RESOLUTION NO. 11-08
A RESOLUTION OF THE CITY OF OKEECHOBEE, FLORIDA,
AMENDING RESOLUTION NO. 09-05 BY REVISING CITY FEES
FOR PUBLIC RECORDS REQUESTS AND REPORTS AS SET OUT
IN THE CODE OF ORDINANCES AS APPENDIX G; PROVIDING
FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Okeechobee, Florida, receives requests for various types of public
records; and
WHEREAS, the City of Okeechobee, Florida, incurs administrative expenses to record and
organize activities, programs, plans and events of interest to the public; and
WHEREAS, Florida Statutes Chapter 119.071(b) authorized the City Council to establish
reasonable charges and fees for public records, therefore the City Council has adopted,
through Resolution No. 09-05, a schedule of fees for public records and reports; and
WHEREAS, contained in the public records fees are certain types of records, whose fee is
established by Florida Statute 321.23, and amended by the State Legislature from time to
time, causing the City of Okeechobee's fee schedule to be revised.
NOW, THEREFORE, be it resolved before the City Council of the City of Okeechobee, Florida;
presented at a duly advertised public meeting; and passed by a majority vote of the City
Council; and properly executed by the Mayor or designee, as Chief Presiding Officer for
the City:
SECTION 1. The City Council hereby revises the fees for public records request as set out
in "Exhibit A," attached hereto and made part hereof.
SECTION 2. This Resolution shall supersede all prior rate resolutions.
SECTION 3. If any section subsection, sentence, clause, phrase or portion of this
Resolution, or application hereof, is for any reason held invalid or unconstitutional by any
court of competent jurisdiction, such portion or provision and such holding shall not affect
the validity of the remaining portions or applications here.
SECTION 4. Effective Date. This Resolution shall take effect immediately upon adoption.

Procedures are set forth in Exhibit B for assessing fees for public records or reports requests (1)
which require extensive use of information technology reserves, (2) which require extensive
clerical and /or supervisory assistance by personnel of the City, (3) in a medium requested which
the City does not ordinarily use, but which the City can provide as requested, or (4) which the City
can satisfy a request for records not routinely developed or maintained by the City that requires
a substantial amount of research, examination or programming.
