A RESOLUTION OF THE CITY OF OKEECHOBEE ESTABLISHING A
PROCEDURE FOR ZONING, COMPREHENSIVE PLAN AMENDMENTS
AND OTHER CITY BUSINESS REQUIRING A PUBLIC HEARING;
PROVIDING FOR AN EFFECTIVE DATE.
BE IT RESOLVED by the City of Okeechobee, Florida as follows:
POLICY
The intent of these procedures is to assure a fair opportunity for all persons to be
heard, and assure that the best interest of the City is protected.
The procedure for addressing the City Council at Zoning and Comprehensive Plan
Amendment Public Hearings are prescribed below. The May has the authority to use
these procedures for other public hearings as he deems appropriate.
PROCEDURE
The procedural order for public hearings shall be as follows:
Mayor's Authority
1. The Mayor shall conduct the meeting according to this procedural guideline.
2. The Mayor shall have the right to modify these rules or impose additional
rules to accommodate or facilitate a particular proceeding.
3. The Mayor shall have the right to limit redundant, incompetent or improper
testimony.
City Attorney
1. The City Attorney shall ensure that matters of records and specific legal
requirements are met. Participants shall notify the City Attorney at least
four (4) working days in advance of the hearing. A complete copy of all
cases, rules, statutes, memoranda, or briefs to be submitted, cited, or relied
upon by participants at the hearing shall be presented to the City Attorney
and the City Administrator at least 72 hours prior to the hearing.
Council Members Authority
1. Council members may question any witness at any time and shall be
afforded an opportunity to question each witness prior to any cross-
examination.
Recognition of Participants
1. All persons wishing to participate in the hearing shall request recognition at
the beginning of the proceedings.
2. All persons anticipating participation will be sworn in by City Attorney.
3. All persons presenting testimony shall identify themselves by name,
affiliation, and business or residential address as is appropriate.
