Dear Jack:
I have reviewed the January 10, 1994 correspondence to you from Mr.
John Drago. In our phone conversation of January 25, 1994, you
indicated that you had some concerns regarding some of the city's
perceptions of your valuation methods and techniques.
I have discussed your concerns with the County Administrator and
the County Attorney. We are all in agreement that you should
proceed as quickly as possible to complete the appraisal as
contracted. Your methods and techniques should be supported by
documented industry practices. The County is not qualified to
establish one valuation method as better than the next and we do
not desire to try.
This process was undertaken to acquire an independent, professional
appraisal of the water system. As you know the County provided a
list of three (3) highly qualified firms from which the City
selected your firm to conduct this appraisal. We have every
confidence that your efforts and final report will be the
professional product that was originally envisioned.

Greetings:
Attached please find the agreement between the parties to
abate this action for sixty days, which I understand must be signed
by all parties representatives by Friday, January 27, 1994, in
order to cancel the hearing set for February 1.
I believe this document is designed to reflect the sincere
efforts by all parties to attempt to settle this issues, and was
not drafted by the respective attorneys. Each attorney, I would
imagine, would prefer to pick this apart, read between the lines,
and try to figure ou° whaL nefarious scheme the other is up to,
depending on where a particular comma is located, etc. I have made
a couple of wording change, and further defined what utility work
would be suspended during the interim, with the goal to not gain
any advantage, or alter the work of the drafter of the agreement.
I arrived at this not by consulting outside counsel, but by talking
to the City engineer, Bill Reese. He states there are several
projects for which the contracts have already been awarded, that we
are not able to halt at this time. I do not have a list of those,
but can easily obtain it if you. desire. The other changes are
designed to give greater clarity, and should not be objectionable.
Please review and get with me no later than 3:00 p.m. today
for your input, as I would like this to go before the BOCC on
Thursday. I have authority from the Council for the Mayor to
execute the document without further meeting.
