Suarez for site plan review for a 12,000 square foot building on approximately 1.50 acre for lots 7 through 12 of Block 116, Okeechobee. This project is the second phase of Shoppes on the Boardwalk, 701 NE 3rd Street Senior Planner. IV. New Business Continued. Technical Review Committee October 15, 2009 Page 2 of 2 A. Banquet Hall 09 -005 TRC continued. Mr. Brisson presented the Staff Report stating several deficiencies and concerns with the application lacking the required information as requested to review the project. Administrator Whitehall addressed the applicant's engineer, Jeff Kennedy, explaining the petition was sorely short of required documentation to have a ruling on the site plan review. Mr. Brisson stated the parking was extremely inadequate for the proposed site, and DOT would have to be consulted regarding the intersection of NE 7th Avenue and SR 70, as was supplied in the traffic study presented for the first phase by the traffic analyst for the project. The application was postponed and no action was taken. B. Corey and Lauren Miller 09 -007 TRC. The application was submitted by Cass Long on behalf of property owners Corey and Lauren Miller for site plan review for a single family home being converted into an accounting office with parking to be developed in a single phase for property located at 110 SE 4th Street, Okeechobee, Florida Senior Planner. Mr. Brisson presented the Staff report of approval stating all requirements were met in the application, with the exception of a lighting plan and dumpster location. Determination to be made whether the applicant requires a dumpster or can use regular receptacle pick- up. Secretary's note: Spoke with the BTR Administrative Assistant, Waste Management requires the applicant to have a commercial account, and will be responsible for determining the type of receptacle required. Cass Long, Neal Long Construction representing the applicant agreed to provide a lighting plan, and inquired whether the sidewalk would be required, due to the elevation being so steep. Director Robertson said the area my need to be graded to allow for a lower slope. Ms. Cass stated the applicant will work with the City for the details for the sidewalk and will provide a lighting plan. The Committee stated a guard rail may be needed on SE 4th Street on the street side due to the grade. Director Robertson will check the FDOT book for regulations. The applicant was also instructed, the access to SW 2 Avenue in the sidewalk area will required to be concrete not asphalt. OUA is working with the applicant regarding the septic tank on the property and the sewer connection and there were no issues with Environmental Health. The Building Official instructed the applicant regarding parking and handicap markings, Police and Fire had no additional comments. Chief Davis made a motion to approve 09- 007 -TRC final site plan review for a single family home being converted into an accounting office with parking to be developed in a single phase for property located at 110 SE 4th Street, Okeechobee, FL; seconded by Chief Smith. Motion carried unanimously. The application was submitted by Lyndon Bonner on behalf of the property owners BOCC to close NW 7th Avenue from NW 4th Street to NW 6th Street and close NW 5th Street from NW 7th Avenue to dead -end, Okeechobee, Florida Senior Planner. Technical Review Committee September 17, 2009 Page 2 of 3 IV. New Business Continued. A. Street Closing Petition 09- 006 -TRC continued. Mr. Brisson addressed the Committee, stating he was very impressed with the reasons stated in the application for the street closing. Mr. Brisson further stated LaRue Planning Staff recommends approval. Mr. Jim Threewits, Deputy County Commissioner for Okeechobee County asked the Board whether they had any questions? Administrator Whitehall questioned the comments from Embarq. Mr. Threewits stated the comments of concem were addressing 4th, which is not part of the petition. OUA Nothing Health Not present. FC Accessibility to the proposed building? Mr. Threewits replied yes, on the East side. BO No comments. CE Always feel the City should not give away property, but this project is a benefit to the City as well as the County. PW No issues. PD No Issues. Chief Davis made a motion to recommend approval to the Planning Board for Street Closing Petition 09- 006 -TRC to close NW 7th Avenue from NW 4th Street to NW 6th Street, and close NW 5th Street to dead -end, seconded by; Chief Smith. Motion carried unanimously. B. Outdoor vehicle sales Lot 09 -007 TRC. The application was submitted by Linda L. Bridges for site plan review for outdoor vehicle sales lot located at 920 NW Park Street Senior Planner. Mr. Brisson presented the Staff report of approval with four issues needing to be addressed by the applicant. Mr. Brisson went on to state the development of the property is consistent with the surrounding commercial property with the exception of one lot that is zoned RMF. Traffic does not appear to be a problem. The issues are with the width of the drive through the property being shown as 10 feet which should at least be 12 feet, the placement of the dumpster, no sidewalk shown on 10th and no lighting plan was submitted. Mr. Larry Bennett of H.L. Bennet, of LaBelle, Florida addressed the Committee representing the applicant. Mr. Bennett stated all the issues would be addressed. Mrs. Linda Bridges, the applicant stated the business across the street had the same type dumpster placement. Mr. Whitehall replied that is a situation the City is trying to address. Mrs. Bridges also stated she was planning on putting a spot light on the pole by the dumpster. Mr. Brisson interjected, the applicant does not need to supply a lighting plan, but does have to comply with the code. Mr. Whitehall expressed concem regarding the spotlight and instructed the applicant to make sure this would cause no concem with the surrounding neighbors or drivers on SR 70. Mrs. Bridges stated the one -way, 10 foot driveway through the property was for safety and would provide for open space. Administrator Whitehall then asked for concerns from the Committee: OUA No issues. IV. New Business Continued. B. Outdoor vehicle sales Lot 09 -007 TRC continued. BO Drive needs to be at least 12 foot wide, and dumpster placement needs to be addressed, also the configuration off 10th is a little peculiar. Mr. Whitehall then interjected, the drive needs to be 20 foot wide with two lanes, and the dumpster needs to be relocated. The Building Official then addressed the residence, stating there needs to be firewalls and such. Mr. Bennett replied, yes. Mr. Schaub inquired of the applicant why the necessity for the residence? Mrs. Bridges replied that she lives in Ft. Lauderdale and when she comes to Okeechobee she wants a place to stay. Engineer Bermudez instructed Mrs. Bridges to check with the DMV when getting the license to sell cars to be sure that more than one business is allowed on the same property. Mr. Schaub inquired if Mrs. Bridges would be leasing the businesses? She replied, yes. Possibly having an office, when someone buys a car, they can get temporary tags. FD Really need 20 foot for the fire truck to maneuver through the property. Ten foot would be adequate as long as there was nothing on either side of the drive and the one oak tree that is on the property has to allow clearance of at least 13' 8" for the height of the truck. Administrator Whitehall said it was reasonable of the Committee to request the 20 foot, two -way drive though, this would improve everything all around. Mr. Bennett said one -way was preferable, but two -way would not be a problem either. The Fire Chief stated he has a problem with the gates on both ends of the drive, if the Fire Department should need to access the property, the gate(s) may be destroyed. CE Sidewalk along 10th a must. PW The swale may need to be graded to allow for the sidewalk, also concemed about first pipe off SR 70. Driveway should be widened and may need to extend drainage pipe North. PD Fence around the perimeter with locked gates at night is a concem. If the officers do not have access to patrol the lot, break -ins could be a problem. Also need adequate lighting. Chief Smith made a motion to approve final site plan review for outdoor vehicle sales, convert existing carport into vehicle sales office, (362 s.f.) remodel existing residence, (700 s.f.) for professional office and remaining, (600 s.f.) for single family dwelling unit for property located at 920 NW Park Street with the following contingencies: Lighting to be reviewed with the Planner and the Engineer, 2 lane drive through, at least 20 foot in width with adequate radius off NW 10th Avenue, sidewalk installed on NW 10th Avenue and relocation of the dumpster, seconded by Engineer Bermudez. An existing 1,859 square foot single family structure will be converted to office use. This property was the subject of an approval of a special exception for the banquet hall granted by the Board of Adjustment on February 19, 2009. That approval was given with the following conditions. 1. Evening and nighttime hours of operation are to be limited to midnight on weekdays and 2:00 AM on Saturday and Sunday. 2. Activities shall be undertaken entirely within the building. 3. Amplified music or the use of loudspeakers shall be prohibited. 4. The building shall be located between the parking area and Taylor Creek so as to minimize the potential nuisance impacts of vehicular lights and noise associated with attendees of functions. 5. Possible increased setbacks of the building and parking areas from residentially zoned properties to the north. 6. A revised traffic analysis should be submitted that uses a more appropriate land use category, such as a multi- purpose recreational facility or recreational community center, for determination of the traffic impact of this use. The subsequent traffic generation estimates, provided by the Applicant's Traffic Engineer for the entire Shoppes on the Boardwalk project, reflect this assumption. We find the explanation and rationale acceptable and concur with the use of a church for purposes of calculating traffic generation. Page 6 of the Traffic Analysis for Shovnes on the Boardwalk, dated December 12, 2008 contained the following summary of the intersection analyses: "The two intersections which would provide the primary access to the project were analyzed; SR -70/NE 7 Avenue and NE 7 Avenue 3 Street. Counts were made on November 6, 2008 and grown to 2010. The traffic volumes on SR -70 provide few gaps for vehicles to turn left from NE 7 Avenue. Therefore, the intersection would operate at level of service F. The analysis was re -run as a right -out only and reanalyzed. With the modification the intersection operates at level of service B and The final configuration at SR -70 and NE 7 Avenue will be determined in conjunction with the FDOT...." No other intersections were significantly affected. We agree with the above findings and suggest the following condition be attached to any approval of the site plan: The Applicant shall consult with FDOT on this matter in order to ascertain the adequacy of this two -way controlled stop sign intersection and the Applicant's possible cost sharing for any intersection modifications that may be necessary (e.g., signing/marking/directional median openings, etc.). Five spaces, (including one handicap space) are shown as back -out parking onto NE 3rd Street. Explanatory comments: This matter was discussed with the Applicant's representative during a conference call in early September. At that time the Applicant was advised that we would expect justification for the applicant's classification of the "banquet hall" as a private club. We suggested that it should be treated more like indoor recreation and expected that the parking requirement for the use would probably be about one space per 200 square feet of floor area. The Applicant has submitted no rational for using the parking requirement for a private club. Therefore we offer our explanation for the opinion that the use should be considered indoor recreation for the purposes of calculating required parking. The "banquet hall" does not meet the definition of a private club as set forth in Sec. 66.1, which reads as follows: "Private club means an establishment catering exclusively to an association of persons and their guests, which is not available for unrestricted public access, includes fraternal lodge, sorority, union hall." The primary distinction is that the "banquet hall" will not be available exclusively to persons of an association, etc. It is not similar to a fraternal lodge, sorority or union hall. Rather, it will be open to the general public for a variety of events and purposes, although the primary focus will be for weekend meetings, reception and parties. While the "banquet hall" does not also strictly meet the definition of indoor recreation in the LDC, we are of the opinion that this would be the most similar category upon which to base the need for off street parking. We have reviewed other codes and find that indoor recreation, meeting halls, exhibition halls without fixed seating may have parking requirements ranging from 6 to 12 spaces per 1,000 square feet. We believe that the five spaces per thousand square feet the City requires for indoor recreation uses is the absolute minimum that should be applied in this case. Applying this minimum requirement indicates that there should be at least 60 spaces devoted to the banquet hall, plus another six for the office use, for a total of 66 spaces. Staff Report Application No.: 09-005 -TRC Site Plan Review Applicant's Name: Jerry Suarez (Banquet Hall) Landscaping Total Site (Sec. 90 -532) Parking Vehicular Use Areas (Sec. 90 -533) Minimum of one tree and three shrubs per 3,000 square feet of lot area 22 trees and 65 shrubs. 46 spaces 18 sf /required space 828 sf landscaped area plus 1 tree/ 72 sf of required landscaped area 12 trees. One landscaped island (5' X 15') for each 10 spaces with a maximum of 12 uninterrupted spaces in a row =4.6. This is rounded up to 5 landscaped islands. Minimum dimension of landscaping is four feet, except adjacent to buildings. Minimum 2' landscaping between vehicular use areas and buildings 23 trees and about 150+ shrubs Although the site plan did not provide calculations of the square footage of landscaped area within the vehicular use areas, it is apparent that the area provided exceeds the minimum required. The Applicant is providing more than the minimum of five landscaped islands. All are of adequate size and contain a sufficient number of trees. All landscaped areas meet this requirement. Just two areas do not meet this requirement, those along the front and east sides of the "banquet hall" where only the sidewalk separates the build- ing from the vehicular use area. The requirement for the two feet of landscaping is intended to soften the appearance of the building. The landscaping can be located between the building and the sidewalk, or between the sidewalk and the parking areas. Staff Report Site Plan Review Landscaped Buffers (Sec. 90 535) Application No.: 09-005 -TRC Appllcant's Name: Jerry Suarez (Banquet Hall) 10' on street frontage; 2' along other property lines. Therefore, based on 464 feet of non driveway frontage along NE 3` Street and NE 7 Avenue and about 694 feet along the other property lines, there should be about 4,640 sf of landscaped area along the roadway frontage and about 1,328 sf along the balance of the peri- meter total of about 5,968,sf of buffer area. At 1 tree 3 shrubs /300 sf of required buffer 20 trees and 60 shrubs. Trees may be planted in clusters, but shall not exceed 50' on centers abutting the street. The only area along a street frontage that does not meet the minimum 10' landscape requirement is the easternmost end of the parking lot abutting NE 7` Avenue. Otherwise, there are over 8,000 square feet of landscaped area, 23 trees and almost 200 bushes meeting the location and spacing requirements. Other Requirements and Considerations: Sidewalks (Sec. 78 -36): No sidewalk is shown along the east side of NW 7 Avenue. Lighting Plan (Sec. 78 -71): No lighting plan has been submitted for the vehicular use area. Dumpster Location: The dumpster location shown on the site plan appears to be reasonably located. Elevations: No elevations have been provided. Special Exception Consideration: The Board of Adjustment and Appeals' approval of the special exception included recommendations addressing the following issues: 1. The building shall be located between the parking area and Taylor Creek so as to minimize the potential nuisance impacts vehicular lights and noise associated with attendees of functions. Possible increased setbacks of the building and parking areas from residentially zoned properties to the north. We believe the setbacks, as proposed are adequate for their intended purpose. 3. A revised traffic analysis should be submitted that uses a more appropriate land use category, such as a multi purpose recreational facility or recreational community center, for determination of the traffic impact of this use. The Applicant's Traffic Engineer has submitted information adequately establishing that for purposes of traffic generation, a church use is appropriate in this instance. Recommendation: Because parking is a critical component of any site plan and can have impacts on the location of structures, drainage, access and interior circulation and landscaping, Staff recommends that the Applicant return with a revised site plan that adequately addresses the need for parking for the banquet hall, and any attendant changes provision of adequate parking may have upon other aspects of the project. Specifically, we recommend the following conditions be included: 1. The site plan is revised to provide at least 66 spaces, 60 for the "banquet hall" and six for the office building, and parking is provided in such a manner that there is no back -out parking onto either NE 3 Street or NE 7th Avenue and the noted deficiencies in the plan pertaining to parking setbacks and minimum landscaping between the building and vehicular use areas be rectified. 2. The gazebo is set back the required minimum of 20 feet from the top of the bank of Taylor Creek. 3. Provision is made for a sidewalk along the east side of NE 7th Avenue if found to be necessary by the TRC. 4. A lighting plan meeting the City's requirements is submitted. 5. Elevations of the building(s) are submitted. 6. In accordance with the conditions set forth by the Board of Adjustment as follows: a.
