Code Officer Sterling testified certified notices were received by the attorney for the mortgage company and notice of
hearing was posted on the property. Mr. Sterling stated this is an overgrown vacant lot which is in foreclosure and nothing
has been done to maintain the property. Member Sweda moved to find Case 11-028, George Morris, III at 202 NE 81 Avenue
in violation of Ch 30 Sec 3044 General cleaning, based on the testimony of Code Officer Sterling, imposing a fine of twenty
five dollars per day beginning fourteen days from July 12, 2011; seconded by Member Huckabee.

Code Officer Sterling testified certified notices were received at the mailing address of the property owner which is a grocery
store. Mr. Sterling stated he also posted notice to appear on the property and spoke with Mr. Naser who is leasing the building.
However, the business still has an excessive amount of signs and debris behind the building and in the city right of way. Mr.
Sterling explained the business is allowed one square foot of sign face area for each linear foot of the building width that faces
the front of the lot. Member Douglas moved to find Case 11-037 Zaben Omar Alzaben at 1002 NW Park Street in violation of
Ch 30 Sec 30-44 General cleaning and Ch 90 Sec 90-572 Building signs, based on the testimony of Code Officer Sterling,
imposing a fine of twenty five dollars per day beginning fourteen days from July 12, 2011; seconded by Member Irby.

Case No. 11-055 Code Officer Sterling testified certified notice of violation and notice of hearing were received by the property owner. He said
Randal & Cynthia Weigum.1306 SE 12th Drive this case was referred by the building department for a pool which failed the final inspection. Although the building department
Ch 70 Sec 70-251 Permit required has been in contact with the property owners and the company which installed the pool, nothing has been done to resolve the
matter. There was some discussion among the board members as to whether a fine should be placed on the property owners
since the pool company is actually at fault. Chairperson Gamiotea reminded the board the only action they have authority to
take is against the property owners. He added, if a fine was imposed on the property owners it could give them more leverage
to force the pool company to have the proper permits and inspections completed. Member Huckabee moved to find Case 11
055 Randal & Cynthia Weigum at 1306 SE 121h Drive in violation of Ch 70 Sec 70-251 Permit required, based on the testimony
of Code Officer Sterling, imposing a fine of twenty five dollars per day beginning August 25, 2011 if not in compliance by that
date; seconded by Member Irby.

Code Board Discussion: III After some discussion among the board regarding cases with fines which have accrued for over ninety days, Member Irby
