0524 Handicapped ParkingORDINANCE NO. 524 AN ORDINANCE AMENDING THE ORDINANCE CODE OF THE CITY OF OKEECHOBEE, FLORIDA; AMENDING CHAPTER 17 TO CREATE SEC- TION 17-4 WHICH SAID SECTION SHALL PROVIDE PARKING REG- ULATIONS FOR HANDICAPPED AND DISABLED PERSONS; CREATING SECTION 17-5 TO PROVIDE PENALTIES FOR VIOLATION OF THE RULES AND REGULATIONS RELATIVE TO PARKING REQUIREMENTS FOR HANDICAPPED AND DISABLED PERSONS; PROVIDING AN EF- FECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OKEECHOBEE, FLORIDA, as follows: SECTION 1: Chapter 17 of the Code of Ordinances of the City of Okeechobee, Florida, is hereby amended to create Section 17-4 and 17-5 and these said Sections shall read as follows: CHAPTER 17 TRAFFIC Section 17-4: Parking Provisions for Handicapped and Disabled Persons 1) It shall be the policy of the City of Okeechobee to provide a minimum of one (1) special) designed and marked motor vehicle parking space at the City Hall for the exclusive use of-_severely physically disabled individuals with per- manent mobility problems. Said parking space is to be utilized only b those who are severely handicapped and who have been issued an exemption entitlement parking permit pursuant to Florida Statutes Chapter 320 0848 2) In addition to the minimum space at the City Hall it shall be required that other governmental units provide a minimum of one (1) space in the immediate vicinity of a building which houses a governmental entity or a political subdivision including, but not limited to, state office buildings and court houses These spaces shall be special- ly designed and specially marked and reserved for the ex- clusive use of severely physically disabled individuals who have been issued an exemption entitlement parking per- mit pursuant to Florida Statutes Chapter 320 0848 3) Each parking space shall conform to the requirements of Florida Statutes 316.1955(3) and shall be posted and main- tained with a permanent sign bearing the internationally accepted wheelchair symbol and the caption "PARKING BY DISABLED PERMIT ONLY". Section 17-5: Penalties. 1) Any person who parks a vehicle in any parking space des- ignated with the international) accepted wheelchair sym- bol and the caption "PARKING BY DISABLED PERMIT ONLY" shall be guilty of a traffic infraction unless such vehicle displays a parking permit issued pursuant to Florida • Statutes, Chapter 320.0848 and such vehicle is trans- porting a person eligible for such parking permit However, an person who is chauffeuring a disabled per- son shall be allowed without need for an identification parking permit, momentary parking in any such parking space for the purpose of loading or unloading a dis abled person. No penalty shall be imposed upon the driver for such momentary parking 2) The penalty for any violation of Section 17-4 or 17-5 , herein, shall be a fine of Twen y fives x}011 , ($2 OO) . SECTION 2: This ordinance shall take effect upon its adoption.
