Dear Mr. Creel: October 20, 1993 On October 8, 1993, a notice of proposed rulemaking appeared in the Florida Administrative Weekly, Vol. 19, No. 40 at pages 5610 -5638. The notice states that the South Florida Water Management District proposes to adopt or amend District rules including Rules 40E- 2.091, 40E- 2.301, 40E -2.331 and 40E- 2.381, Florida Administrative Code. The notice states that a hearing will be held on the proposed rules on November 10, 1993. The notice further states that the person to be contacted regarding the proposed rules and economic impact statement is Jim Drosakis. Beginning at page 5612 of the notice, the District has published notice of its intent to amend or substantially reword the Basis of Review for Water Use Permit Applications within the South Florida Water Management District ("Basis of Review"), a document which is incorporated by reference in Rules 40E- 2.091, 40E- 2.301, 40E -2.331 and 40E- 2.381. Pursuant to Section 120.54(1)(c), Florida Statutes (1992), the City of Okeechobee, a body corporate and politic, requests the South Florida Water Management District to prepare an economic impact statement for proposed rules 40E- 2.091, 40E- 2.301, 40E- 2.331 and 40E- 2.381, Florida Administrative Code, including the proposed amendment or substantial rewording of the Basis of Review, that meets the criteria of Section 120.54(2)(c), Florida Statutes (1992). Creel October 20, 1993 Page Two of Two The City would also like to request that a draft copy of the economic impact statement be made available to the City at least 14 days prior to the scheduled public hearing. In the event that the District has already received a written request to prepare such an economic impact statement, or if the District has already prepared the draft of such an economic impact statement, by a copy of this letter to Mr. Drosakis, the City is requesting that it be provided a copy of that economic statement as is required by subparagraph 120.54(2)(b)2, Florida Statutes (1992).
