1994/11/15 City & & SFWMD-Water Main Ext #C5060-Amend #2A ORIGINAL C-5060-A2 AMENDMENT NO. 2 TO THE COOPERATIVE AGREEMENT BETWEEN THE SOUTH FLORIDA WATER MANAGEMENT DISTRICT CITY OF OKEECHOBEE, FLORIDA This AMENDMENT NO. 2, entered into on ffv t~e fv% b err /-5-. l 4 9 5( , to that AGREEMENT dated December 22, 1993 as amended September 21, 19 49 between "the Parties," the South Florida Water Management District ("the DISTRICT"), and City of Okeechobee, Florida ( "the CITY"). WITNESSETH THAT: WHEREAS, the DISTRICT entered into a cost reimbursement relationship with the CITY to upgrade the DISTRICT'S existing potable water service at its Okeechobee Field Station by means of extension of the CITY'S water main to the Station; and WHEREAS, the AGREEMENT may be amended with the prior written approval of the parties; and WHEREAS, the CITY incurred an additional unanticipated increase in scope of work for the water line; and WHEREAS, the parties wish to amend the AGREEMENT in order to increase funding of the AGREEMENT to provide for the difference in construction costs; NOW THEREFORE, the DISTRICT and the CITY, in consideration of the mutual benefits flowing from each to the other, do hereby agree as follows: 1. The CITY shall, to the satisfaction of the DISTRICT, fully and timely perform all work items described in Exhibit "A-2" attached hereto and made a part of this AMENDMENT NO. 2. Amendment No. 2 to Contract No. C-5060 - Page 1 of 2 q. 2. The monetary consideration for the construction portion of the costs under the AGREEMENT is hereby increased by an amount not to exceed Six Thousand Two Hundred Forty Two Dollars and No Cents ($6,242.00), for a total AGREEMENT amount not to exceed One Hundred Seventy One Thousand Two Hundred Sixty One and Seventy Five Cents ($171,261.75.) 3. This AMENDMENT NO. 1 shall be effective upon the date of execution. The AGREEMENT'S termination date shall be extended twenty one (21) days from January 1, 1995 and as amended, shall terminate January 22, 1995. 4. The Project Manager for the DISTRICT is now Mr. Alex Garcia, telephone (407) 687-6186. The parties shall direct all matters arising in connection with the performance of this AGREEMENT, other than invoices and notices, to the attention of the Project Managers for attempted resolution or action. 5. All other terms and conditions of the AGREEMENT remain unchanged.
