It is the Applicant's responsibility to convince the Board of Adjustment that approval of the proposed special

sufficient explanation and documentation to convince the Board of Adjustment to find that:

Item before the Board of Adjustment:
The matter for consideration by the City of Okeechobee Board of Adjustment is a
Special Exception application for an outdoor vehicle sales lot located at 820 NW Park
St. in the CHV zoning district.
Description of the Situation:
The subject property lies in the CHV zoning district and is comprised of approximately
0.6 acres on which is presently located a vacant building which was the former location
of the Exclusivas "Lupita" retail store. The property owner also owns the lot to the
immediate east which is listed as a vehicle sales lot on the Property Appraiser's
website, although it does not appear to be actively used for this purpose. In a brief
discussion with Mr. Marlon Medrano, the contact person listed on the Application and
apparently the operator of the proposed business, he indicated that the existing building
will be used for a sales office and storage. The building was constructed in 1961,
contains about 6,684 square feet but only 2,084 square feet are shown in the Property
Appraiser's records as being heated.
The Application states that there will be four employees and the business will be open
Monday through Friday from 8:00 AM to 5:00 PM.
An outdoor vehicle sales lot is a Special Exception use in the CHV Zoning District [Sec.
90 -283 (18)].
The Applicant has submitted a survey of the property but this survey does not indicate
the location of the existing building or other improvements on the property. It does
appear from an aerial view of the property that there is a chain link fence around the
perimeter and a driveway directly onto SR 70.

Consistency with Land Development Regulations:
Section 70 -373 (b) requires that the Applicant address, during his /her presentation to
the Board of Adjustment, the following standards for granting a Special Exception. The
Applicant's submission contains only very brief statements addressing these standards.
These are repeated in Times Roman typeface in the following sections, followed by the
Staff Comments in Arial typeface.
(1) Demonstrate that the proposed location and site are appropriate for the use.

Staff believes the proposed location on the north side of Park Street (SR70) at its
Intersection with NW 9th Ave is an appropriate location and site for the proposed
use. The area is surrounded by commercial uses or vacant commercially zoned
lands. The property next door is shown on the Property Appraiser's website as a
vehicle sales lot although it does not appear to be actively used in this manner.
(2) Demonstrate how the site and proposed buildings have been designed so they
are compatible with the adjacent uses and the neighborhood, or explain why no
specific design efforts are needed.
"No change, previously a business alike."
There is no indication that the Applicant envisions any new construction. The
existing building will be used as a sales office and for storage. No special design
efforts should be necessary as surrounding uses are either vacant or of a
character similar to that of the proposed use. Undeveloped portions of the site
will likely be used for display of vehicles for sale.
Demonstrate any landscaping techniques to visually screen the use from
adjacent uses; or explain why no visual screening is necessary.
There has been no indication of intent to provide landscaping. While there is no
special need to visually screen the proposed use from adjacent properties, as
they are either vacant lands or relatively intense commercial uses of a character
similar to the proposed use, the Applicant should be aware that the requirements
of Sec. 90 -535 will need to be addressed during the site plan review stage.

(4) Demonstrate what is proposed to reduce the impacts of any potential hazards,
problems or public nuisance generated by the use or explain how the nature of
the use creates no such potential problems.
"None"
There should be no hazards or special problems associated with the proposed
use. The impact of the proposed outside vehicle sales would certainly be less
than that caused by a number of the permitted uses in the CHV District.
(5) Demonstrate how the utilities and other service requirements of the use can be
met.
"With the city utilities."
The prior retail use was served by public utilities. The proposed use will not
create additional demands for potable water or sanitary sewer service. The
utilities currently serving this property should be adequate for the proposed use.
(6) Demonstrate how the impact of traffic generation will be handled off site and on-
site.
"No change, business location."
A Special Exception for an outdoor vehicle sales lot was approved in 2009 for a
similarly -sized property on the same side of SR 70 just one block to the west. At
that time, the traffic impact was estimated by the applicant's engineer using the
Institute of Traffic Engineers' Trip Generation, 7th Edition, at just three (3) trips
during the PM peak hour. One would not expect traffic at the proposed use to be
significantly different. Therefore, it is unlikely that the traffic generated by the
proposed use will exceed that which has historically been experienced by the
prior retail use and is not expected to have a significant impact on existing
roadways.

When reaching a conclusion on a Special Exception request, the Board of Adjustment
shall consider and show in its record the following findings as set forth in Section 70-
373(c)(1) (8). The required findings and are listed below followed by the Applicant's
statements in Times Roman typeface after which are the Staff comments in Arial typeface.
(1) The use is not contrary to the Comprehensive Plan requirements.
"No"
The future land use classification of this parcel is commercial. The granting of
this special exception is consistent with that classification.
(2) The use is specifically authorized as a special exception use in the zoning
district.
"No change"
Outdoor vehicle sales is listed as an allowable Special Exception use in the CHV
district in §90- 283(18) of the Land Development Regulations.
(3) The use will not have an adverse effect on the public interest.
"No."
The granting of the special exception should not have an adverse effect on the
public interest. Surrounding land uses and zoning are commercial and similar
uses have been approved in the vicinity in the past. Surrounding uses are of
similar intensity and character.
(4) The use is appropriate for the proposed location, is reasonably compatible with
adjacent uses and is not detrimental to urbanizing land use pattems.
"Yes, business area."
The proposed use is compatible with adjacent uses, and is appropriate for this
area. Surrounding uses include a vacant lot used for parking of various types of
vehicles, retail stores, and vacant commercially zoned land.

(5) The use will not adversely affect property values or living conditions, nor be a
deterrent to the development of adjacent property.
"No."
The proposed vehicle sales lot will make use of now vacant property. Given
the nature of the surrounding area, outside vehicle sales should not likely affect
property values or discourage development of adjacent properties.
(6) The use may be required to be screened from surrounding uses to reduce the
impact of any nuisance or hazard to adjacent uses.
"If necessary."
The only property that may need to be screened is the vacant land to the
immediate north. The other surrounding uses are not dissimilar in character or
potential intensity of use to that of the proposed use. No nuisances are
expected to be associated with vehicles sales lot that adversely impact adjoining
commercial uses.
(7) The use will not create a density pattern that will overburden public facilities such
as schools, streets, and utility services.
"No."
There is nothing associated with the proposed use that should be expected to
overburden such public facilities.
(8) The use will not create traffic congestion, flooding or drainage problems, or
otherwise affect public safety.
"No."
The proposed use will not create traffic congestion, flooding, or drainage
problems. No additional impervious surface is expected and therefore drainage
should be unaffected by the change in the use. The traffic generation of the use
is not in excess of the levels of traffic normally associated with other uses
allowed in the CHV District.

Based upon the foregoing analysis and findings, Staff recommends that Petition
Number 10- 005 -SE be Approved with the stipulation that the landscaping standards set

Please reference City Code Book Sec. 70 -348 Effective time limit on approvals. Paragraph (4)
Special exception use and variance approvals shall have a valid period of not more than two
years, prior to which a building permit application must be submitted or the approval
shall lapse.
