Occupational Licenses be added under Item #5, New Business. E. OLD BUSINESS 1. Motion to read, by title only, and set October Motion by Councilman Rubin, seconded by 4, 1988 for the final Public Hearing, an Ordinance Councilman Watford, to read, by title only establishing Traffic Regulations - City Attorney proposed Ordinance #606, and set October 4, (Exhibit 1). 1988 for the final Public Hearing. Attorney Cook read, by title only, proposed Ordinance #606, as follows: AN ORDINANCE OF THE CITY OF OKEECHOBEE, FLORIDA, PROVIDING FOR THE REPEAL OF SECTIONS 11-10, 11-11, 11-12, 11-18, 11-19, 11-36, 11-37, 13-1, 13-2 AND 17-1 THROUGH 17-5 INCLUSIVE, OF THE CODE OF ORDINANCES OF THE CITY OF OKEECHOBEE, FLORIDA, AND DECLARING SAME TO BE NULL AND VOID AND OF NO EFFECT; PROVIDING FOR A NEW CHAPTER SEVENTEEN RELATING TO TRAFFIC; PROVIDING FOR RULES AND REGULATIONS IN GENERAL; PROVIDING FOR PARKING, STOPPING AND STANDING; PROVIDING FOR RECREATIONAL VEHICLES; PROVIDING FOR OFF -ROAD VEHICLES, PROVIDING FOR ABANDONED, UNATTENDED VEHICLES; PROVIDING FOR SEVERABILITY; PROVIDING FOR FINES, PENALTIES AND PROCEDURES; PROVIDING FOR AN EFFECTIVE DATE. 2. Motion to approve the first reading of an Ordinance Motion:by Councilman Thomas, seconded by establishing Traffic Regulations. Motion to approve an employment contract for the City Motion by Councilman Collins, seconded by Administrator - Mayor Chapman (Exhibit 2). Councilman Thomas to approve an employment contract for the City Administrator. After lengthy discussion regarding pension plan contribution by the City, severance pay, length of contract (which Attorney Cook stated was indeterminate), and the provision for automobile usage, Motion by Councilman Watford to amend the severance pay from ninety (90) to thirty (30) days, seconded by Councilman Rubin. After discussion, Chapman X Collins X Rubin Thomas X Watford Motion denied. Smith, Inc. of Vero Councilman Collins, for discussion. Beach - City Administrator (Exhibit 3). After discussion regarding the additional parking spots at City Hall, problems which exists on 5th Avenue, and various areas to be striped, Chapman X Collins X Rubin X Thomas X Watford X Motion carried. Motion to adopt a proclamation for the General City Elections - City Clerk COUNCIIMEMERS/ACTION Mayor Chapman read the proclamation in its entirety, as follows: PROCLAMATION NOTICE OF GENERAL CITY ELECTIONS CITY OF OKEECHOBEE, FLORIDA November 8, 1988 WHEREAS, under and by virtue of the provisions of the Charter of the City of Okeechobee, Florida, it is the duty of the Mayor to proclaim and call General City Elections at the time and the manner provided by said City Charter. NOW, THEREFORE, I, OAKLAND CHAPMAN, MAYOR of City of Okeechobee, Florida, do hereby PROCLAIM AND DECLARE that a GENERAL CITY ELECTION by the duly qualified electors of the City of Okeechobee, Florida, be held on Tuesday, November 8, 1988, during the regular hours of voting, to wit: from 7:00 A.M. to 7:00 P.M., for the purpose of electing the following officers to serve as such for four (4) years beginning January 1, 1989 and ending December 31, 1992, following such election and until their successors are elected and qualified: TWO (2) COUNCILMEN Said election shall be held in the normal polling or voting places within the normal precincts of the duly qualified City electors, which precincts have been established by'the Okeechobee County Board of County Commissioners and Supervisor of Elections for the general election of said County. Hear from Mr. Leo Blair regarding water Mr. Blair and Mr. Collins requested Council allocation - Mr. Tom Blair/Mr. Mosley Collins place the Palm Village Ranch (Leo Blair MHP) (Exhibit 5) project on the existing waiting list for 20,000 gpd water allocation for 200 mobile homes lots. September 20, 1988 page seven 6. Hear from McDonald's Corporation regarding water cr+ and sewer allocation - Mr. Bob Kotovsky. COUNCIlMSERS/ACTION Motion by Councilman Watford, seconded by Councilman Rubin that we add Palm Village Ranch Mobile Home Project (Mr. Leo Blair) on the County waiting list for water allocation up to 20,000 gpd water capacity. After discussion, regarding annexation and future allocations from DER, Chapman Collins Rubin Thomas Watford Motion carried. Mr. Kotovsky requested Council give the McDonald's Corporation an extension on the deadline of September 1st, 1988 (to at least March, 1989) and that Council place the McDonald's Cc -,oration on the County waiting list for 2,500 gpd water capacity for the 441 South building location. After discussion, Motion by Councilman Collins, seconded by Councilman Thomas to allow a six (6) month extension of time on the original agreement (of September 1, 1988) and that the McDonald's Corporation be added to the County Waiting List for water allocation. Mayor Chapman called the meeting back to order at 3:25 P.M. 7. Discuss the Town Center Apartment project for drainage Councilman Watford stated that he had been - Councilman Watford. contacted by Mrs. Bill Hendry regarding a drainage problem with her property which is adjacent to the Town Center Apartment project. Councilman Watford suggested that Council write to the County Building Department and request they send the drainage plans to South Florida Water Management District and request that SFWMD review the plans and comment on the efficiency of the plans, particularly with the retention pond. Councilman Watford also suggested that Council take `= whatever steps necessary to correct the problem, although he stated he felt confident that Mr. Gadoury will protect �-he adjacent property owners from future probl.:iis of this nature once construction is completed. After discussion, Motion by Councilman Watford to send a letter to the County Building Department and request that the drainage plans be reviewed by South Florida Water Management District. Motion died for lack of a second. Motion by Councilman Collins to have Mr. Gadoury, his engineer and Mr. Hendry to review the drainag and attempt to work out the problems, seconded by Councilman Thomas. Discuss the Taylor Creek Cleaning Project - Councilman Collins briefly discussed the Councilman Collins (Exhibit 6). project and the various individuals and entities getting involved. County Commissioner Williamson will ask the County Commission (Thursday) about the feasibility of utilizing inmates from the Sheriff's Department to assist in this project. Motion by Councilman Thomas, seconded by Councilman Watford to appoint Councilman Collins to take charge of this project with full authority and to proceed to get this project underway. COUNCIL REPORTS AND/OR REQUESTS: 1. Councilman Collins: Councilman Collins discussed a problem which exists for individuals having to secure six (6) month Occupational Licenses (minimum) when starting a business within the City and falling within a few days of the deadline for purchasing new Occupational Licenses. Councilman Collins suggests we set up a system to prorate these licenses monthly or quarterly. Attorney Cook explained the Statutes and indicated that provisions for partial licenses September 20, 1988 page ten COUNCUMMERS/ACTION VOTE ABSENT YES NO Motion by Councilman Collins, seconded by Councilman Rubin to instruct Attorney Cook to draw up an amendment to the Ordinance for Occupational Licenses to state Licenses will be prorated to provide that licenses will be charged on a monthly basis. Councilman Rubin: Will be attending the Central Florida Regional Planning Commission meeting and will report back to Council.
