0654 Alcohol Sales Hours ORDINANCE NO. 654 S AN ORDINANCE OF THE CITY OF OKEECHOBEE, FLORIDA, DELETING SECTION 3 -2 OF THE CODE OF ORDINANCES PERTAINING TO THE HOURS OF SALE OF ALCOHOLIC BEVERAGES; AND ENACTING A REVISED SECTION REGULATING THE HOURS OF SALE OF ALCOHOLIC BEVERAGES WITHIN THE CITY OF OKEECHOBEE; PROVIDING AN EFFECTIVE DATE. WHEREAS, the hours of operation for establishments engaged in the sale of alcohol has been recently amended in the unincorporated area of Okeechobee County, by ordinance passed by the County Commission to allow extended hours of operation on certain days of each year; and WHEREAS, the difference in hours of operation between the county and the City has proved to cause diminished sales and profit for local business' located within the City limits of Okeechobee, Florida, and in fairness the hours of operation within the City should be amended to place local business' on equal footing with the establishments located in the County; it therefore RESOLVED AND ADOPTED that section 3 -2 of the Code of Ordinances for the City of Okeechobee is herewith deleted in its entirety, and in it place and stead the following section is approved by the City Council: Sec. 3 -2. Hours; Sunday Sales. (a) Other than beer and wine. Except as otherwise provided herein, it shall be unlawful for any person holding an alcoholic beverage license from the State to sell, or cause to be sold, or to permit the sale of any alcoholic beverage except beer and wine between 12 :00 midnight Saturday and 7:00 a.m. Monday. (b) Beer and Wine. Except as otherwise provided herein, it shall be unlawful for any person holding an alcoholic beverage license from the State to sell or cause to be sold, or to permit the sale of beer or wine between 12 :00 midnight Saturday, and 1:00 p.m. Sunday. (c) Exceptions permitted. Any person holding an alcoholic beverage license from the State may sell any lawful alcoholic beverage until the hour of 2 :00 a.m. on certain selected days during the year in the following manner. (i) The license holder may select up to a total of ten (10) of any days during each calendar year, either consecutive or randomly spaced, in which to sell alcoholic beverages, on the date selected, until 2:00 a.m. the following day. For the remainder of 1992, the total number of days selected cannot exceed four (4); thereafter, a total of up to ten (10) days each year. (ii) In order to lawfully use this exception, the license holder must notify the City of Okeechobee license and business regulation office in General Services, as well as the City Police Department, in writing at least seven (7) days in advance of any day so selected, in order to arrange sufficient police and fire protection. Upon timely receipt of the notice, the City will furnish a permit allowing the hours of extended operation by the establishment for the day(s) selected. The Department of General Nwor Services shall charge and collect a processing fee of $10.00 (ten dollars and no cents) for each date selected.
