A. Street Closing Petition 09- 006 -TRC continued.
Mr. Brisson addressed the Committee, stating he was very impressed with the reasons stated in the application for the street closing.
Mr. Brisson further stated LaRue Planning Staff recommends approval.
Mr. Jim Threewits, Deputy County Commissioner for Okeechobee County asked the Board whether they had any questions?
Administrator Whitehall questioned the comments from Embarq. Mr. Threewits stated the comments of concern were addressing 4th,
which is not part of the petition.

FC Accessibility to the proposed building? Mr. Threewits replied yes, on the East side.
BO No comments.
CE Always feel the City should not give away property, but this project is a benefit to the City as well as the County.
PW No issues.
PD No Issues.
Chief Davis made a motion to recommend approval to the Planning Board for Street Closing Petition 09- 006 -TRC to close NW 7th
Avenue from NW 4th Street to NW 6th Street, and close NW 5th Street to dead -end, seconded by; Chief Smith.
Motion carried unanimously.
B. Outdoor vehicle sales Lot 09 -007 TRC. The application was submitted by Linda L. Bridges for site plan review for
outdoor vehicle sales lot located at 920 NW Park Street Senior Planner.
Mr. Brisson presented the Staff report of approval with four issues needing to be addressed by the applicant. Mr. Brisson went on to
state the development of the property is consistent with the surrounding commercial property with the exception of one lot that is zoned
RMF. Traffic does not appear to be a problem. The issues are with the width of the drive through the property being shown as 10 feet
which should at least be 12 feet, the placement of the dumpster, no sidewalk shown on 10th and no lighting plan was submitted.
Mr. Larry Bennett of H.L. Bennet, of LaBeIIe, Florida addressed the Committee representing the applicant. Mr. Bennett stated all the
issues would be addressed.
Mrs. Linda Bridges, the applicant stated the business across the street had the same type dumpster placement. Mr. Whitehall replied
that is a situation the City is trying to address. Mrs. Bridges also stated she was planning on putting a spot Tight on the pole by the
dumpster. Mr. Brisson interjected, the applicant does not need to supply a lighting plan, but does have to comply with the code.
Mr. Whitehall expressed concern regarding the spotlight and instructed the applicant to make sure this would cause no concem with
the surrounding neighbors or drivers on SR 70.
Mrs. Bridges stated the one -way, 10 foot driveway through the property was for safety and would provide for open space.
Administrator Whitehall then asked for concems from the Committee:

IV. New Business Continued.
B. Outdoor vehicle sales Lot 09 -007 TRC continued.
BO Drive needs to be at least 12 foot wide, and dumpster placement needs to be addressed, also the configuration off 10th is a little
peculiar. Mr. Whitehall then interjected, the drive needs to be 20 foot wide with two lanes, and the dumpster needs to be relocated.
The Building Official then addressed the residence, stating there needs to be firewalls and such. Mr. Bennett replied, yes. Mr. Schaub
inquired of the applicant why the necessity for the residence? Mrs. Bridges replied that she lives in Ft. Lauderdale and when she
comes to Okeechobee she wants a place to stay.
Engineer Bermudez instructed Mrs. Bridges to check with the DMV when getting the license to sell cars to be sure that more than one
business is allowed on the same property.
Mr. Schaub inquired if Mrs. Bridges would be leasing the businesses? She replied, yes. Possibly having an office, when someone
buys a car, they can get temporary tags.
FD Really need 20 foot for the fire truck to maneuver through the property. Ten foot would be adequate as long as there was nothing
on either side of the drive and the one oak tree that is on the property has to allow clearance of at least 13' 8" for the height of the truck.
Administrator Whitehall said it was reasonable of the Committee to request the 20 foot, two -way drive though, this would improve
everything all around. Mr. Bennett said one -way was preferable, but two -way would not be a problem either.
The Fire Chief stated he has a problem with the gates on both ends of the drive, if the Fire Department should need to access the
property, the gate(s) may be destroyed.
CE Sidewalk along 10th a must.
PW The swale may need to be graded to allow for the sidewalk, also concerned about first pipe off SR 70. Driveway should be
widened and may need to extend drainage pipe North.
PD Fence around the perimeter with locked gates at night is a concem. If the officers do not have access to patrol the lot, break -ins
could be a problem. Also need adequate lighting.
Chief Smith made a motion to approve final site plan review for outdoor vehicle sales, convert existing carport into vehicle sales office,
(362 s.f.) remodel existing residence, (700 s.f.) for professional office and remaining, (600 s.f.) for single family dwelling unit for
property located at 920 NW Park Street with the following contingencies: Lighting to be reviewed with the Planner and the
Engineer, 2 lane drive through, at least 20 foot in width with adequate radius off NW 10th Avenue, sidewalk installed on NW
10th Avenue and relocation of the dumpster; seconded by Engineer Bermudez. Motion carried unanimously.

With reference to your request to vacate the above referenced roadway sections, Embarq does
notobject to the vacation of NW 7 Avenue or NW 5' Street as depicted on the attached,
however we do object to vacating the area shown along NW 4th Street from the intersection
with. NW 6th Avenue proceeding West along NW 4th Street for a distance of 300'. If you would
like;this area to be vacated, we will need to confirm the exact location of the facilities. Our
facilities can potentially be relocated, if there is a conflict, at the cost of the property owner
effectuating the move. Alternatively, if we can remain in place with access to facilities for
operations, maintenance, upgrades, etc., we can discuss conveyance of an easement over our

vacating public rights -of -way.

Section 78 -33 of the Land Development Regulations requires the reviewing bodies to find that an
application for vacating rights -of -way meets the following requirements. The Applicant has
provided brief written responses to each of the required findings. For your consideration, the
Applicant's responses are provided in Arial typeface, followed by Staff comments.
1. Proposed vacation is consistent with the Comprehensive Plan.
"Yes, this will afford Okeechobee County to establish connectivity between multiple facilities;
Okeechobee Sheriffs Office, Fire Rescue station #1 and the currently proposed
Okeechobee Emergency Operations Center."
Staff agrees. Both the Public and Industrial Future Land Use Categories contemplate public
uses.
2. Right -of -way to be vacated is not the sole access to any property and the remaining access is
not an easement.
"Correct, Okeechobee County is the sole owner from NW 5 Ave. west to CSX Uptown Spur
and from NW 6 St. south to the unimproved portion of NW 4 Street."
Staff agrees. The requested vacation will not eliminate sole access to any property not
owned by Okeechobee County.
3. Proposed vacation is in the public interest and provides a benefit to the City.
"Yes, these rights -of -ways divide land currently owned by Okeechobee County
which limits their functional use. We are currently proposing to construct the
Okeechobee County Emergency Operations Center and the r -o -w's need to be
vacated for that purpose. Additionally, this vacation request will provide for a "Public
Safety Complex."
Staff agrees. The requested vacation is in the public interest and provides a benefit to the
City in the form of improved countywide emergency operations services.
4. Proposed vacation would not jeopardize the location of any utility.
"Correct, all utility issues have been addressed with the appropriate agencies, see
attached letters and utility sheet. The R. E. Hamrick Trust u/w has agreed to sell the
Trust Revisionary Interest for these two (2) R- O -W's, see attached vacant land
contract."
Staff agrees, assuming that agreement has been reached with OUA with regard to relocating
the water mains in NW 7 Avenue and in NW 4 Street.

NARRATIVE
INTRODUCTION
The subject property is being permitted by Linda L. Bridges Owner, and is being permitted
for the site improvement for the proposed building remodel project. The site is zoned CHV
(commercial) and is currently used as a legal non conforming use (SFR) single family
residence. A special exception approved under petition #09- 002 -SE allows a mix of uses on
the property including an outdoor vehicle sales lot and use of portions of the existing building
as a used car sales office, real estate office, and as a dwelling unit for the owner. Currently
the existing use provides grass parking in the front of the building. The existing and proposed
building parking requirement can be met with additional parking on -site. Site improvement
would include the required parking, landscaping, and the required drainage system, etc. The
location of the proposed development is west of the SR70 and US441 intersection in
Okeechobee in Section 16, Township 37 South, Range, 35 East, in City of Okeechobee
Okeechobee County.
EXISTING CONDITIONS
The property is approximately 0.65 acres an is owned by Linda L. Bridges. The project limits
are currently occupied by a 1,837 s.f. wood framed building (single family unit) and two
storage shed units that will remain on site. The site is surrounded by commercial (CHV)
zoned district to the south, west, east northwest, a SFR zone to the northeast. State Road
70 is to the south of the property. Ne 10 Avenue is to the west of the property.
The soil mapping unit over the site is Immokalee sand (11), based on information obtained
from the Soil Conservation Service (SCS) Soil Survey for Okeechobee County. Elevations
for the project are based on a site benchmark NGVD. The seasonal high water elevation for
the project is set at 30.00' (NGVD 29) based on the SCS survey. The natural ground
elevation in this area is between 31.5' to 32.0'.
PROPOSED CONDITIONS
The contiguously owned land area is approximately 0.65 acres. The project area is 0.65 acres
and will include the site improvement development of the existing building and its proposed
mixed use occupancy with its associated required parking, drainage and landscape improvements.
Existing grass parking and driveways will be improved as required by the City of Okeechobee and
FDOT. A driveway connection permit has been applied for thru FDOT. A revised parking layout and
driveway is proposed to better serve and provide a safer access to the existing building. Off site
improvements include the removal of one driveway and the paving of two existing
driveways. Minor drainage improvements are required. Existing city water meter will provide the
required potable water requirements. The existing sewer connection will remain as is.
Proposed building remodel will project will be permitted and designed by others. Existing
structure is of type V construction and will be protected and unsprinkled.
The site improvements required by the building have been addressed on the site development
plan.

The subject property is a parcel of land encompassing approximately 0.65 acres located

The subject site is designated commercial on the Future Land Use Map (FLUM) and
zoned CHV. With the exception of the property to the north of the existing single family
residence, which is zoned RMF and occupied by a single family dwelling, all imme-
diately adjacent properties are zoned CHV and in commercial use.
Following is the Staff analysis of the project's consistency with the various City require-
ments and regulations. Instances where the Staff believes the submission to be defi-
cient are highlighted.

Adequacy of Public Facilities:
The property is presently provided water and sewer service by OUA and the additional
commercial activity is not expected to present a significant increase in demand. Similarly, any
increase in solid waste generation will be minimal and the County has recently confirmed a
considerable level of excess capacity available to serve the solid waste disposal needs of other
major developments in the City. It is reasonable that the volume of solid waste associated with a
development of this size can also be accommodated within the capacity of the County's Solid
Waste Facility.
Drainage: The proposed development will be required to meet all standards required by the
City of Okeechobee, the South Florida Water Management District and the Department of
Environmental Protection's NPDES program.

Traffic:
Ingress and egress are presently afforded via a driveway on NW 10 Avenue and a driveway
directly onto SR 70, although this latter driveway has been closed off with a chain, and, as we
understand it, has occasionally been used for access by the owner.
The current driveway on NW 10 Avenue will be moved northward to a point about 120 feet
north of the intersection of NW 10 Avenue and SR 70. The Applicant has submitted, as part of
the site plan package, a letter from FDOT outlining the conditions under which the FDOT will
allow the existing driveway on SR 70 to remain.
The Applicant submitted as part of its Special Exception Application an analysis of traffic
generation associated with the mix of proposed uses. The estimate was that average weekday
traffic could amount to 75 trips per day with the PM peak hour generation at only 5 trips. It was
determined that the proposed use would not have significant impact on the existing roadway
system and the Special Exception was approved on May 21, 2009 with no special conditions.

Other Requirements and Considerations:
Lighting Plan (Sec. 78 -71): The Applicant has not submitted a lighting plan for the parking
area. However, with only six parking spaces the parking lot is of minimal size and a formal
lighting plan may not be necessary, but the Applicant would still need to provide adequate
lighting for the area.
Dumpster Location: The proposed dumpster location is at the juncture of the property line and
the one -way drive exiting onto NW 10 Avenue. It is unclear how the dumpster would be
accessed by the collection vehicle unless the plan is for refuse to be in trash receptacles which
are collected and emptied manually.
Recommendations:
Staff recommends approval of the site plan review provided the highlighted deficiencies
are rectified or the TRC finds that:
1. The 10 -foot wide one -way driveway onto NW 10 Street is adequate;
2. No sidewalk is needed along NW 10 Avenue;
3. Adequate lighting of the vehicular use area is provided; and
4. The dumpster location is found to be safe and convenient for its intended purpose.
