Requests for the addition, deferral or withdrawal of items on Code Officer Sterling requested the withdrawal of Case 09-023 Robert Leach, and Case 09-053 0 Town Properties, from today's agenda. Disposition of Cases presented by Code Officer Sterling : No. 09-041 Code Officer Sterling testified he had been in contact with the property owner, Michael Arnold, and as of this morning the Michael Arnold. 1007 N Parrott Avenue property is about ninety-five percent in compliance. Mr. Sterling requested the Board find him in non-compliance from April24, Ch 30 Sec 30-43 Public nuisance 2009 thru July 14, 2009 so he would be considered a repeat violator in the future. Member Irby moved to find Case 09-041 Michael Arnold, in violation of Ch 30 Sec 30-43 Public nuisance from April 24, 2009 thru July 14, 2009; seconded by Member Huckabee. VOTE GAMIOTEA - YES IRBY - YES HUCKABEE - YES MCCREARY - ABSENT REVELS - ABSENT SWEDA - YES HUNT - ABSENT MOTION CARRIED. No. 09-049 Code Officer Sterling testified he had spoken with business owner, Leo Garcia, who stated a sign company was hired to put Building Blocks Preschool.1811 SW 2' Avenue out signs advertising their summer program. He promised no more signs would be put out. Mr. Sterling reminded Mr. Garcia Ch 90 Sec 90-568 Prohibited signs the same promise had been made last year. Mr. Sterling requested the property be found in violation from May 22, 2009 thru July 2, 2009 then if it happens again next year it will be a repeat violation. Member Huckabee moved to find Case 09-049 Building Blocks Preschool, in violation of Ch 90 Sec 90-568 Prohibited signs from May 22, 2009 thru July 2, 2009; seconded by Member Irby. Delivered Notice of Violation, signed for by Kizzy Boswell. • 06/04/2009 — Sign placed at Walgreen's, removed sign. • 06/30/2009 — Sent Notice of Hearing. • 07/01/2009 — Notice of Hearing received, signed for by Leo Garcia. • 07/02/2009 — Mr. Garcia called, explained to him that snipe signs are not legal. He stated that there would be no more signs placed within the city limits. I reminded him that we had this same conversation last year and at that time he promised not to put any more signs out.
