Board Attorney John Cook requested the withdrawal of Case 09-098, Bank of America, from today's agenda due to improper
notification.
Code Officer Sterling testified he had received a complaint of someone living in a shed on this property, the shed does not meet
the standards for single family dwellings. When the property owner, Serafin Cervantes, received the notice of violation, he came
in and talked to the City Engineer, Oscar Bermudez, stating the shed was used only for storage and no one was living there.
However, when the City Engineer went to look at the property it appeared to him that someone was living in the shed. In
addition, the City Police Department responded to a call at this location on January 17, 2010. Their report clearly stated contact
was made with someone living in the shed. Member Irby moved to find Case 10-011 Serafin Cervantes, in violation of Ch 90
Sec 90-167 Standard for single family dwellings based on the testimony of Code Officer Sterling, imposing a fine of twenty-five
dollars per day beginning fourteen (14) days from today; seconded by Member Pippin.

Code Officer Sterling testified this property was in compliance as of March 8, 2010. No action was taken by the Code
Enforcement Board.
Code Officer Sterling testified the property was in violation from February 9, 2010 until March 8, 2010. He added this location
has continually been a problem and he spoke with the owner today informing her it needed to be mowed on a consistent basis.
Member Huckabee moved to find Case 10-016 Wendi Snow, in violation of Ch 30 Sec 30-44 General cleaning from February
9, 2010 until March 8, 2010, based on the testimony of Code Officer Sterling, therefore in the future this property owner will be
considered a repeat violator; seconded by Member Close,

Investigation Narrative
On Tuesday, January 19, 2010, I, Sergeant J. Bernst, was advised at evening
briefing by Sgt. Wendt that code enforcement officer Fred Sterling was
requesting information about subjects living in outbuildings at 209 SW 7th
Avenue. It happens that on 01/17/00 at approximately 0330 hours, myself and
Officers Almazon and Cisneros were at that address attempting to make contact
with someone in reference to a battery case that Officer Boon was
investigating.
While on the property, we made contact with a subject living in
north end of the property. The property was also littered with
if not hundreds, of beer cans and bottles along with some trash
advised that code enforcement had received a complaint about the
sewage coming from the property, however, that was not observed.

Sec. 90-194. Minimum requirements for spe-
cial exceptions for residential
migrant housing facilities.
The city, in the interest of aesthetics, health,
safety and welfare of the general population,
deems it desirable and necessary to define and set
forth the minimum requirements to obtain a
special exception for residential migrant housing
facilities in the RMF district as follows:
(1) Any application for special exception for
residential migrant housing facility shall
also include the additional information of
this section.
(2) The applicant shall submit a site plan
which shall include floor plans showing
the size and dimensions of all rooms, and
list the maximum number of persons who
may occupy each structure pursuant to
the provisions of F.S. § 381.008, or other
applicable state or federal provisions. Such
application shall include a state permit to
operate a migrant housing facility pursu-
ant to F.S. § 381.0081.
(3) The owner of the facility shall submit an
affidavit stating that the facility shall be
inhabited solely by individuals and their
families who are migrant farm workers
employed in active agricultural opera-
tions, together with the name and loca-
tion of such operation; and that the facil-
ity shall not be inhabited on a yearround
basis, except that single individual or
family may occupy the facility yearround
if they act as caretakers under a contract
therefor with the owner.
(4) The facility shall not house a number of
persons in excess of dwelling unit densi-
ties for affordable housing set out in sec-
tion 90-76.
(5) No migrant facility shall be located closer
than one mile from any other licensed
migrant facility, and no migrant facility
shall be located within 1,000 feet of any
church or school.
(6) Any migrant facility shall comply with all
other regulations and land use regula-
tions for density, setbacks or other require-
ments of this zoning classification.

Sec. 90-195. Customary accessory uses
Each permitted principal use and special ex-
ception use in the RMF district is also permitted
to have the customary accessory uses for that use.

Except where further restricted by these regulations for a particular use, the minimum lot and
structure requirements in the RMF district shall be as follows:
