Mr. Nelson, property owner and applicant reported to the Board, living at the same address for 30 years and having the shed for 25 years. The shed now needs to be replaced and needing more space. Mr. Nelson stated he wants to improve the property and has spoken to all his surrounding neighbors and none objected. Darrell Ferneau, 1302 SE 8th Avenue, neighbor reported having no objection. The Special Exception is now being requested by the owner of the property to avoid further problems. The concerns are landscaping, due to extensive pavement, safety issues due to four ingress/egress opportunities and anesthetics such as the fence. Staff feels landscaping could be improved through planters. Mr. Emilio Perez, owner and applicant addressed the Board stating he has been the owner for 20 years. The property has been leased for many years. Have had no problem with the school located on the south side of the business. Will replace the wooden fence and stipe the 3 parking spaces requested by the Building Official of the City. No problem with providing landscaping, however closing any of the existing driveways would be a problem. Pastor Jim Waters of Grace Brethren Church spoke concerning possible noise that would be generated by the new leasee, ei, air wrenches and pneumatic tools. The church and school want to appeal to the community with neatness and clean property, also surrounding properties. Chair Maxwell closed the Public Hearing. The Board discussed having damaged cars in a fenced area at the rear of the property so as not being visible from the street. Clean cars for sales could be placed in front. The minimum allowable setback is 10 feet. Placement of the new shed will also likely expand the amount of the shed which now extends eastward beyond the rear property line. 1 Staff Report Variance Request Applicant: Steven and Andrea Nelson Petition No.: 10 -001 -V Subject Site and Surrounding Area: According to aerial photography, the subject property and some others along the Augustus Canal have accessory structures that are situated in violation of the side setbacks. Some, including the subject property also have accessory structures (other than docks) that extend beyond the rear property lines onto the banks of the Augustus Canal. We have no knowledge as to whether or not the intrusions beyond the rear property lines are legally or illegally nonconforming. We do, however, suspect that the intrusions into the side yard setbacks are legal nonconformities do to actions likely taken before the City's set back provisions were adopted. The property on which the storage shed is located is bordered on both sides and across the canal by residentially developed RSF1 properties. We have estimated the extents of building coverage and total impervious surface coverage after the new shed is erected. Both building coverage and impervious surface coverage will remain within the allowable maximums if the larger shed is located on the property. Discussion: Standards for Granting a Variance (Sec. 70- 374(b), page CD70:20 in the LDRs): Applicants are required by Sec. 70- 374(b) to address the following issues in his /her presentation before the Board of Adjustment. Staff strongly recommends that the Applicant include, in his /her application, materials that address each of these issues in order to allow Staff and the Board of Adjustment sufficient time to adequately consider the Applicant's request. The Applicant has submitted brief responses addressing these standards. For ease of review, we have included the Applicant's responses followed by Staff Comments in bold typeface: 1. Demonstrate that the variance is needed to overcome a hardship caused by the unique physical conditions of the site (and not merely for economic reasons or the convenience of the applicant). Location of existing shed and size of lot @ 1960. Granted the lot is smaller than the required 10,000 square feet. However, it is difficult to ascribe a hardship to the property owner's desire to have a larger storage shed. This is especially true when the existing already intrudes into the required side yard setback and even extends beyond the rear property line and the new shed will be even closer to the side property line. 2 Staff Report Applicant: Steven and Andrea Nelson Variance Request Petition No.: 10 -001 -V 2. Specify the minimum variance required including height, lot area, size of structure, size of yard, setback, buffer or open space. (Applicant should explain why the requested variance is the minimum necessary to overcome the hardship.) 2 feet addition to existing concrete slab. See photos. The Applicant has provided no real explanation of why the new shed needs to be placed closer to the side property line. There is now about 9.5 feet between the shed and the landscaping around the pool. If the new shed were put two feet closer to the pool landscaping there would still be 7.5 feet available between the two. We see no reason the setback should be further reduced when there are alternatives; these being extending the slab two feet closer to the pool, or replacing the shed with one the same width. Findings Required for Granting a Variance (Sec. 70- 374(c), page CD70:20 & 21 in the LDRs): After reviewing this application, Staff has determined that the request generally satisfies the criteria outlined below for granting the variance: 1. Special conditions and circumstances exist which are peculiar to the land or structure involved, and are not applicable to other land or structures in the same zoning district. Due to conditions at the time subdivision was platted in 1960. Neither the storage shed nor this particular lot is unique. There are numerous lots of the same or very similar size and configuration in the immediate area and elsewhere in this subdivision. 2. The special conditions and circumstances do not result from actions of the applicant. Yes. Since we cannot agree that there are special conditions, this question becomes extraneous. 3 Staff Report Applicant: Steven and Andrea Nelson Variance Request Petition No.: 10 -001 -V 3. Literal interpretation and enforcement of the Land Development Code would deprive the applicant of rights commonly enjoyed by other properties in the same zoning districts under the terms of the Land Development Code, and would work unnecessary and undue hardship on the applicant. Other homes have structures at or on property line. Sec. 70 -374(a)(3) pertaining to variances specifically addresses this issue and eliminates the above argument as a basis for granting a variance. This section reads as follows: "(3) Establishment or expansion of a use or density otherwise not permitted shall not be allowed by variance, nor shall a variance be granted because of the presence of other nonconforming structures in the zoning district or adjoining district." [emphasis added] 4. The variance, if granted, is the minimum variance necessary to make possible the reasonable use of the land or structure. Yes. We disagree. Granting the variance will be compatible with the intent and purpose of the Land Development Code, and the variance will not be injurious to the neighborhood or detrimental to the public welfare.
