0706 Rescinding Ord. 251 & Opening Street N ry .-e 2R0403 rik;E1029 ORDINANCE NO. 706 AN ORDINANCE OF THE CITY OF OKEECHOBEE, FLORIDA RESCINDING ORDINANCE NO. 251; WHICH ORDINANCE INCORRECTLY CLOSED A CITY STREET OR RIGHT OF WAY DESCRIBED AS THAT PORTION OF KISSIMMEE AVENUE BETWEEN NINTH AND TENTH STREETS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Okeechobee on August 4, 1952 enacted Ordinance No. 251 in order to close the street or right of way between those blocks then known as the "football field WHEREAS, the legal description in said ordinance was incorrect, and purported to close the street through the football field, but actually closed a street in the block immediately to the South of the old football field, (now known as S.W. 2nd Avenue between S.W. 16th and 17th Streets); WHEREAS, the City has recognized that this ordinance is incorrect, and although the street in said ordinance has remained opened for public use since 1952, it is necessary to correct this error; NOW THEREFORE, the City Council by majority vote of those present has voted to rescind said Ordinance No. 251; and BE IT ORDAINED by the City Council of the City of Okeechobee, Florida that Ordinance 251 originally adopted on August 4, 1952 is hereby rescinded in its entirety, and is of No force and effect within the City of Okeechobee, Florida.
