076; seconded by Council Member Williams City Senior Planner, Mr. Bill Brisson, addressed the Council, explaining that Ordinance No. 1056 was adopted on March 15, 2011. It was withheld from being sent to the Department of Community Affairs to re-evaluate the information from South Florida Water Management District and the County. Also, during that lapse, new legislation was being considered. Planning Staff concluded it was in the City's best interest to wait until the clarification of the significant legislation by DCA and the re -submit the changes. The necessary action is to re -adopt as originally presented but change the format to separate the Comprehensive Plan's Data and Analysis from the Goals, Objectives and Policies. Consider a motion to approve a Temporary Street Closing Request from Main Street to close Southwest 3`d and 41h Avenues between North and South Park Streets from December 9, 2011 at 5:00 p.m. to December 10, 2011 at 10:00 p.m. for the Annual Christmas Festival and Parade - City Administrator (Exhibit 3). COUNCIL ACTION - DISCUSSION - VOTE VOTE KIRK - YEA MAXWELL - YEA O'CONNOR - YEA WATFORD - YEA WILLIAMS - YEA MOTION CARRIED. Council Member Watford moved to approve a Temporary Street Closing Request from Main Street to close Southwest 3`d and 4`h Avenues between North and South Park Streets from December 9, 2011 at 5:00 p.m. to December 10, 2011 at 10:00 p.m. for the Annual Christmas Festival and Parade; seconded by Council Member Williams. KIRK - YEA WATFORD - YEA VOTE MAXWELL - YEA WILLIAMS - YEA O'CONNOR - YEA MOTION CARRIED. Ms. Cindy Birdashaw, President of Okeechobee Main Street (OKMS) requested permission for the use of sidewalks, and waive the temporary use permit fee, so the merchants can hold sidewalks sales on December 10, 2011, as a way to attract business and build up the downtown area during the community festival and parade. Administrator Whitehall noted that he would request to meet with Public Works Director Robertson and Okeechobee Main Street to set ground rules that would accommodate the pedestrians and benefit the participating merchants. It would be the responsibility of OKMS to inform the merchants of these rules and compliance. Council Member Watford applauded their efforts to draw attention to the downtown area and assist the merchants. He reflected on times past when merchants stayed open later to accommodate those attending the parade. It was a nice atmosphere with Christmas caroling and a lively downtown area. Council Member Watford moved to allow the use of sidewalk sales during the Annual Christmas Festival, December 10, 2011 in the Central Business District; second by Council Member O'Connor. NEW BUSINESS CONTINUED. C. Motion to approve Southwest 21 s' Street Storm Sewer Project Funding - City Administrator (Exhibit 5). Administrator Whitehall requested the next item be discuss before the motion was established to address any questions or concerns. He informed the Council that the County solicited and has been approved for state funding to assist with the Southwest 21S` Street Storm Sewer Project. The Board of County Commissioners requested the City to contribute funds since the City is within the boundaries of the project. He also explained that he has given the County the informal offer of twenty thousand dollars ($20,000.00), which would be taken from the gas tax fund. The status of the project is they are ready to receive bids. Council Member O'Connor requested a cap be put on our offer and that the City participate in any change orders. Council Member Watford was concerned with the mechanics of this project and what authority the City would have on decisions. Council Member Maxwell stated this project is entirely in the City so we should have an opinion of the scope as well as the funds. Mayor Kirk mentioned that even though this project consists of property in the City we are only a small portion to benefit from it and are only funding a small amount, so our authority does not hold much weight. Administrator Whitehall explained the change orders can be brought back to Council for consideration. Council Member O'Connor asked who would be responsible for any maintenance of the project after completion. Administrator Whitehall answered the contractor has a bond of up to one year after which it will become the City's responsibility. Council Member Watford stated his dislike in the manner the City was not consulted ahead of time with all the details, but does appreciate the effort to improve the drainage in the Southwest area. Council Member Watford moved to approve participation in the Southwest 21 st Street Storm Sewer Project with the City's portion being not more than 13 percent or twenty thousand dollars ($20,000.00); and City Staff has authority to review any change orders; seconded by Council Member Williams. Discussion pertaining to a proposed park at Southeast 6`h Avenue Administrator Whitehall distributed conceptual site plans for a proposed park to be situated on 1.95 acres of vacated and Southeast V' Street - City Administrator (Exhibit 5). City property located along Taylor Creek, East of Southeast 6" Avenue and 7th Street, Council Member O'Connor has been enthusiastically approached by City and non -City residents to move forward with the proposed park ideas. He has received many offers for in -kind services to see this through fruition and to assist with the $215,224.00 estimated 11 cost. Discussion pertaining to a proposed park at Southeast 6`h Avenue and Southeast 7`h Street continued. Mr. Frank DeCarlo, Mr. J.D. Mixon, Mr. Donald Hagan, Mr. Mack "Hoot" Worley, the Honorable County Judge Jerry Bryant, Mr. Stan Curren, and Mr. Steve Nelson were present to speak in favor of the park. Some mentioned their childhood memories of growing up near Taylor Creek. Their comments pertained to the area being under utilized as an attraction to and for the City. We are in dire economic situations, but there are willing citizens to make this happen and it would improve the quality of life. Judge Bryant noted that even the City Seal has a sailboat on it which represents the heritage of a waterway lifestyle. Mr. Lowry Markham, lives in the area and spoke of his opposition. There are concerns of traffic, noise and safety issues. Also, the creek itself is a safety concern as it is not suitable for swimming or any other activity except boating and it does not have a barrier. This is a big project for the City to undertake in such hard economic times, and it will be costly to maintain. He noted he is not against parks, but not near a residential area and not as big of a park as proposed. Council Member Maxwell remarked that now is the time to take action. Even though these are hard economic times there are willing parties to make this happen, whereas, in the past when the economy was more fruitful and abundant, still nothing was done regarding community recreation. He is in favor of this park and suggested implementing phases instead of completing all at once. Council Member Watford stated that this is a tough situation, it is not good timing. Council Members Williams and Watford are willing to consider but not obligate any funds at this time. Council Member Watford noted that most cities have areas identified throughout their community as to whether open space or parks are best suited as active versus passive. This is based on the surrounding area and existing infrastructure. The conceptual plans of this park would be considered active recreation when perhaps that area should be passive recreation. Discussion then turned toward forming a Citizen Park Committee. Mayor Kirk instructed Clerk Gamiotea to advertise and take applications for the formation of the City Park Committee, and present at the next regular City Council Meeting, October 18, 2011. ITEM ADDED TO AGENDA: Motion to appoint Ray Worley to the Police Council Member Watford moved to appoint Mr. Ray Worley to the Police Officer Pension Fund Board of Trustees, term Officers Pension Fund Board of Trustees, term beginning October 5, 2011 beginning October 5, 2011 to September 30, 2015 (replacing Louise Chandler); seconded by Council Member to September 30, 2015 (replacing Louise Chandler) - City Clerk (Exhibit). County got state funding approved. 75/25 local match, BOCC thought it of interest for the City to contribute toward this. Use gas tax money and we have the budgeted amount. $19,000. City play a roll in any change orders as well. Bid sheet distributed in exhibit 4. Watford, did you discuss the city's portion with the county? Kirk, discussion with one of the commissions and Brian, not sure they are going to commit. Have done engineering and are ready for bids. O'Connor, other project kept going up. At first we weren't going to have to contribute, they always change their tune, cap would be the only way and we participate in the change orders. Brian I suggest $20,000 even to give as a cap. Worse case scenario I could come back. Maxwell, entire project is in the city, we need say so in the scope as well as the funds. Brian, the city is not the only beneficiary of this project. The collection system is to protect the residents in County with significant weather. Collection system that will benefit the county residents. The equity will show up on our net worth. Maxwell, some control over Brian, what do you mean? Maxwell, proposed decreases as well as increases Brian, thought you meant increases, landscaping, driveways, benefit cosmetically Maxwell, that's one way, other Watford, how would the mechanics work? That we approve all change orders? Brian, Corp authority will be one to approve the change orders. Council? I was thinking staff would do. Or amounts that are more than the match would trigger. Rethink our position on change orders that the city si originally. Dissecting the project more than we need to tonight. Watford, staff would be better. Brian, your already putting a cap on it. Maxwell, right of review that would effect the city citizens. Mike, do the job, over with, something in the city not working, who will fix it? Contractor has a construction bond to fix anything up to one year. Then it would be our problem to fix. However, this is an instance it was handled not the way it should have been, consulted ahead of time, perhaps same individual as the radio project, kind of wonder if we are being treated fairly in these instances. Chris Close and I talked about the prospect of this park. Bob did the conceptual idea. Hoot Whorley wants to participate. $35,000 of in -kind pledges for the development of this park. JD Mixon, Curren Electric. Albert Snow, Chief Billie. 71 names of people and organizations that want to participate. Name on plaque for donations. Name plaque to put everyones name on there to remember those that got behind this thing. It's a good place for families to go. Parents don't have enough money to take kids out of here. Grill out there, family times. Kirk, cost wise? Mike, Close construction gave a list of items that were attached in the Status report. $215,224.00. Then the in kind services will deduct the costs. Frank DeCarlo, think it's a perfect place. Even the schools could use it. OCA is just down the street and they could use it as well. JD Mixon, approval for the minimal regatta, looking for a site within town along taylor creek, when I came across this site and realized it belonged to the city, and then the possibility of a park one day, its within walking distance of a number of homes. Thank it's a great spot and that you will agree to it. Hagan, live in the neighborhood, think it will be a positive, minimal traffic surrounding, safer for children. Can address a fence to keep smaller children away from the water. Plus for community and our families. I live in that area and I don't agree. Water not suitable for swimming, fishing not that great there. Kids being on the docks all night. Bathrooms will be used by the homeless. Sitting right in the middle of the neighborhood. Lived in the neighborhood for the last 65 years. Money with everybody, people laying off, don't have jobs. Not any body going to tell us when this turn around is going to be. People I've talked to said its not time to spend the money right now. Hoot Whorley, speak to you in 2 capacities, chair economic council, personal support, give him quality of life committee, thought it was very respective, favorable, general membership, then board of directors, didn't reach a consensus, thought favorable and those whorley, grew up in ft pierce, neighborhood played on a city park, swings and slides, judge what we should do with life experiences, city park where people can actually be used. Then want to speak to you in a parable, man had $65,000 in reserves, one Judge Bryant, speaking for mother property, I grew up on that property, enjoyed going to the creek, cant get to the creek any more, on the seal, sail boat on the creek, old photograph, old fish houses, creek has been important for almost 100 years, under utilized for our city, one of the vew few left made available to the community. Immediately thought it was a great idea. Idea so many people willing to contribute to the park makes it even better. Understand economic situation but life still goes on. You are in charge of the quality of life for this community. Cleaner than I've seen it in years. Citizens would appreciate having that available. For the amount of money it may cost you will be a deal contribute to the community. William Stan Curren, growing up had the luxury of walking up and down the streets, our kids don't, my grand kids could use this, think it would be an asset to the city.. Steve Nelson, okee disc drugs, OUA chair, dedication to the city willing to step up for the proposed park, timing is right, Idr committee, give back to the people need something to give the people they can be proud of, the vision that we have, offers the kids and adults a place to come to, willing to go beyond and help with raising necessary funds, spoke with john hayford, oua do their share to keep the area maintained, undertake public bathrooms and showers, timing is right, hope you will pass necessary to do this, others willing to raise the bulk of the money, give us the opportunity to do that. Maxwell, not a request before us, but the big question is how to pay for the park, big proponent of green space and parks, one thing to talk about them another to get them done. Economic situation makes you not want to, but when we weren't in these times we didn't do anything either. Need to do this and long term goals for other quadrants for recreation. Not proportionate enough for capital improvements. Think we should do. Do we need to dedicate it a park, as right now its just open space. Work on putting these other items. Move something forward, concept to approve, just not all the funds at this time. Suggest work through getting it paid for, budget, rather than just say no park. Brian, heard from each city council man everyone agrees the property is a waste as it is now. First shown, ambitious, perhaps phase it in. This audience is enthusiastic need to make sure the park is being used. Establish a committee to handle. Mike, it's a conceptual idea not a plan set in stone. Everything can be tweaked. Don't know if they are catching any fish but there are a lot people fishing. Watford, procedure is greatly flawed, council not put in a difficult decision. Should have been little better direction. Timing not good for this. Funding, didn't get the parable. Funding, wins the lottery, next year completely broke, nickle and dime our Page 6 of 8 reserves to death. Traditionally the county has provided the recreation for the parks. If were going to go with this really need to consider other areas we have and if we're going to do the same type thing. Water access is a hot topic in florida. Council had an opportunity to have more access through a street that was closed. Would not support funds from reserves, fund other ways that's fine. If we're going to do need to look at maintenance and the forces of vandalism. Williams, agree location, wish it was a little larger, have some concerns, traffic, parking, other cities have closed up their parks, reserves are a problem, not for taking out of the kiddy going to need it, working group that could identify grants or other funding sources. Will have some exposure. Willing to consider but not obligate the funds. Hoot, the reserves your talking about? The capital improvements or total? Your sitting on $10 million in reserves and %4.6 million in capital improvements. Estimate $215,000 less than 4% of the capital improvements. $185,000 left after in kind, your talking about 2.8% of the total you have set aside for capital improvements. I appreciate your fiscal conservativeness. But I think the pendulum has swung too far the other way. Could you spend the money on this park to make the quality of life better. Markham, one thing I'd like to have someone do and have someone go to the county parks, cars parked all over the place, people walking along the streets. Not against having parks but just don't think the time for this big of a park you're going to have people living closely to this park. Watford, don't know how thins will finally end up here, the location of this need to be careful, active recreation areas and passive recreation areas, basketball courts gets intense. Volleyball can get intense, you want it more for passive recreation just because of the area its in. Nelson, respect everyone's point of view why not appoint a citizens board? Kirk, Mike, Maxwell, has to be some indication for staff to know where to move, phasing, or citizen advisory committee, can do minimum things and see whether people use them, council needs to approve concept first. Don't' think we have enough information. Mayor - Take citizen board applications for a Park Committee and present at next meeting (Oct 18). The Citv will also ensure that adequate water supplies and facilities are available and in place prior to issuing a certificate of occupancv or its functional equivalent. This determination will require the demonstration by the Okeechobee Utility Authority (OUA) at the building permit stage that a consumptive use permit has been issued to OUA with sufficient allocation available to serve the new development, given all other existing commitments for that allocation within the entire OUA service area. A-1 Policy 1.7: Utility connections mandatory for new development: All new development and redevelopment within the City of Okeechobee shall be required to connect to the public potable water and sanitary sewer systems in the following manner: (1) Where water and/or sanitary sewer service lines are in place immediately adioining the property and service is available, the property shall be required to connect to the system(s) and no development permit shall be approved until such time as financial arrangements with OUA for the Payment of connection fees and capital outlay fees associated with required connection to the system(s) have been completed. (2) Where reuse water service lines are in place immediately adjoining the Property and service is available, the property shall be required to connect to the system(s) and no development permit shall be approved until such time as financial arrangements with OUA for the payment of connection fees and capital outlay fees associated with required connection to the system(s) have been completed. (3) Where reuse water service lines are not in place adjoining the property and reuse service is not available, the developer shall work to install a water reuse distribution system as feasible, and in coordination with, QUA. Policy 1.8 Utility connections mandatory for existing development upon a change in ownership: (1) Where potable water and sanitary sewer service lines are in place and service is available immediately adjoining the property, any use not connected to the potable water and/or sanitary sewer system shall be required, at the time of a change in ownership, to connect to the system(s). (2) No development permit shall be issued, or other required approval granted, until such time as financial arrangements with OUA for the Payment of connection fees and capital outlay fees associated with required connection to the system(s) have been completed. Policy 2. 1: The City Administrator shall continue to evaluate and rank capital improvements projects, proposed for inclusion in the five-year capital improvements program, for which the City has financial responsibility, A-2 Policy 2.2: Capital improvement projects for which the City has financial responsibility shall be ranked according to the following priority level guidelines: Priority One: The project is needed to protect the public health and safety, or to fulfill the City's legal obligation to provide facilities and services. Priority Two: The project increases efficiency of existing facilities, reduces improvement costs, provides service to developed areas lacking full service, or promotes infill development. Priority Three: The project represents a logical extension of facilities or services within a designated service Area. Policy 8.4: The City will continue to cooperate with the South Florida Water Management District (SFWMD) in its efforts to restrict the unnecessary consumption of potable water, particularly as it relates to irrigation, lawn watering, and car washing during periods of drought, supply reduction, and other emergencies. Policy 8.5: The City shall inform residents and businesses of, and shall encourage their participation in conservation programs of the SFWMD, Okeechobee County or OUA. These information and educational efforts shall include the following types of efforts: a. brochures and signage to be made available at City Hall; b. pursuing funding through SFWMD Community Education Grant and coopera- tive funding programs for educational efforts such as demonstration gardens and Prototype landscaping on public properties; and, c. Inviting speakers for forums or workshops at City Hall. Policy 8.6: The City shall coordinate local water conservation education efforts with the SFWMD, the Okeechobee Utility Authority (OUA), and the Okeechobee County School Board. Policy 8.7: The City will promote and encourage homeowner and landlord participation in the County's initiatives and programs for water conservation through retrofitting indoor plumbing with low flow fixtures, and the use of low impact development techniques (,such as the Florida Water Stars'" program, which is a point based, new home certification program for water -efficient developments, similar to the federal Energy Star program). Policy 8.8: The City will assist in enforcement of eeferse the SFW MD's lawn and landscape irrigation rule, which limits irrigation to two days per week between the hours of 4 p.m. and 10 a.m., with some exceptions, as may be revised. Policy 8.9: The City shall develop a water audit program for all City facilities, including irriga- tion by the end of 284-2 2014. The City shall also consider developing a water audit program, including irrigation systems, for the public. Again, this is simply a matter of recording a document that by all account should have been recorded 50 years ago, but there is no record thereof. The City plats already currently reflect that NW 3rd Av north of the RR to NW 9th St is vacated. • SW 21 Storm Storm sewer project funding.— I'm attaching a 2-page exhibit to the Agenda that reflects the engineer's estimate for the project. The total Eng est is $586,957 of which 75% is to be paid for by a grant, leaving $146, 739 (25%) local match. No bid date has been established and this is only an estimate of the project costs. The County has paid all engineering to date for the design ($56,118) and that along with the est $49, 280 for construction observation is incl in the $586,957 amt mentioned above. As this project is clearly a public facilities (gas tax) expenditure (vs. General Fund), I arrived at what might be an appropriate financing compromise. We calculated the total County and City gas tax revenue and arrived at the following prorated percentile — County 87%, City 13%. Applying that proration to the matching contribution, the City portion would be $19,076... based on the current estimate (before bidding). I'm recommending that the City contribute 13% of the 25% match to the final project cost (currently est at $19,076), utilizing Public facilities monies. • Proposed park at SE 61h Av and SE 71h Street — Attached pls find some literature on the proposed park. • Legislative Day is Oct 12 — Attached pls find the legislative issues that we plan to have Councilman Watford present at the Oct 12th meeting. Again, the leg session begins Jan 2012 and ends March 9. • Main Street Christmas fest and parade — 12/9 (5:00pm) thru 12/10 (10:00pm) is on the Agenda. Further, Main Street is initiating a downtown holiday sidewalk sale. Representatives will be present to discuss the matter. • Ten-year Water Supply Plan (WSP) reaffirmation Ord is on Agenda — In March 2011, the City adopted the Water Supply Plan Ordinance. Immediately thereafter, we were advised that there was some minimal changes proposed by SFWMD... we waited to re -submit to DCA. In the meantime, there was a legislative prospect that the Plan may no longer be required. In the end, there was no complete repeal of the legislative requirement, but there was a modification on the City's Comp Plan amendment requirement. Instead, the City now simply needs to reaffirm the WSP in ordinance form and submit to the State by Dec 28th. Page 1 1014111 Activity Rpt Cont'd - Impact fees/consultant selection - In August the County accepted consultant proposals for an impact fee compliance review. I gave you a brief synopsis on how staff ranked the consultants which included, Walter Keller, Inc (Current), Tindale-Oliver & Assoc, TischlerBise, inc., and Duncan/Kimley Horn & Assoc. One of the nagging reasons I haven't proposed the City take any action on the consultants is the fact that we are in the midst of a moratorium and I can't see that being lifted soon. It's recommended that an entity do a formal review of their impact fee schedule and procedure every 4-5 years. We implemented the program in 2007. In the scenario of a continued moratorium of, say 3 or 4 years, it may just be a waste of monies (approaching an est of $20k) to do it now, not knowing what might change on top of the fact that we have already essentially exhausted all of our impact fee funds. CDBG for housing repair grant - Staff met w/ Nancy Phillips and Clint Hines (construction mgr), to review the administration of the grant. - Sep expect to begin soliciting for applications (30 day window) - Nov/Dec expect Council approval of a list of applications in qualified rank order - Jan/Feb expect Council to approve the bids for the work and construction to commence. Note: the program will ignore the City's local vendor pref ordinance - The grant funded improvements are treated as a secondary lien on the property which reduces 1/7`h ea yr over the following 7 yrs. - There are plenty of quirks w/ the program that will be reviewed w/ the Council when presented w/ the ranking list. - Again, City's goal w/ the $700k grant is to fund approx ten housing rehabilitation projects for low-income residents at an average cost of $59k. Hurricane preparedness - EOC Director, Mitch Smeykal, will be seeking Council approval on a 5-yr "mitigation strategy plan" at a coming meeting. Again, at some point he will initiate one-on-one conferences (to avoid the open meeting act) w/ each Councilman (and Commissioner) who will act as Policy Advisors in the event of a hurricane. In the mean time, Mr. Smeykal directed our attention to www. FloridaDisaster. org a web site for Florida's Div of Emergency Management. City Attorney/litigation issues: • Chamber eviction - There is no new court trial date set as of this date. The trial was delayed as a result of the bullet below: ➢ Rec'd a copy of an 815111 letter fr IRS to the appointed Judge, Robert Belanger, requesting a delay in the eviction proceedings until the IRS can have representation at the meeting. ➢ Have spoken to a cpl of IRS tax advocates, the latest gave his impression that if the IRS is unable to capture anything for the lease value they could foreclose on the property, but added that that scenario is highly unlikely... particularly after I explained the ownership issue. He expects that the IRS will simply release the property after liquidating the personal assets. He confirmed that if the eviction proceeds are successful the lease value would become worthless. Page 2 1014111 Activity Rpt Cont'd (City Atty)- Carter Pritchett Advertising v. City billboard issue - Recently, there has been some communication bringing the matter to the forefront. Last December, Atty Bob Shearman, representing the City, indicated that Atty Steve Ramunni, representing Carter Pritchett/Centennial Bldrs, essentially said they can't move the proposed sign location easterly (as requested by the City) and proposed the City accept a 20 year (vs 10 year) period before non-conformance provisions be instituted on a proposed billboard. At that time, the City Atty conveyed to Atty Shearman the City's position of unacceptability. City Clerk: • 'Sunshine' manuals and abstaining - You rec'd the open meeting regs book last month, but I wanted to direct your attention to something (Whitehall) wasn't aware of. 'A member of a Municipal Board is prohibited from abstaining from voting unless there is, or appears to be a conflict of interest.' (see page 43 #7) I'm used to Roberts Rules of Order and this is a significant deviation from that. • Procedure in the event of an election tie -Recall that the Council's request was to investigate minimizing the number of days to hold a subsequent run-off Special Election. Finance: • PRM conference - India went to the 9/16 PRM Gp Health mtg and I'm attaching her report. A few noteworthy issues include that PRM has relaxed their reporting requirement for those pool members that wish to go out for bid. Originally PRM required that a member was limited to express they might be leaving. Another issue is, that while the plan is doing well but the City claims cost per employee is about 9.5% higher than the group average. • Ec Council mtg - India and I met w/ the EC on 9/28 to discuss the City's budget. • Investment Policy Again, we plan to introduce the new GASB (Gov Acctg Standard bulletin) order #54 as explained by the City's auditors creating a new `reserves' categorization method that describes how the generally accepted accounting practices (GAAP) for local government `recommends' (not mandatory) we distinguish monies from restricted to committed to unrestricted. In conjunction w/ that, we are still reviewing formalizing the investment policy. Fire: • Fire Safety Week - Each year the Fire Dept visits several schools and I'm attaching this year's fi er for Oct 10th at the freshman Campus for all Day Care facilities. Oct 11 t they plan to visit Central Elementary. • Union discussion -The last time we met with Union reps a proposal was made to essentially limit volunteer assistance. Chief Smith has now provided some scheduling language to the contract that we are reviewing. • Code Enforcement -The Royal Palm Beach nuisance ordinance creating a registration requirement for the mortgagee (lender) along w/ maintenance standards for those distressed properties was distributed and discussed some at the Sep 13 Code Enf meeting. Page 3 1014111 Activity Rpt Cont'd (Fire Dept) — Fire at United Feed - You're aware of the extravagant fire we experienced, but I wanted to apprise you of an issue that's been ongoing, apparently. Immediately after the fire, United Feed submitted a demolition permit that reflected $1.5 million as an estimated cost of the project. Unfortunately, the Bldg Official probably should have realized it was erroneous and made a correction then. Instead, I rec'd a visit from one of the Board members about it and we quickly requested that they give the City a more accurate indication of the cost. They did and we reduced the permit cost from $6000 down to $236.90 (based on a $60k improvement). I've attached a copy of a letter I sent to United Feed. General Services: • Betty Clement will be retirinq around the end of October. Patty Burnette, the part-time receptionist and bldg permit coordinator in Gen Services has agreed to accept the position. Police: • SLERS radio — Apparently, the tower is constructed and tech equipment is being installed... expect October (2011) startup according to the County. I've described some of the installation difficulties but more importantly is the eventual cost of this system: Fire Dept $25, 908 + an est $10, 000 for paging capability Police Dept $77, 724 Pub Wks $ 9,011 In addition, the City will be paying a significant annual fee for user and maintenance fees Public Works/Engineering: • Employment - As you know the City retained two seasonal part-time workers for the summer, with the probable intent of hiring one of them to replace Floyd Selph (left in Dec 2010). Both employees (incl Brian Hoy) have worked out fine and one of them (Jeff Treece) is a pretty good mechanic. We've been notified that Alfred Fisher (mechanic) will retire in mid -November and we are losing Jeff Adams to retirement. My plan is to hire both of the part-timers to full time to help cover the 3 vacancies and then next summer possibly hire 2 part time ppl, when we need more help, as we did this past year. • Sidewalk program 2011 - Lynch Paving started the project on 9/29. • Sidewalk program 2012 - We have begun developing next year's project. If you have input on the matter pls advise. • Hurricane -resistant quarters at City garage facility. The current statutes prohibit public agencies from considering price when hiring an architect, engineer, surveyor or mapper. • Our appeal to you as Legislators continues to be to help us by avoiding unfunded mandates and any other piece of legislation that will eventually cause us undo harm. Our area has been designated as a rural area of critical economic concern (RACEC) but we need your continued support on any front to augment our fiscally constrained plight. We understand the State has faced unbelievable financial crises, but our area has fallen on uniquely difficult times... more specifically our: ■ Unemployment = (July, 2011)--13.3% ■ 22.3% below Poverty level ■ High School dropout rate = 6.4% ■ Average wage in the County is $13.93, or $28,964 annual gross salary • Continue to support FDOT intersection and SR 70 widening -- Including SR 70 west to Hwy. 27 primarily from an evacuation perspective but also an economic standpoint. Maintain FDOT funding already in place. • Support for continued funding of the Okeechobee Battlefield Historic State Park • Funding assistance is needed for City's Commerce Center Permit Conditions Proiect -- $200,000 is needed to complete conditions of SFWMD permit for wetland and water retention compliance. This is also a job creator/economic development project as it completes infrastructure, which provides incentives for new business. • Funding assistance is needed for Storm Water Retrofit Proiect — This $250,000 project will allow the City to continue with water quality compliance as per SFWMD by providing Swale and inlet improvements to reduce the nutrients and volume of runoff entering Taylor Creek and Lake Okeechobee; supports the clean water act, Northern Everglades Protection Act. • Pill mill legislation —Support efforts to close any attempted loopholes. • The City concurs with the continued streamlining of regulations for business and support for job creation. • The City supports the County's Legislative issues and concerns. • The City supports the Okeechobee Utility Authority's Eastside Forcemain and Treasure Island Wastewater Projects. Florida Police Chiefs Association SUPPORTS: • PRESCRIPTION DRUG MONITORING PROGRAM: FPCA supports the full and timely funding of start-up and maintenance of this program that will facilitate investigations into prescription medication abuse cases that are causing rampant addiction and death incidents statewide. • TEXTING WHILE DRIVING: FPCA supports modification to traffic statutes to provide that the act of texting while driving shall be prima facie evidence of careless driving, and may be considered evidence to support a charge of reckless driving. • TRUST FUND DOLLARS: FPCA supports and urges the Legislature to give FDLE budgetary capability to maintain and improve advanced training of law enforcement officers. FDLE reports that with proper management, they should be able to leave the training dollar level at $67 per officer. • CONTROLLED SUBSTANCE PRESCRIPTION ENHANCEMENT: FPCA supports an amendment to section 893.04, Florida Statutes, to allow a pharmacist to collect a thumbprint from the person presenting or picking up any prescription for a controlled substance for the purposes of identification of such persons. Florida Police Chiefs Association OPPOSES: • WEAPONS: FPCA opposes any change to F.S.S 790.06 that would allow the storage of firearms in a vehicle on any school campus. We also oppose any change to this statute that would allow the possession of a firearm on any school campus. The time frame for notification was also amended to : 1 st notice of intent to withdraw must be sixty (60) days prior to renewal and another formal notification 10 days prior to the beginning to the Fiscal Year. Responsibilities of a Terminated Member changed from 6 months to 4 months of administration cost. The Brokers Status report of our Plan and its claims was given, all in all through the month of July our claims as a pool are less than anticipated and at this time, year-end projected surplus is $357,563, which means at this time the actual and projected surplus does not include the $1.7 million budgeted contribution from surplus. (City of Okeechobee claims cost per employee as of July is running 9.5% higher than the PRM group.) I just wanted to take the time to follow up with you on the demolition permit process. As you are aware, the City quickly adjusted the associated fee to $236.90 after finding that the original $1.5 million estimate on the application was erroneous and later reported as $60,000 for the cleanup processing. While I would like to think that staff would have questioned this matter without your input, I appreciate you making the effort to stop by to explain the situation. The City considers United Feed as a huge asset ... one that we will do everything possible to assist you and the Board in keeping here. We also understand the horribleness of the incident and the far reaching implications to the farming community.
