Consider requests for recommendation to City Council to amend the City's Land Development Regulations for uses for the Commercial Zoning Districts regarding store front churches - Planning Consultant. NOVEMBER 18, 2010 - PLANNING BOARD /BOARD OF ADJUSTMENT AND APPEALS - PAGE 2 OF 4 ACTION - DISCUSSION - VOTE Mr. Brisson presented the LaRue Planning Staff report to the Board, explaining the application meets all the criteria and is compatible with the surrounding property, however there may be a problem with the parking and septic may be an issue. These items will be determined at the Technical Review Committee (TRC) site plan review. Alternate Board Member Baughman moved to approve Petition No. 10 -004 SE to allow a restaurant, cafe within a Light Commercial (CLT) Zoning District, Ref. Sec. 90- 253(1) for property located at 510 NE 2nd Avenue subject to site plan review; seconded by Board Member Burroughs. There was no discussion. BURROUGHS - YEA MCCOY- ABSENT MORGAN - YEA BRASS - YEA Mr. Brisson distributed a memorandum dated November 18, 2010, regarding "Storefront churches ". At the November 2nd City Council meeting, the Council directed that the Planning Board consider how to provide for locating a church in a "storefront" in a commercial zoning district. This action was the result of a local religious group wishing to locate its church in a now vacant unit located in a shopping center. The owner of the shopping center felt that "in these hard economic times she needed to be able to rent the office space available, and she had a few opportunities to rent to churches." Mr. Brisson presented the following comments. Under current regulations houses of worship are a permitted use in the residential districts on a site of at least five acres. If the site is less than five acres, it is a special exception and must be on a site of at least 40,000 square feet. In the commercial districts a house of worship is allowed as a special exception, and the special exception requires a site of at least 40,000 square feet. There is no provision for a church on less than 40,000 square feet in any district or location in the City. The memo further provides for general information on "storefront churches ", such as parking requirements as defined by the Fire Department. AGENDA VII. NEW BUSINESS - Continued. A. NOVEMBER 18, 2010 - PLANNING BOARD /BOARD OF ADJUSTMENT AND APPEALS - PAGE 3 OF 4 J `� n ACTION - DISCUSSION - VOTE The memo continues, the planning staff only considered allowing storefront churches in commercial zoning districts and industrial, where applicable, either in multi -use buildings along a commercial strip or in shopping centers, not in a single - use freestanding building. If a church is to be located in a free - standing building, it should be required to meet the current minimum lot requirements for churches. Planning Staff is proposing two tier regulation. Tier one for storefronts with less than 1,500 square feet of gross floor area and another for storefronts with 1,500 or more square feet. In both cases storage spaces are excluded. 1,500 square feet and above would require a special exception. In conclusion, another simpler, alternative would be to allow "storefront churches" as a matter of right only under a certain size - perhaps 2,000 square feet - with the same conditions and submission requirements as discussed. Parking would be required at the rate of one space per 90 square feet. Larger storefront churches would not be allowed. The requirements would be submitted by the applicant and the City would verify the requirements. The Board questioned what basis was used for the square footage. Mr. Brisson reported one person per 30 square feet and figured out what essentially the parking would be and once you get over 50 people the fire department criteria enters in. Once above 1,500 square feet the parking doubles. The Board also questioned the Central Business District (CBD) regulations concerning parking. Mr. Brisson answered, virtually the only parking provided for in the CBD Zoning District is on- street parking. The Board decided the recommendation for CBD Zoning district would be exempt from parking specifications. Mr. Brisson acknowledged the City Council does not want interpretation, they prefer rules. Board Member Burroughs made a motion to recommend to City Council to adopt an ordinance that is consistent with option number one as stated in the memorandum presented by the City Planner eliminating parking restrictions in the CBD Zoning District; seconded by Alternate Member Brass. A "storefront church" is a church housed in a storefront building, usually in a commer- cial area, rather than a freestanding building initially constructed as a church. If the City is to consider allowing a "storefront church" in its commercial zoning districts, which most jurisdictions do, parking must be considered. 1. Churches, as places of assembly, typically generate the need for more parking than conventional commercial uses. However, the times of maximum use of a church do not usually occur at the same time as those of office or retail /service uses. Sunday, as a typical church -going day, is not usually a period of maximum retail activity. 2. The parking requirement for a church without fixed seating is one space per three seats, implying one space for each three persons. However, under Sec. 90 -482, computation of parking spaces in places of public assembly is based on the maximum occupancy rating given the building by the fire marshal. 3. The Fire Marshal uses the following standards for places of assembly without fixed seating, which is the most likely scenario in a "storefront church." a. Maximum occupancy of 50 or more persons based on 15 square feet per person (net, excludes tables, etc.) b. Maximum occupancy of fewer than 50 persons based on 30 square feet per person (gross, includes all of what would normally be considered sales area). LOCATIONAL CONSTRAINTS ON "STOREFRONT CHURCHES" We are only considering allowing storefront churches in commercial zoning districts, either in multi -use buildings along a commercial strip or in shopping centers, not in a single -use freestanding building. If a church is to be located in a free standing building, it should be required to meet the current minimum lot requirements for churches. 2 PROPOSED REGULATIONS TO ALLOW FOR "STOREFRONT CHURCHES" Our initial thoughts are that there should be two tiers of "storefront churches" based on the maximum occupancy one for storefronts with less than 1,500 square feet of gross floor area and another for storefronts with 1,500 or more square feet. In both cases storage spaces are excluded. 1. Storefronts with less than 1,500 square feet of gross floor area (excluding storage areas) will be permitted outright with the following information to allow the City to determine whether or not the existing parking inventory on the site can accommodate the parking demand associated with the "storefront church a. The applicant must submit to the City a list describing all of the uses in the multi -use building or shopping center, including: (1) Their square footages upon which parking is calculated (excluding storage) (2) Description of the use (e.g., retail, restaurant, professional or business office, medical office, etc.) (3) Hours of operation. (4) Total parking spaces available to all uses within the multi -use building or shopping center. (5) Square footage of vacant spaces shall also be provided. b. The applicant must submit documentation of the square footage of the "storefront church" (less storage areas) and the day/hours of major use of the church with estimates of attendance /occupancy at those times. c. Parking demand for the "storefront church" will be based on one space for each 90 square feet of floor area excluding storage areas. This is the equivalent of one space per each three persons at the maximum occupancy used by the Fire Marshal. 2.
