0513 Water and Sewage DisposalORDINANCE NO. 513 AN ORDINANCE AMENDING THE ORDINANCE CODE OF THE CITY OF OKEECHOBEE: AMENDING CHAPTER.18, ARTICLE III, SECTION 18 -48, SUBPARAGRAPH (a) TO PROVIDE FOR THE ESTABLISHMENT • OF FEES AND CREATION OF A SANITARY SEWER SYSTEM TRUST FUND; PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OKEECHOBEE, FLORIDA AS FOLLOWS: SECTION I: CHAPTER 18, ARTICLE III, Section 18-48, subparagraph (a) is hereby amended as follows: CHAPTER 18 WATER, SEWERS AND SEWAGE DISPOSAL ARTICLE III. SEWERS AND SEWAGE DISPOSAL Section 18-48 Fees: (a) Established. There is hereby established sanitary sewer conn- ection fees, sanitary sewer user fees, and sanitary sewer system capa- city charges, and a sanitary sewer system trust fund to provide reve- nue for the payment of operation and maintenance expense for the plant and the collection system, to provide revenues for the payment of prin- cipal and interest on monies borrowed to construct the system and reve- nues for routine renewal, replacement and expansion and enlargement. (1) Where is hereby created a special trust fund to be known as the Sanitary Sewer System trust fund into which fund is to be deposited all monies raised as a result of the charges made in connection with Section 18-48 subparagraph (h) here- in, these funds are to be used only for the purpose of ex- pansion and enlargement of the city's treatment plant and collection system as authorized by a majority vote of the Okeechobee City Council. These funds may be invested as other funds of the City and may be comingled in order to ob- tain the maximum amount of interest provided, however, sep- arate books of accounts shall be established to precisely identify the funds of this trust account. The interest accruing from the investment of these funds shall accrue to the trust fund and shall be used for no other purpose than . the expansion and enlargement of the City's sanitary sewer treatment plant and collection system. In the event reven- ues are insufficient at any time, to fund the debt principal and interest on the sanitary sewer system, the funds, herein, on majority vote of the Okeechobee City Council may be used for payment of said debt principal and interest. • SECTION II: This ordinance shall take effect as provided by law.
