0501 Water and SewageORDINANCE NO. 501 AN ORDINANCE AMENDING THE ORDINANCE CODE OF THE CITY OF OKEECHOBEE, FLORIDA; AMENDING CHAPTER 18, ARTICLE II, SECTION 18-16 TO ALLOW • DEVELOPERS WITH THE APPROVAL OF THE CITY TO MAKE WATER CONNECTIONS WITHIN A DEVELOPMENT; AMENDING SECTION 18-17 TO PROVIDE INSPECTION FEES AND METER INSTALLATION FEES WHERE DEVELOPERS HAVE INSTALLED MAIN WATER LINES AND APPURTENANCES WITHIN A DEVELOPMENT; AMENDING CHAPTER 18, ARTICLE III, SECTION 18-43 TO ALLOW A DEVELOPER TO MAKE SEWER CONNECTIONS WHEN THE DEVELOPER HAS INSTALLED THE MAIN SEWER LINE WITHIN A DEVELOPMENT; AMENDING SECTION 18-43 PROVIDING ONE SEWER CONNECTION FOR GROUP HOMES, TOWN HOUSES AND OTHER BUILDINGS GROUPED CLOSE TOGETHER; AMENDING SECTION 18-48 TO PROVIDE INSPECTION FEES WHERE A DEVELOPER HAS INSTALLED THE MAIN AND LATERAL SERVICE LINES; PROVIDING AN EFFECTIVE DATE. RE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OKEECHOBEE, FLORIDA as follows: SECTION I: Chapter 18, Article II, Sections 18-16 and 18-17 are hereby amended to read as follows: CHAPTER 18 ARTICLE II Section 18-16. The city to make connections, supply materials; authorizes developer to make water connections. The city shall make all water connections to the meter and/or meter box and shall furnish the pipe, saddle, tail pieces, meter, meter box and all other materials required for the completion of said connection. A developer, upon approval of the city, may make the water connections within the development and shall furnish the pipe, saddle, tail pieces, meter, meter box and all other materials required for the completion of said connection. All materials purchased shall be in accordance with the city's specifications and all labor costs shall be born by the contractor Once the installation is complete the meter purchased by the developer shall be delivered to the City Department of Public Works for installation at which time an inspection and installation fee shall be due and payable in accordance with the fees provided in Section 18-17 herein. Section 18-17. Connection fees and inspection fees. Building Sewers and Connections. (a) Connections by authorized persons only. No unauthorized person shall uncover, • make any connections with or openings into, use, alter or disturb any public sewer or appurtenances thereof. All connections to the public sewer shall be performed by the city. (b) Costs borne by owner, liability of city. All costs and expense incident to the installation and connection of the building sewer shall be borne by the owner. The owner shall indemnify the City of Okeechobee from any loss or damage that may directly of indirectly.be occasioned by the installation of the building sewer . (c) Separate sewer required for each building; exception. A separate and independent sewer shall be provided for every building except where one building has multiple offices of dwellings or where there exists a group of buildings or town houses that are grouped in such a way that one separate and independent sewer could more efficiently serve the structures, however all fees and monthly charges shall be billed and collected on a per unit basis as if each unit or dwelling had its own separate sewer connection. (d) Old building sewers. Old building sewers may be used in connection with new buildings only when they are found, on examination and test by the building official, to meet all requirements of this chapter. (e) Specifications. The size, slope, alignment, materials of construction of a building sewer and the methods to be used in excavating, placing of the pipe, jointing, testing and backfilling the trench within the 201 facilities planning area, shall all conform to the requirements of the building and plumbing code or other applicable rules and regulations of the City of Okeechobee. (f) Elevation of connection; lift systems. whenever possible, the building sewer shall be brought to the building at an elevation below any basement floor. In all buildings in which any building drain is too low to permit gravity flow to the public sewer, sanitary sewage carried by such building drain shall be lifted by an approved means and discharged to the building sewer. (g) Prohibited connections. No person shall make connection of roof downspouts, exterior foundation drains, areaway drains or other sources of surface runoff or groundwater to a building sewer or building drain which in turn is connected directly or indirectly to a public sanitary sewer. (h) Conformation with building, plumbing codes, other regulations. The connection of the building sewer into the public sewer within the 201 facilities planning area, shall conform to the requirements of the building and plumbing code or other applicable rules and regulations of the City of Okeechobee. All such connections shall be made gastight and watertight. Any deviation from the prescribed procedures and materials must be approved by the building official before installation. (i) Inspections. The applicant for the sewer permit shall notify the building official when the building sewer is ready for inspection and connection to the sanitary sewer. The connection shall be made under the inspection and approval of the building official or his representative. (j) Barricades and lights for excavations; restoration of property. All excava- tions for building sewer installation shall be adequately guarded with barricades and lights so as to protect the public from hazard. Streets, sidewalks, park- ways and other public property disturbed in the course of the work shall be restored in a manner satisfactory to the City and County of Okeechobee. Section 18-48. Connection. Fees and Inspection Fees. (a) Established. There are hereby established sanitary sewer connection fees,and sanitary sewer inspection fees, sanitary sewer user fees and sanitary sewer . system capacity charges to provide revenue for the payment of operation and maintenance expenses for the plant and the collection system, to provide revenues for the payment of principal and interest on monies borrowed to construct the system and revenues for routine renewal, replacement and expansion. LID", no I -3- (b) Use of funds. Funds derived shall be used as provide by law. (c) Schedules. • (1) Sanitary sewer connection fees. A connection and tappage fee for connection to the area-wide sewer system and the system capacity charges provided in section 18-49 shall be paid to the finance department at the time of application for a sewer connection. The connection and tappage fee shall be applicable to 201 facilities planning area as follows: Inside City Outside City a. Residential sewer customers $325.00 $406.25 b. All other sewer customers: Four-inch service $325.00 $406.25 Six-inch service $425.00 $531.25 C. Where a developer has installed the main sewer lines and provided the service lines to the property line, includin the pipe and saddle and the necessary fittings, all in accordance with city specifications and at no cost to the city, the connection fees shall no longer be required but an inspection fee shall be charged as follows: Inside City Outside City Residential inspection fee $8.00 $10.00 All other inspection fees $8.00 $10.00 (2) Sanitary sewer user fees. The fees established herein for use, or availability for use, of the area-wide wastewater treatment system shall be payable by each and every dwelling unit, business establishment, chrrch, hospital and every other type of private or public building, structure or activity providing sewage and/or waste. a Dwelling unit: A house, apartment, group of rooms or a single room occupied or intended for occupancy as separate living quarters. Separate living quarters are those in which the occupants do not live and eat with any other persons in the structure, and which quarters have either: (i) direct access from the outside of the building or through a common hall; or (ii) complete kitchen facilities for the exclusive use of the occupants. b. Multiple dwellings: Structures occupied or intended for use as living quarters, containing more than one dwelling unit, not to include hotels, motels or similar living quarters which do not contain dwelling units as defined herein. C. Residences: Structures occupied or intended for use as single-family living quarters, containing no more than one dwelling unit. d. All others: Structures occupied or intended for use as a business establish- ment, church, hospital and all other types not classified as a dwelling unit or residence. (d) Sewer use fees. Sewer use fees for the incorporated sections of the 201 facilities planning area shall be based on volume of water used each month through the water meter at the rates set forth below. (1) Sewer rates. Each customer connected to the city's sewer system shall be billed at the rate of two dollars and forty nine cents ($2.49) per one thousand (1,000) gallons. (2) Customers without water meter service. In the event a sewer customer, (building or premises) is discharging sewage, water or other liquid wastes into the city's sewer facilities and using water supplied on other than a metered basis from a private water supply then in each such case the owner shall be required by the city to cause a water meter or other measuring device to be installed acceptable to the city, and the quantity of water used as measured by such meter shall serve as a basis for determining the sewer charge, and pending installation of such meter, rates and charges shall be based upon an estimated quantity of water used. (e) Applicability. Rates and charges provided for in this section shall not apply to water billings for such meters as have been determined by the city to have • no relationship to the use of the area-wide sanitary sewer system. (f) Unincorporated areas of 201 facilities planning area. Sanitary sewer use rates for the unicorporated areas of the 201 facilities planning area: One and one- quarter (11) times the rate set forth in subsection 18-48(d) above. &dL r) 0 Ka ~(O -4- (g) Billing. The users of the POTW and the sewage collection system within the 201 facilities planning area shall be billed monthly. (h) System capacity charge. A system capacity charge shall be paid by all new customers of the City of Okeechobee sanitary sewer system in the following amounts: Inside City (1) Residential customers with 518 by 314 inch meter $400.00 (2) Residential customers with one-inch water meter ......................................$1,000.00 (3) All other sewer customers: a. Minimum system capacity charge $300.00 b. For sewer discharge flows exceeding 200 gallons per day, per gallon $1.50 SECTION III: This ordinance shall take effect as provided by law.
