Code Officer Sterling requested the withdrawal of Cases 10-121 David & Maria Terrazas, 11 -010 Donald McBrayer, and 11-046
Superstop Petroleum from today's agenda.
Code Officer Sterling testified this property was in the process of going into foreclosure. He stated the certified notices sent
to the property owner were returned. Therefore, notice of violation/notice of hearing was posted on the property on May 25,
2011. There was some discussion among the board members regarding cases where the owner can not be located or the
property is in the process of foreclosure. Attorney Cook advised the board as to what action should be taken in order to allow
the City to have authority to clean the property. Member Huckabee moved to find Case 11-024 Timothy & Kimberly Casanova
in violation of Ch 30 Sec 30-44 General cleaning and beautification, based on the testimony of Code Officer Sterling, imposing
a fine of twenty five dollars per day beginning June 15, 2011 and recommending the City staff proceed to have the property
cleaned with a lien for the amount of cleaning placed on the property; seconded by Member Close.

PLEASE TAKE NOTICE AND BE ADVISED that when a person decides to
appeal any decision made by the Code Enforcement Board with respect to
any matter considered at this meeting, he/she may need to insure that a
verbatim record of the proceeding is made, which record includes the
testimony and evidence upon which the appeal is to be based. Code
Enforcement Board media is for the sole purpose of backup for official
records of the fire department.
Code Officer Sterling informed the board this property had recently been found by the board to be in violation of general cleaning
and beautification and was currently being fined. However, the property was never mowed because the property owner could
not be located. Therefore, Attorney Cook directed the code officer to cite the property as a public nuisance and present it to
the board to be found in violation of public nuisance. Member Douglas moved to find Case 11-034 James George, in violation
of Ch 30 Sec 30-43 Public nuisance, based on the testimony of Code Officer Sterling, and recommend City staff proceed in
having the property cleaned with a lien for the amount of the cleaning placed on the property; seconded by Member Huckabee.
