Chief Davis moved to dispense with the reading and approve the September 26, 2007 Technical Review Committee
Minutes regular meeting; seconded by Chief Smith. Motion carried (5-0).
1. Southeast Milk, Inc. The application was submitted by Steven Dobbs, P.E. on behalf of applicant John Raddatz
and property owner Southeast Milk, Inc. The site improvements shall consist of the expansion of the existing
building and construction of a metal storage building to be developed in a single phase for property located at
Southwest 10th Avenue and Southwest Park Street, 1.54 acres. Legal description: Lots 1 -20, Block 1, Southwest
Addition to Okeechobee, Florida according to the plat thereof as recorded in Plat Book 2, Page 7 of the Public
Records of Okeechobee County, Florida Senior Planning Consultant.

Bill Brisson from LaRue Planning and Management reported LaRue Planning Staff findings, conclusions and
recommendations. He reported LaRue Planning Staff recommends approval of the site plan provided that the parking and
landscaping deficiencies are addressed, and the appropriate setbacks are provided.
Mr. Steve Dobbs and Mr. Todd Hopkins representing Rudd Jones Associates handed out revised plans with setbacks and
landscaping plans.
Administrator Whitehall asked Mr. Brisson if Southeast Milk, Inc. meets the code. Mr. Brisson replied, yes.
Engineer Bermudez made reference to the new building that was granted the 3 foot setback. The foundation must not
encroach on the granted setback. He stated, when you put up a metal building, the foundation extends out from the
building, the 3 foot setback that was granted does not mean you can put the building right on the setback, due to the
foundation that extends beyond the building.
Mr. Mac Worley, General Contractor for the project addressed the Committee. Basically, when counteracting the up lift of
the metal building, the concrete can be refigured, also Mr. Worley reported, the metal building manufacturer does not design
the footings, the engineer designs the footings. If you tell me today, the footing has to be 3 foot from the setback, that will
be the engineers problem to accommodate. Mr. Hayford then affirmed the footer must adhere to the 3 foot setback.
Mr. Bermudez also commented on the visibility triangle in reference to the building on the Northeast corner, Mr. Worley
stated, if we have to move the building from the East side to the West, it will create a hardship and will not give the City the
look of continuity. Mr. Bermudez expressed his desire of removing and not allowing metal buildings in the main corridor of
the City, for atheistic purposes. Mr. Whitehall articulated inherent liability deviating from the code on the visibility triangle.
The Committee determined the developer is to meet with the City Engineer, Mr. Bermudez, to discuss how to accommodate
a sidewalk being placed on the East and West side of the parcel along the property line.
Pervious /impervious area was discussed. It was determined, if more than 85 per cent of the property was covered, they
would need a variance to cover additional land. The Committee decided, if the landscaping and green areas could not be
met, some of the pavement would have to be removed.
Administrator Whitehall said a couple members of the City Staff went and looked at the site. The site needs more
landscaping on SR70 for aesthetics, perhaps a few trees along the North side of the highway. Mr. Hopkins replied, it might
be a bit difficult to do that because of it being all concrete. Mr. Whitehall suggested the possibility of cutting squares in the
concrete to accommodate the trees. It would beautify your lot, considerably. Engineer Bermudez commented on the trees
shown on the landscape plan on the West side, stating they are in the visibility triangle. All trees showing on the four
corners are located within the visibility triangle. Engineer Bermudez also instructed, there needs to be a minimum of 2 foot
buffer around the property line. The only thing that can be in that buffer is grass or maybe some shrubs. That is code. He
said the landscaping plans need to be revised. Mr. Dobbs interjected, regarding the landscaping, we understand the
landscaping is extremely close to the property line, We wanted to match the existing palms that are already located on the
property line. Engineer Bermudez inquired as to whether the existing palm trees were in the City right -of -way? Mr. Dobbs
replied, they are on the property line.
Administrator Whitehall asked whether Chief Smith had additional questions? The storage of the material you plan on
having, would require MSDS sheets and quantities. Mr. Todd Hopkins confirmed he would look into Department of
Environmental Protection (DEP) for permits for chemical storage. Chief Smith asked whether the buildings proposed are
going to be totally enclosed? Mr. Dobbs replied, the one storage on the South is going to be open faced, the building on the
North will be enclosed. Obviously the porch will be open. Will the semitrailers that are currently parked on the property, will
be removed? Mr. Harden, Division Manager for Southeast Milk, Inc., answered, that at some point they will be removed, but
not at this time.
Mr. Harden said there are no chemicals stored in the semitrailers, and all the material under the semitrailers will be cleaned
up. Chief Smith also inquired whether access for emergency vehicles would remain at the South and North entrance. Mr.
Dobbs replied, yes. Chief Smith added he did not require fire lanes due to the industrial type set up that exists, unless you
plan on adding. Chief Smith then asked whether there was any additional storage areas? Mr. Harden said there is outdoor
storage at the West end of the property, that will remain.
Mr. Bermudez asked about the possible damage to the streets semitrailers cause due to the turning radius required for
semitrailers for entering the property? Chief Davis stated he drove milk trucks in and out of that property for years and that
entrance is plenty big enough to accommodate the semitrailers.
Director Robertson questioned how the applicant was proposing to manage the rain water discharge from the new building?
Mr. Hopkins replied, everything is to be directed to the dry detention area in the Northeast corner. How are you going to
take water from the building to the dry retention area? Downspouts was the answer. Mr. Robertson asked, all the way
across the parking lot? Mr. Hopkins asked if Mr. Robertson was referring to the proposed metal building? Mr. Robertson
answered yes. Mr. Hopkins said the building is proposed in an area that is currently impervious. He stated the building
needs gutters and flums into the ditch, this way you will be controlling the water from two ends into the ditch. If this is not
recognized it will give the City problems with washouts. Mr. Worley agreed.
Administrator Whitehall asked whether the Committee had further questions? There were none.
Chief Smith made a motion to approve Southeast Milk, Inc. site improvements consisting of the expansion of the existing
building and construction of a metal storage building to be developed in a single phase for property located at Southwest
10th Avenue and Southwest Park Street; seconded by Engineer Bermudez with the following contingencies: (1) Visibility
triangle adhered to, to be reviewed by the City Engineer; (2) Irrigation system installed for the 3 foot buffer area; (3) Footer
for the building cannot extend into the 3 foot setback; (4) Gutters and downspouts on building and flums required; (5) If the
landscape requirements cannot be met, remove some pavement; (6) Installation of sidewalks on East and West side of
property; (7) Pervious /impervious surface area not increased; (8) New site plan presented to Engineer Bermudez; (9)
Maintain access for fire emergency vehicles; (10) 6 sets of drawings presented to the Engineer for review by the Committee
for conformance. Motion carried (4 1) with Engineer Bermudez voting Nay.
2. Big Lake Home Health Services, Inc. Postponed from the September 26, 2007 meeting for revised
site plan. The application was submitted by Mohammad Noorudin on behalf of property owner
A.M.S.A. Holdings. The application is for a parking lot for conducting business (No public allowed) for
the Home Health Care office for property located at 608 Northeast 2nd Avenue. Legal description:
Lots 3, 4, 5, and 6, Block 78, City of Okeechobee, according to the Plat thereof as recorded in Plat
Book 5, Page 5, of the Public Records of Okeechobee County, Florida Planning Consultant.
Mr. Brisson addressed the Committee stating, LaRue Planning Staff has no problem with the redesign of the site and
believe it to be superior to the original proposal. Staff feels there is a need for buffering and landscaping, and the only other
possible concern would be the location of the driveway within 30 feet of the intersection of Northeast 7 Street and
Northeast 2 Avenue. If the City Engineer or Police Department feel this is too close, there is room to move the driveway to
the East.
Mr. Brisson commented on sidewalks? Engineer Bermudez stated since the applicant is not adding any new buildings, just
a parking lot, sidewalks were not applicable. Administrator Whitehall asked if there were any sidewalks in that proximity?
Mr. Bermudez replied, only on 441.
Mr. Hayford reported there is no gravity sewer, so the only option is septic tank.
Building Official Schaub told the applicant to provide all permits including demolition permits.
Mr. Whitehall asked the Committee whether they had further questions or concerns. There were none.
