0713 Rezoning• ORDINANCE No. 713 AN ORDINANCE OF THE CITY OF OKEECHOBEE, FLORIDA REGARDING THE REZONING OF "UNPLATTED LANDS IN THE CITY ", AMENDING THE OFFICIAL ZONING MAP OF OKEECHOBEE BY REZONING A CERTAIN TRACT OF LAND MORE PARTICULARLY DESCRIBED HEREIN, FROM OKEECHOBEE COUNTY COMMERCIAL TO CITY OF OKEECHOBEE COMMERCIAL (C, COMMERCIAL), AMENDING THE ZONING MAP ACCORDINGLY, PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Okeechobee, Florida has adopted Ordinance Number: 402 in which a revised Official Zoning Map was adopted for said City; and WHEREAS, the owner of the property more particularly described hereafter, has heretofore filed a petition pursuant to the Land Development Regulations of the City of Okeechobee for the purpose of rezoning a certain tract of land consisting of 25.15 acre(s), said land being more particularly described hereinafter, from Okeechobee County Commercial to City of Okeechobee Commercial (C, Commercial), which requests that this 25.15 acre(s) tract be removed from the boundaries of the above mentioned zones to allow for the processing of the rezoning application; and WHEREAS, the City Council finds such rezoning consistent with the City's Comprehensive Plan and deems it in the best interest of the inhabitants of said City to amend aforesaid revised zoning map as hereinafter set forth: Now THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OKEECHOBEE, FLORIDA THAT: Section 1. The following described land, located in the City of Okeechobee, to -wit: See attached Exhibit "A ". Section 2. That the aforesaid Revised Zoning Map of the City shall be amended accordingly. Section 3. All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 4. If any provision or portion of this ordinance is declared by any court of competent jurisdiction to be void, unconstitutional, or unenforceable, then all remaining provisions and portions of this ordinance shall remain in full force and effect. Council Member Watford stated this was the same parcel of property, (as agenda Item VII A 1.a), and that the Planning Board recommended approval of this zoning ordinance. Mayor Kirk closed the Public Hearing at 6:12 p.m. Attorney Cook explained that he received a letter from Attorney Becht dated June 29, 1998 on behalf of the Village Square Restaurant, Inc., the tenant at 301 West South Park Street stated the agreement the City prepared is acceptable with a minor amendment, Mr. Brown is not associated with the restaurant operation and should not be a named party to it The corrections have been made and once the City approves it he will forward it to Attorney Becht for Mrs Janice Brown's signature. The agreement states Mrs. Brown is: "granted a license for full and free light and liberty to erect and maintain an exterior illuminated sign advertising the business of Village Square Restaurant at the location of 301 West South Park Street, Okeechobee Florida, as such sign presently exists ". In retum for the mutual agreements herein, the City and Mrs. Brown agree to forgo any further claim or demand against the other in this dispute involving the sign, and release each other from any such claim, except as specifically set forth herein. In return for the City's grant of license to Mrs. Brown to continue the use of the present sign, Mrs. Brown stipulates and agrees, jointly and severally, that this license as granted unto Mrs. Brown for the sign, shall be confined solely to the present owners of Village Square Restaurant Inc., as the signs present location and the license and rights granted herein for the continued placement and display of the sign shall not be assignable, and shall terminate upon the occurrence of the following events, which ever shall first occur: AGENDA VI. Mayor Kirk dosed the Public Hearing at 6:26 p.m. Mr. Steve Sobieralski, Architect of Genesis Group, for the Community Development Block Grant, Downtown Redevelopment Streetscape rendered drawings of the proposed landscaping and light poles in the front of the buildings along South Park Street. He also showed pictures of a completed Streetscape from downtown Sarasota with tree's in the sidewalks. The tree's will be eighteen inches from curb to center in a three x three foot square area. The trees may have to be juggled for visual purposes next to the stop sign at Okeechobee Hardware. The contract is to take approximately six months, the contractor hopes to push it to four months. Council Member Watford commented on his recent tip through downtown Orlando and their street scape. He was against the tree's in the sidewalks until he could actually see how nice it actually looks. Applicant is Wal -Mart Stores East, Inc. request to rezone 25.15 unplatted acres located along the East side of South Parrott Avenue from County Commercial to City Commercial to allow for a Wal -Mart Super Store - Planning consultant (Exhibit 1). MAY 5, 1998 - PLANNING BOARD /BOARD OF ADJUSTMENT - PAGE 2 OF 4 ACTION DISCUSSION V Petition No. 98 -001 -R was completed by Wal -Mart Stores East, Inc. The request is to rezone 25.15 unplatted acres of land recently annexed into the City from County Commercial to City Commercial. The property will be used to develop a Wal -Mart Super Store. Staff has concluded that the proposed change is not contrary to the established land use pattern; it would not create an isolated district unrelated to adjacent and nearby districts, and allows development of an existing 6.76 acres which has been undeveloped along South Parrott Avenue. It would not materially alter the population density pattern and thereby increase or overtax the load on public facilities such as schools, utilities, streets, etc. The existing district boundaries are not illogically drawn in relation to existing conditions. It is consistent with the Comprehensive Plan. It will not create or excessively increase traffic congestion or otherwise affect public safety; will not create a drainage problem, the site will be developed with a retention pond to capture storm water runoff; will not seriously reduce light and air to adjacent areas; will not adversely affect property values in the adjacent area nor will it be a deterrent to the improvement or development of adjacent property in accord with existing regulations. Does not constitute a grant of special privilege to an individual owner as contrasted with the public welfare. The annexation requires that the existing County Zoning be changed to City classification, so the rezoning is necessary. It is not out of scale with the needs of the City and it is proper to allow the future development as proposed. Based on the above zoning criteria being met, the rezoning request is recommended by Staff to be approved Board Member Oliver moved that Petition No. 98 -001 -R is consistent with the Comprehensive Plan and recommended approval, reduce to ordinance form and present to the City Council; seconded by Board Member Markham. Susan Motley, Agent Legal Description of Subject Property: Item before the Council: EXHIBIT 1 - PLANNING BOARD MAY 5 AGENDA The real property located on the east side of State Road 15, (US 441), and begin in Sections 27 and 28, Township 37 South, Range 35 East, Okeechobee County Florida, consisting of approximately 25.15 acres and, more particularly described in "Exhibit A." The matter for consideration by the City Council, acting as the Land Planning Agency for the City of Okeechobee, is an application by Wal Mart Stores East, Inc., and Susan Motley, agent, petition number 98- 001 -R, with the mailing address being 2100 East Parrott Avenue, Okeechobee, Florida 34973, for a change in zoning from Okeechobee County "Commercial" to City of Okeechobee "Commercial ". Background: The subject property is approximately 31.91 acres of which 25.15 acres are subject to this zoning petition. Consistency with Land Development Regulations: The applicant intends to develop the property as Wal Mart Super Store. This development will have public utilities. Adjoining property uses are as follows: South: Commercial North: Unplatted Agricultural West: Commercial East: Unplatted Agricultural When recommending whether to rezone a classification of land, the factors that the Planning Board shall consider include, where applicable, whether or not: 1. The Proposed Change Is Contrary to the Established Land Use Pattern. The established land use pattern in this area includes primarily commercial uses. As such, the proposed change is compatible with the established land use pattern. Staff Report Petition No. 98 -001 -R 2. The Proposed Change Would Create an Isolated District Unrelated to Adjacent and Nearby Districts. The Commercial Zoning District would not create an isolated situation, but would be consistent with the surrounding urban environment. Additionally, it would allow development of the existing 6.76 acres which lies along US 441. 3. Existing District Boundaries Are Illogically Drawn in Relation to Existing Conditions on the Property Proposed for Change. The existing district boundaries are illogically not drawn, and the zoning change would allow consistency with adjacent land uses. 4. The Proposed Change Would Be Contrary to the Proposed Land Use Plan and Would Have an Adverse Effect on the Comprehensive Plan. The proposed change would be consistent with the City's Future Land Use Map and various Land Use policies regarding commercial development. The plurality of uses along US 441 is commercial with a mixture of multi- family. With the proposed development, this would maintain the this compatibility along the City's major arterial road. Furthermore, the County's Future Land Use category was Commercial so there would be no inconsistency in Commercial Zoning even if it had remained with the County. 5. Changed or Changing Conditions Make the Passage of the Proposed Amendment Necessary. This zoning request is consistent with the Comprehensive Plan's pattern of future growth for commercial development along the City's arterial roads. Development along Parrot Avenue (US 441) is primarily commercial in nature. The proposed super store will be in place with the land use pattern and character of the area. Furthermore, development of this type could only occur along a roadway like US 441. Staff Report Petition No. 98 -0O1 -R 6. The Proposed Change Will Create or Excessively Increase Traffic Congestion or Otherwise Affect Public Safety. The proposed change will not create excessive traffic congestion or otherwise affect the public safety. Additionally, US 441 was constructed to accommodate heavy traffic. The proposed change and subsequent uses on the property will be designed to allow proper ingress and egress onto US 441. 7. The Proposed Change Will/Will Not Create a Drainage Problem. The proposed zoning change and subsequent development will not create a drainage problem. As a result of the impervious surface contemplated, the site will be developed with a retention pond to capture stormwater runoff. 8. The Proposed Change Will Seriously Reduce Light and Air to Adjacent Areas. Required buffering will act to minimize any perceived loss of open space to adjacent areas. As such, there will be no loss of light and air. 9. The Proposed Change Will Adversely Affect Property Values in the Adjacent Area. The proposed change will not adversely affect property values in the area. In fact, it is expected that commercial development along Parrot Avenue will continue to increase and that surrounding properties will increase in value as a result of the multiplier effect. 10. The Proposed Change Will Be a Deterrent to the Improvement or Developed of Adjacent Property in Accord with Existing Regulations. Since much of the adjacent property is zoned Commercial, there will be no negative impact on the development of adjacent properties. The Proposed Change Will Constitute a Grant of Special Privilege to an Individual Owner as Contrasted with the Public Welfare. The proposed change will not grant a special privilege to an individual owner as contrasted with the public welfare. The size of the proposed change along with the existing site plan regulations can ensure that the public welfare is not diminished. 12. There Are Substantial Reasons Why the Property Cannot Be Used in Accord with Existing Zoning. The annexation requires that the existing County Zoning be changed to a City classification. Both are Commercial, so compatibility is met. 13. Whether the Change Suggested Is out of Scale with the Needs of the Neighborhood or the City. The proposed change is not out of scale with the needs of the City. 14. It Is Impossible to Find Other Adequate Sites in the City for the Proposed Use in Districts Already Permitting Such Use. The proposed change is proper to allow the future development as requested. While there are other sites along US 441 that could be used, it is the applicants request to atmex into the City. Furthermore, the proposed site is the only large unplatted parcel in the City that could accommodate the proposed development. The subject property will be designated Commercial on the adopted City of Okeechobee Future Land Use Map. As such, the proposed use is consistent with the Comprehensive Plan. Based upon the above zoning criteria being met, the rezoning request should be recommended as it is consistent with the existing Comprehensive Plan. City of Okeechobee Ordinance 402 outlines sixteen factors that must be considered when recommending whether to rezone a particular tract of land. In response to these sixteen items is as follows: 1. The proposed change is contrary to the established land use pattern. The proposed change is not contrary to the established land use pattern. It is compatible with properties immediately adjacent and across US 441. The property has recently been annexed into the City of Okeechobee from Okeechobee County where it held a Commercial Zoning designation. This request is merely a formality due to the annexation. 2. The proposed change would create an isolated district unrelated to adjacent and nearby districts. This application does not create an isolated district. It is adjacent to significant amounts of commercially zoned properly. 3. The proposed change would materially alter the population density pattern and thereby increase or overtax the load on public facilities such as schools, utilities, streets, etc. The proposal is not population generating, thereby having no effect on schools. As far as we are aware, existing boundaries have not been illogically drawn - this request is merely a formality in completing the annexation process. 5. The proposed change would be contrary to the Proposed Land Use Plan and would have an adverse effect on the Comprehensive Plan. The proposed change is not contrary to the Proposed Land Use Plan. A concurrent Land Use Plan Amendment is being processed in keeping with the requirements of annexation. 6. Changed or changing conditions make the passage of the proposed amendment necessary. The change here is the fact that the property has recently been annexed by the City. 7. The proposed change will adversely influence living conditions in the neighborhood. Significant residential development does not exist in the vicinity of the project. 8. The proposed change will create or excessively increase traffic congestion or otherwise affect public safety. Items such as traffic capacity, police, and fire protection have been reviewed at many points in the site plan approval and annexation process. These facilities and services are adequate to support the project. 9. The proposed change will create a drainage problem. The project meets the requirements of the South Florida Water Management District and City of Okeechobee stormwater management requirements. 10. The proposed change will seriously reduce light and air to adjacent areas. The project includes an adequate amount of open space to not affect light and air to adjacent areas. 11. The proposed change will adversely affect property values in the adjacent area. It is our contention that this project will actually enhance commercial values in the immediate vicinity. 12. The proposed change will be a deterrent to the improvement or development of adjacent property in accord with existing regulations. Ms. Bonnie S. The favorable market impact this project is anticipated to bring should enhance the opportunities for surrounding properties to improve or develop. 13. The proposed change will constitute a grant of special privilege to an individual owner as contrasted with the public welfare. Special privilege will not be granted to this applicant. The request has been necessitated by the annexation, and it is the City's desire to include this property within it's corporate boundaries. 14. There are substantial reasons why the property cannot be used in accordance with existing zoning. Prior to the annexation, the property held a commercial land use and zoning designation and could be used for the same use as proposed within the City. 15. Whether the change suggested is out of scale with the needs of the neighborhood or the City. The proposed change is not out of scale with the needs of the City. Commercial zoning depths are consistent with this parcel in other areas along US 441. 16. It is impossible to find other adequate sites in the City for the proposed use in districts already permitting such use. Finding a site that is appropriately located and of adequate size in the City is difficult. The City has determined that there is value in annexing this parcel; it's compatibility with the City's Comprehensive Land Use plan and zoning patterns were considered when the annexation was reviewed and approved.
