MINUTES OF THE TECHNICAL REVIEW COMMITTEE THURSDAY APRIL 15, 2010, 10:00 A. M. CITY OF OKEECHOBEE 55 Southeast 3rd Avenue Okeechobee, Florida 34974 Page 1 of 3 I. CALL TO ORDER — Chairperson. MINUTES — Secretary. A. Chief Davis moved to dispense with the reading and approve the January 21, 2010 Technical Review Committee Minutes regular meeting; seconded by Chief Smith. Motion carried unanimously. V. NEW BUSINESS — Chairperson. A. D and A Properties Inc., 10- 004 -TRC — The application was submitted by Jeff Kennedy of Kennedy, Lynch & Assoc. on behalf of property owners David and Anita Nunez to construct a seventy-three (73) space parking lot located SE comer of NE 3rd Street and NE 7th Avenue to accommodate commercial buildings for Shoppes on the Boardwalk to be constructed In a single phase - Senior Planner. Technical Review Committee — April 15, 2010 - Page 2 of 3 Mr. Brisson presented the LaRue Planning Staff Report to the Committee citing an additional handicap space needs to be added to the southern parking lot, and a distance of 20 feet from the road right -of- way /property line and the first parking space is typically considered appropriate to avoid conflicts between vehicles entering the parking lot and those attempting to enter or leave a parking space. The parking space closest to the NE 3rd Street entrance to the parking lot is less than 20 feet from the property line and could result in vehicular conflicts. Site plan shows only 11 of the required 16 trees within the parking lot, and no sealed light plan was submitted. Upon compliance with issues listed above, staff recommends approval. Jeff Kennedy of Kennedy and Lynch Engineering addressed the Committee representing the applicant. He agreed to comply with all issues cited by Mr. Brisson, with the exception of the lighting plan, which he said he would pass the information to the applicant for compliance. Mr. Kennedy also stated he would supply three sets of revised plans. Environmental Health had no comment. Building Official Schaub asked whether there should be a sidewalk from the parking lot to the buildings. Mr. Kennedy affirmed striping a walkway from the parking to the buildings. The Committee agreed that would be sufficient. Mr. Schaub also brought up the concern of the radius of the driveway approach from the new to the old at the south side by Taylor Creek. Chief Smith said his concern was having access to the buildings. Mr. Schaub also added photo optics need to be on the lighting plan. Chief Smith instructed a fire lane 20 foot wide needs to be designated in front of the restaurant. Engineer Bermudez had no comment. Director Robertson instructed Mr. Kennedy, the sidewalks are required to be 6 inches thick, not 4 inches as denoted on the plans. Chief Davis had no comment. Administrator Whitehall stated as a matter of record, the conditional CO that was issued for the restaurant was based upon the addition of this parking lot. If additional parking is required, no reduction of parking can be requested without recommendation from the Technical Review Committee. Chief Davis made a motion to recommend approval to construct a seventy -three (73) space parking lot located at 301 NE 7th Street to accommodate commercial building for Shoppes on the Boardwalk complex, to be constructed in a single phase and comply with issues of additional handicap parking space, additional 5 trees for landscaping, sealed and signed lighting plan with photo optics and 3 sets of revised sealed plans submitted to the City; seconded by Chief Smith. Chairperson Whitehall introduced a memo by Senior Planner Brisson regarding Site Plan Review requirements and asked for discussion after presentation of Planner Brisson. Mr. Brisson explained the reasoning behind the memo, that Secretary Clement distributed after the agenda was prepared, stating the options of requirements in reference to minor and major site plan review and cost effectiveness for the applicant and the City. Mr. Brisson gave his findings and Chairperson Whitehall asked the Committee for their input. Discussion ensued and options were discussed. Chairperson Whitehall asked each member of the Committee to give thought to criteria for presentation to the Planning Board for possible recommendation to the City Council to change the LDRs for site plan review. The developer has an immediate need to open their business. Therefore, this memo is to establish the criteria in issuing what is now a Conditional Certificate of Occupancy: 1. The City Building Official and City Fire Inspector have approved the facilities to the extent under their jurisdiction without regard to the parking issues and have found no dangerous or hazardous incompliance particulars that would adversely effect issuing a C /O. 2. That unimproved parcel directly north of the building described as 204 to 208 NE 7th Avenue will be used for overflow parking and will be improved to the extent possible, including grading and temporary surface until such time as the City's TRC will convene to address a more permanent solution to parking as it relates to the entire development. 3. It is agreed that the developer will take the following measures to assist in reducing any parking issues: a. A separate unimproved area in the north and east side of the development will be provided for employee parking. The developer agrees to provide adequate lighting and security in that area. b. The use of Valet parking will be offered at the facility with those vehicles parked in an area next to the employee parking. c. Signage will be provided by the developer to direct overflow traffic to the area described in sect'n 2, above. d. When appropriate (after approval by the Planning Board and TRC), the developer will build a parking lot on the unimproved area mentioned in sect'n 2 above. October 2008 went thru the TRC process and the configuration included: 1. 5,250 sq ' retail & 7,150 sq ' office space (1/300) 41.3 pkg spaces 2. 6,615 sq ft of indoor recreation (1 /200)(gaming) 33.1 pkg spaces Total 74 pkg spaces Since then, 74 spaces constructed but what gives rise to discussion is the following, which has become apparent during inspection for the C/O & business licensing: East Bldg- North sect'n (3,740sq') is no longer to be used as office (1/300) but to be used as 'indoor rec' (1/200), a more intensive use. It is still under construction w/ no opening date South sect'n (1,500sq') is no longer 'retail' (1/300) but is now part of the billiard and gamming center (the VIP Lounge) which is more intensive use est by Bill Brisson at 1/200) The area can be reduced by Code by approx 160sq' fro an 8X20 storage area. Therefore 1340sq' applicable. Owner wants this sect'n open w /in next week or so. The middle sect'n (6,615sq') has the function of the billiards bar and grill, which the owner contends was what was presented at the TRC and was determined to be 1 space per 200sq . The parking related to that sq' can be reduced according to Code by the kitchen area (1,106 sq') Therefore 5509sq' applicable to billiards and restaurant Patio /deck area includes approx 890 sq ft (need to remeasure under roof part) to be used as outdoor seating with the remainder of the deck unobstructed walkway area. - Summary of East bldg - 1. The north part of the east bldg (3750sq' — 19 spaces) is under construction and the west part of the west bldg (approx 2350sq' - 11 spaces (is under construction w/ an opening date a ways away. If the City considers temporary lenience of the parking based on the under - construction -area there would be a required reduction of 30 spaces. The owner has submitted for a land use and zoning change for the area just north of the west office bldg to be addressed at the 3/18/10 Planning Board meeting and then subsequent City Council meetings. That area is appently additional parking spaces. At some point in time, the TRC will have an for about 50 re- evaluate the area in conjunction with that parking facility. Further, the area no htand east of that parcel will be used for a valet parking according to the owner, with patrons from the entrance to the `Hammerhead Billiards' The owner has directed all employee parking to the area mentioned above...north and east part of the Nunez property. With some amount of reduction (12) by the Council and the construction of the parking lot (50), the shortage of 62 spaces can be addressed. However, unfortunately, the parking lot isn't done and it will be a couple of months before the zoning and construction can be done. In the meantime, the owner has indicated that unimproved parking area to the north can be graded and fixed with directional signage for what will be the obvious overflow parking needs. A. SITE PLAN SUBMITTAL AND REVIEW REQUIREMENTS The LDC currently contains no guidance as to when a site plan must be submitted for review by the TRC. We were requested to address a possible threshold that would trigger the need for submission of a site plan and its subsequent review. There seem to be two issues at hand. First, when does a property owner /applicant need to prepare and submit a site plan? Second, are there situations when the site plan might be approved administratively and at a lesser costs than would be the case with a formal review at a TRC meeting? To be able to determine whether or not a formal site plan review at a TRC meeting is necessary, any application for a building permit or a Business Tax Receipt that involves new construction, expansion of a structure, or a change in use should be required to complete an application for a site plan review and include a complete site plan. 1. Minor Site Plan Review Determination Except for the following development applications, all site plan reviews will be considered major site plan reviews which should automatically be conducted at a TRC meeting. a. Replacement of a conforming structure and /or conforming use on the same building footprint and of the same square footage and height as the structure it is replacing. b. A change in the use of an existing structure such that the new use requires no more than a total of four parking spaces. This is because parking is one of the factors that most affects the complexity of a site plan. When the number of required parking spaces is very few, the site plan review can be relatively simple. Minor Site Plan Review and Sign -Off by Individual TRC Members? Once it is determined that a project requires only a minor site plan review, the Zoning Administrator could be granted the authority to administratively approve a site plan without the need for a formal TRC meeting to discuss the site plan provided each of the following conditions are met: a. A Staff Report is prepared which contains conclusions that the site plan is in strict compliance with the minimum required lot area and all required setbacks; maximum building coverage and impervious coverage limitations; minimum number and design requirements for required off - street parking, ingress and egress; minimum require- ments for landscaping and landscaped buffers; maximum allowable height. b. Each member of the TRC has commented on and found the site plan to be acceptable with regard to all pertinent issues within the expertise and purview of that member; or specific conditions or stipulations are set forth that will make the site plan acceptable to that TRC member. In the event any voting member of the TRC determines that the site plan is deficient and cannot be found acceptable without further discussion among the TRC members, the site plan will be scheduled for discussion at a TRC meeting. 3. Review by TRC at an official TRC meeting. All site plans not considered a minor site plan review, or minor site plans determined by a TRC member to require additional consideration as describe above, will be reviewed and considered for approval at a formal TRC meeting. B. SITE PLAN REVIEW FEES 1. Current Costs We've checked on the time involved in some of the simpler site plan reviews over the past year or so. Specifically these were 09- 001 -TRC, Mid Florida Credit Union; 090 - 002 -TRC, Big Lake Eye Care; 09- 004 -TRC, Miller Accounting; and, 09 -007, Bridges Auto Lot. For the most part, preparation of the Staff Report for a business that requires six or more park- ing spaces typically takes about six hours. Attendance at, and travel time to and from, the TRC meeting usually amounts to five (5) or six (6) hours. This time is split among the various site plans being reviewed at the meeting. Usually there is more than one plan on the TRC agenda, so allocating the time among the different plans results in another 1.5 to 2.5 hours being added to the cost of each site plan review. Therefore, total time involved on these types of site plan reviews usually runs just about 8 hours. This alone approximates $900 in cost to the City. When you add in the time of other City employees involved, in the process, advertising, etc., we think it's clear that the $1,000 charge is certainly not excessive whenever a hearing before the TRC is necessary. 2. Reduced Fee for Less Intensive Projects that Require only "Minor Review" Without Consideration at a TRC Meeting When a project involves just a few parking spaces, for example four (4) or less, the land- scaping requirements for parking and vehicular use areas (Sec. 90 -533) do not apply and there is somewhat less time involved in preparing the Staff Reports. Preparation of the Staff Report for such a project will still probably involve a minimum of three (3) to four (4) hours, with a cost approximating $350 -- $450. Adding even two hours for the shared cost of travel to /from, and attendance at, the TRC meeting would mean the cost of the site plan review and meeting would be at least $600 or perhaps slightly more, plus any other cost the City would incur in preparation for and holding the TRC meeting.
