Adjournment -- -- -- SEVENTH MEETING TUESDAYJ JULY 1, 1980 The Planning Board and Board of Adjustments and Appeals of the City of Okeechobee, Florida, convened in its seventh Regular Meeting in the Council Chambers at City Hall, Okeechobee, Florida, at 7:00 P.M., Tuesday, July, 1, 1980. Chairman Jerry Walker presiding with the following Members present: Frank Altobello, Darrell Ferneau, Jim Wright and Robert Joiner. Others present were David Conlon, City Attorney; Richard Spray, Building Official and Janice M. Mann, Deputy Clerk. BOARD OF ADJUSTMENTS AND APPEALS APPROVAL OF MINUTES Member Altobello moved to waive the reading of the minutes of the Board of Adjust- ments and Appeals and approve them as presented, seconded by Member Wright, vote unanimous. REQUEST FOR VARIANCE Due to an error the Church of Christ request for special exception was readvertised as a request for a variance. As previously requested, the Church of Christ provided a plot plan which met with the approval of the Board. The plot plan revealed ample room on the property for the proposed addition. Member Altobello moved to grant the variance request by the Church of Christ, seconded by Member FerneauJ vote unanimous. There being no further business of the Board of Adjustments and Appeals adjourned. PLANNING BOARD APPROVAL OF MINUTES Member Wright moved to waive the reading and approve the minutes as presented for the Planning Board, seconded by Member Altobello, vote unanimous. REZONING REQUEST - FRAZIER Gary R. Frazier presented his rezoning request to change Lots 11 and 12, Block 35, First Addition to South Okeechobee, from Commercial to ResidentialJ General (RG-2). Frazier felt granting the request would enable him to build a tri-plex which would enhance the area not hinder it. Plans are to be drawn up pending the granting of the request. Each unit will contain 1,100 square feet of living area, 2 bedrooms, 2 baths, similar to Oak Lake Condominiums and/or the Villas. Member Wright noted he had surveyed the area in question and stated it was a beautiful building site, however, the request is spot zoning. There is no rental property ~ 47 ~ ~ ~ gþ in the area, strictly single family dwelling. Chaiman Walker called for comments from citizens present. Robert Goolsby owner of Lots 3, 4, 5 and 6, Block 33, 1st Addition to South Okeechobee spoke out in favor of the change, stating an expensive rental unit would be much better than a small inexpensive single family home. W. Geiselman, owner of a duplex, is in favor of the change. He pointed out the fact that contracts can be drawn up for rental units to keep them from deteriorating. Chairman Walker opened the floor for discussion from those opposed to the zoning change. Lawrence Feldman, owner of Lots 4, 5 and 6, Block 39, 1st Addition to South Okeechobee, objected to the change. He noted he has invested a great deal of money in his home and does not want rental property near by. Member Altobello questioned that if the zoning remained Commercial would the residents care to see a truck stop or shopping strip on the property. Christina Hooker, owner of Lots 1, 2, 3 and 4, Block 38, lst Addition to South Okeechobee, stated the surrounding area is strictly Residential, single family. Some type of office, dental or medical, etc., would blend beautifully. Rentals tend to decay regardless of what the owners say. Floy Nell Lowe, owner of Lots 5 and 6, Block 35, 1st Addition to South Okeechobee, adjacent to property in question objected to the change. Attorney Conlon pointed out Section 16, items 5b and 5e of Ordinance #402, for the Board to consider: b) Will the proposed change create an isolated district unrelated to adjacent and nearby districts? e) Would the proposed change be contrary to the City's conprehensive plan? Conlon stated granting the request will create spot zoning. Mrs. Lowe commented that the neighborhood is nice presently. Because no plans were submitted, the adjacent owners do not know what is to be built. Mrs. Lowe felt it only fair, to see the proposed tri-plex. Member Altobello suggested having Frazier submit a sketch of the type of building prior to a decision on this matter. The right type of rental unit wj.ll enhance the area and increase property values. Rental property is very effectively mixed in with residential in the better sub-divisions. -- -- -- - - - Other citizens that were in opposition (either by written letter or telephone call) were as follows: 1) Joseph & Leona Flanagan, Jr. Lots 1, 2 and 3, Block 39 4) Mrs. Phillips 204 S.W. 21st Street 2) Phil Berger Owner of Parcel 28; Lots 9, 10, 11, 12 of Block 39; and Lots 7, 8, 9, 10, 11, 12, of Block 42 5) Clifton & Alene Godwin Lots 5,6, 11 and 12, Block 36 6) Demenick & Lucy Goglia Lots 5, 6, 11 and 12, Block 34 3) James & Amy Ammons Lots 1 and 2, Block 36 After lengthy discussion, Member Altobello moved to table the issue until the next meeting at which time Mr. Frazier can supply the additional information, seconded by Member Joiner, vote carried, with Member Wright abstaining. APPEAL OF ZONING ADMINISTRATOR'S DECISION Kyle VanLandingham has submitted an appeal of the Zoning Administrator's decision regarding a fence. Member Wright moved to hear the appeal of Mr. VanLandingham at the August 5th, 1980, meeting with the proper advertisements and notification of adjacent land owners, seconded by Member Altobello, vote unanimous. ADJOURNMENT There being no further business, Member Altobello moved to adjourn at 8:15 P.M., seconded by Member Wright, vote unanimous.
