1047 Street ClosingWHEREAS,. the City has received a Street Closing Application (No. 09- 001 -SC) from
property owner(s) Keith and Genia Arbogast, for the closing of a certain right -of -way
as described in this ordinance to access their property and develop a driveway; and
WHEREAS, a review of such application at duly advertised meetings by the Technical
Review Committee held on June 18, 2009, and the City Planning Board held on July
16, 2009, and submitted by Staff Report, reveals that it is in the best interest of the
citizens of the City of Okeechobee as a whole to grant said application; and
WHEREAS, the granting of the application will serve a legitimate public interest and is a
proper exercise of the municipal authority of the City of Okeechobee as a
discretionary function;
NOW, THEREFORE, BE IT ORDAINED by the City Council for the City of Okeechobee,
Florida; presented at a duly advertised public meeting; and passed by majority vote
of the City Council; and properly executed by the Mayor or designee, as Chief
Presiding Officer for the City:
Section One. The right -of -way described hereafter is hereby closed, vacated and
abandoned by the City of Okeechobee, Florida to -wit:
THAT PORTION OF SOUTHWEST 15 STREET, FROM SOUTHWEST 3
AVENUE WESTERLY TO THE DEAD -END AS SITUATED BETWEEN
BLOCKS 25 AND 26, SOUTH OKEECHOBEE SUBDIVISION,
ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK
5, PAGE 7, OF THE PUBLIC RECORDS FOR OKEECHOBEE COUNTY,
FLORI DA.

AN ORDINANCE CLOSING, VACATING AND ABANDONING A PORTION
OF SOUTHWEST 15 STREET, FROM SOUTHWEST 3 AVENUE
WESTWARD TO THE DEAD -END, AS DESCRIBED HEREIN; RESERVING
UNTO THE CITY ITS SUCCESSORS AND ASSIGNS, A NONEXCLUSIVE
EASEMENT FOR PUBLIC UTILITIES PURPOSES; AND DIRECTING THE
CITY CLERK TO RECORD THE ORDINANCE IN THE PUBLIC RECORDS
OF THE CLERK OF THE CIRCUIT COURT IN AND FOR OKEECHOBEE
COUNTY, FLORIDA; PROVIDING FOR AN EFFECTIVE DATE.
The City of Okeechobee, Florida hereby reserves unto itself, its
successors or assigns, a perpetual non exclusive easement on the
North 40 feet of said Southwest 15 Street for public utility purposes,
in, over or under the right -of -way as described herein from Southwest

Following is the Staff analysis of the request's consistency with the various require-
ments for vacating public rights -of -way.
Section 78 -33 of the Land Development Regulations requires the reviewing bodies to
find that an application for vacating rights -of -way meets the following requirements.
1. Proposed vacation is consistent with the Comprehensive Plan.
The properties to the immediate north, south, and west, which are the most affected
by the proposed vacation, are all designated Single - Family on the Future Land Use
Map (FLUM) and are occupied by single - family structures. As such, the conversion
of the right -of -way to a driveway serving a single - family use would be considered
consistent with the Comprehensive Plan.
2. Right -of -way to be vacated is not the sole access to any property and the remaining
access is not an easement.
All properties abutting the right -of -way to be vacated have access via another public
street.
