The invocation was offered by Reverend Jim Benton of Faith Farm Ministries; the Pledge was led by Mayor Kirk.

Mayor Kirk proclaimed the week of May 1 through 7, 2011 as "Municipal Clerk's Week" and read the proclamation in
its entirety as follows: "WHEREAS, the Office of the Municipal Clerk, a time honored and vital part of local
government exists throughout the world; and WHEREAS, the Office of the Municipal Clerk is the oldest among
public servants; and WHEREAS, the Office of the Municipal Clerk provides the professional link between the
citizens, the local governing bodies and agencies of government at other levels; and WHEREAS, Municipal
Clerks have pledged to be ever mindful of their neutrality and impartiality, rendering equal service to all; and

(continued from page one) WHEREAS, the Municipal Clerk serves as the information centeron functions of local
govemmentand community, and WHEREAS, Municipal Clerks continuallystrive to improve the administration
of the affairs of the Office of the Municipal Clerk through participation in education programs, seminars,
workshops and the annual meetings of their state, province, county and intemadonal professional
organizations; and WHEREAS, it is most appropriate that we recognize the accomplishments of the Office of
the Municipal Clerk. NOW, THEREFORE,1, James E. Kirk, Mayor of the City of Okeechobee, Florida, do hereby
proclaim May 1 through May 7, 2011, as "MUNICIPAL CLERKS WEED" and further extend appreciation to our
Municipal Clerk, Lane Gamiotea, and to all Municipal Clerks for the vital services they perform and their
exemplary dedication to the communities they represent "The proclamation was accepted by Clerk Gamiotea
and Deputy Clerk Jahner.

proclamation in its entirety as follows: "WHEREAS, public works services provided in our community are an
integral part of our citizens' everyday lives; and WHEREAS, the support of an understanding and informed
citizenry is vital to the efficient operation of public works systems and programs such as water, sewers,
streets and highways, public buildings, solid waste collection, parks and canal maintenance; and WHEREAS,
the health, safety, and comfort of this community greatly depends on these facilities and services; and
WHEREAS, the qualityand effectiveness of these facilities, as well as their planning, design, and construction,
is vitally dependent upon the efforts and skill of public works officials; and WHEREAS, the efficiency of the
qualified and dedicated personnel who staff public works departments is materiallyinfluenced by the people's
attitude and understanding of the importance of the work they perform; and WHEREAS, this year's theme,
"Public Works: Serving you and your community", as we celebrate the hard work and dedication of the many
public works professionals throughout the world. NOW THEREFORE, 1, James E. Kirk, by virtue of the
authority vested in me as Mayor of the City of Okeechobee, Florida, do hereby proclaim May 15 - 21, 2011, as
"NATIONAL PUBLIC WORKS WEEK" in the City of Okeechobee." Public Works Director Robertson accepted the
proclamation.

A. Motion to approve the March 2011 Warrant Register:

hundred ninety-two thousand, forty-nine dollars and forty-one cents ($392,049.41); Capital Improvement Projects
Fund, two hundred forty-four thousand, five hundred thirty-six dollars and thirty-eight cents ($244,536.38); and Public
Facilities Improvement Fund, twenty-one thousand, nine hundred thirty dollars and fifteen cents ($21,930.15);
seconded by Council Member Williams.

Vill. UNFINISHED BUSINESS.
A. Consider amendments to the Election - City Clerk (Exhibit 1). A request to change Election Code Section 26-11 was originally discussed at the February 15" Council Meeting. The
Council asked Clerk Gamiotea to research the effects of changing the City General Election to be the same time as
the Primary Election so that should a Special Election need to be held, it could be held during the General Election.
The main concern noted was the difference in voter turnout. Based on the information obtained from the County
Supervisor of Elections the voter turnout is almost double during some election years. Clerk Gamiotea also explained
that the Code requires the Mayor to Call the Election to be held 90 days later. There is not sufficient time between the
Primary and General Election to meet that requirement.
The Council then discussed that County Supervisor of Elections Chandler had offered an estimated cost to conduct
a Special Election, of $2,747.20. This is a minimum election with no early vote and only one precinct. There would still
be additional advertising the City would have to absorb, adding approximately another $1,000.00. Council Member
Williams noted that should the Council take no action, and leave the Special Election requirement in the Code for ties,
the new Council and election of Mayor would not take place until March or April with the 90 day requirement.
The Council asked Clerk Gamiotea to see whether the 90 days could be shortened and report back to the
Council.

IX. NEW BUSINESS.
A. Consider Citizen Board Appointments - City Clerk (Exhibit 2).
Council Member Watford moved to reappoint Rennae Sweda, Randy Huckabee and Judy Douglas as Regular
Members to the Code Enforcement Board, terms being May 1, 2011 to April 30, 2014; seconded by Council Member
O'Connor.
The discussion briefly turned to the option of disbanding the Code Board and hiring a Magistrate to handle these
issues. Mayor Kirk instructed Administrator Whitehall to again distribute to the Council, the summary of what it would
take to switch to a Magistrate -run Code Enforcement. Should there be enough interest expressed by the Council, he
could then put the matter on the agenda.

There are still two Code Enforcement Board Alternate Member positions vacant that need to be filled. At this time there
are no applications.
Council Member Watford moved to reappoint Karyne Brass and Kenneth Keller as Regular Members and Gary Ritter
as an Alternate Member to the Planning Board/Board of Adjustments/Design Review Board, terms being May 1, 2011
to April 30, 2014; seconded by Council Member Williams.

There are also vacancies on the General Employees and Police Officer's Pension Board of Trustee's. The City does
not have any applicants for these positions for Council to take action on at this time.
Contained with Exhibit Two was a memorandum from Attorney Cook regarding dual office holding among citizen
boards, he is recommending that the City not permit any board member on a board within the City to assume a position
on another City board. The Council thanked Attorney Cook for his research but did not see a conflict for the above
board appointments. The possible conflict was noted for Mr. Huckabee, who was recently appointed to the OUA Board
as a County representative. The other was Mr. Ritter, who is also serving as the City's appointed member to the
Firefighter's Pension Board of Trustee's.

There were two Code Enforcement Cases forwarded to the Council for recommendation to begin foreclosure
proceedings. Case No. 10-096 Margueite D'Onofrio, 400 Southeast 10`h Avenue was withdrawn from discussion at
this time as the property is now in the process of coming into compliance.
Case No.10-092, James George, Lots 1 and 2 of Block 42, City of Okeechobee Subdivision was discussed. The Code
Board is recommending the Council approve to begin foreclosure proceedings for Code Violations of overgrown
vegetation. A fine has been running for 128 days at a rate of twenty-five dollars ($25.00) per day. All notices have been
returned to the City. The property owner is deceased. The property is not in probate at this time and heirs have not
been located. Attorney Cook explained the very complicated process this would take to foreclose on the possible
unclaimed property. Following discussion, the Council requested the matter go back to the Code Enforcement
Board for them to consider declarinq the Droperty a public nuisance and the City cleanina it, then assessing

This subject was first discussed at the February 15, 2011 Council Meeting, where the Council asked me
to research the effects of changing the City General Election to be the same time as the Primary
Election, so that if a Special Election had to be held, it could be held during the General Election. The
main concern noted was the difference in voter turn out. Below is the information provided by the Office
of the County Supervisor of Elections.

Another factor to consider is there is not sufficient time to have the Mayor Call for the Election, as
required by Charter and Code. A special election has to be called by the Mayor by Proclamation, at least
90 days prior to the date of holding the election. The Primary Election must be held no more than 10
weeks prior to the General Election (per F.S.).
Mrs. Chandler also provided an estimate to conduct a City Special Election, this estimate does not
include Early Voting, only one precinct at a government building and the City will cover all media
advertising:

The matter before the Council, is a request to amend Section 26-11 by adopting the same language as

DATE: April 13, 2011
Following the January 5 Council Meeting where citizen board appointments were discussed, it was
brought to my attention that citizens cannot be appointed to two quasi-judicial boards and that the matter
should be researched further. I asked Attorney Cook to give his legal opinion and findings in writing.
Attached is a copy. His recommendation is we not permit any one to be appointed to two or more boards.
This issue will need to be addressed when the Council considers reappointing Mr. Huckabee and Mr.
Ritter. Mr. Huckabee now sits on the OIJA Board (as a County appointee and was not sure this would
be a factor but thought it needed to be brought to your attention). Mr. Ritter sits on both the City Fire
Pension Board of Trustees and recently was appointed to the Planning Board to fill a vacant term.
1. Code Enforcement Board
� We are in need of two alternate members.
Any applications received will be distributed at the April 19 meeting (to date we have none).
The terms for Alternate Members appointments will be April 20, 2011 to April 30, 2013 and April
30, 2011 to 2014.

Huckabee and Judy Douglas, all three have expressed their interest in being reappointed.

re: dual office holding
Lane:
The question of whom may serve on the various boards and commissions within the city
and county of Okeechobee comes up from time to time, and in response to your request, I
suggest that we implement the following policy within the City, with an explanation as to the
reasons for it.
The prohibition arises from the Florida constitution, Article II, section 5(a), which states
that no person shall hold at the same time more than one office under the governments of the
state, counties and municipalities, which applies both to elected and appointed positions.
The key of course, it what is an "office"..... this historically has been held to mean that
one is prohibited from serving on another board or position if in that other position the board has
been delegated some sovereign authority. Without an in depth study of that, suffice it to say that
all of our boards, as well as the OUA, have been delegated some sovereign authority. The ability
to receive information, make recommendations, issue permits, permissions, fines, create policy,
set, recommend or adopt revisions to ordinances for consideration by the council, and related
functions would all support the premise that a member thereof holds an "office".
In this context, I can only imagine a board where one could serve on more than one at a
time would be similar to a fact finding board established to receive information concerning a
subject; to compile the information; and pass it on to the council for whatever action they
deemed appropriate; i.e. charter revision committee, evaluation and appraisal report to submit to
our planners for DCA updates, committee to explore qualified recipients for CDBG grant funds,
and things of the sort.
In summary then, I would recommend that we not permit any board member on a board
within the City to assume a position on another board, or the OUA.
