0530 Creating Utilities DepartmentORDINANCE NO. 530 AN ORDINANCE AMENDING THE ORDINANCE CODE OF THE CITY OF OKEECHOBEE, • FLORIDA; AMENDING CHAPTER 2, ARTICLE III, SECTION 2-47 TO ELIMINATE THE RESPONSIBILITY OF WATER AND SEWER FACILITIES, LIFT STATIONS AND TREATMENT PLANTS FROM THE DEPARTMENT OF PUBLIC WORKS; CREATING SEC- TION 2-47A UTILITIES DEPARTMENT; PROVIDING FOR DUTIES AND RESPONSI- BILITIES; PROVIDING FOR A DIRECTOR; AMENDING CHAPTER 18, WATER, SEWERS AND SEWAGE DISPOSAL TO PROVIDE WITHIN THE CHAPTER, IN ALL INSTANCES, THAT THE DIRECTOR OF PUBLIC UTILITIES SHALL REPLACE THE DIRECTOR OF PUBLIC WORKS AS THE RESPONSIBLE INDIVIDUAL; PRO- VIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OKEECHOBEE, FLORIDA as follows: SECTION 1: Chapter 2, Article III of Section 2-47 Department of Public Works is hereby amended to read as follows: CHAPTER 2 ADMINISTRATION ARTICLE III. DEPARTMENTS AND OFFICES Section 2-47. Department of Public Works. There is hereby created and established the Department of Public Works. The head of the department shall be known as the Director of Public Works. The department shall be responsible for the maintenance of streets, drain- age, sanitation, park and right-of-way maintenance, paste--sad-9ewe~-€ee#~-- tle9-lneladlag-Iift-9tat#ene-and-the-watev-and- sewage-treatment -pleats. The director of this department shall supervise all employees assigned to the department and shall be responsible for the proper maintenance of the build- ings and equipment used in the operation of the department. The director of the department shall perform such other duties as may be prescribed by the city council. SECTION II: Chapter 2, Article III is hereby amended to create Section 2-47a which said Article shall read as follows: CHAPTER 2 ADMINISTRATION ARTICLE III. DEPARTMENTS AND OFFICES Section 2-47a. Department of Public Utilities. There is hereby created and established a Department of Public Utilities The head of the department shall be known as the Director of Public Utilities The department shall be responsible for the operation and maintenance of water and sewer facilities including lift stations and the water and sewage treatment plants. The director of this department shall supervise all employees assigned to the department and shall be responsible for the proper maintenance of the buildings and equipment used in the operation of the department The director of the department shall perform such other duties as may be perscribed by the city council. SECTIONIII: Chapter 18 of the Code of Ordinances of the City of Okeechobee, Florida is hereby amended to read as follows: • CHAPTER 18 WATER, SEWERS AND SEWAGE DISPOSAL ARTICLE I. IN GENERAL Section 18-3. Discontinuing water service for violation. The ~leeee~-a€-pablle-weeks director of public utilities may discontinue water service to any premises on which a violation of this chapter or any rule or regulation relating to the city's water or sewer systems has been or is be- ing committed. Such service shall not be reconnected until the violation has been corrected and until the consumer has paid a reconnecting charge in the amount provided by section 2-66, together with all fines and penalties. SECTION IV: Chapter 18, Article II, Section 18-25 and Section 18-28 shall read as follows: CHAPTER 18 WATER, SEWERS AND SEWAGE DISPOSAL ARTICLE II. WATER Section 18-25. Supplying water to others. No person shall supply water to others except by special permission from the dlveet "-a€-peblle-werks director of public utilities. Section 18-28. Obstructing access to system appurtenances. It shall be unlawful for any person to obstruct the access to any fire hydrant, stop valve or other fixture connected to the water system of the city, by placing thereon or within ten (10) feet thereof, building material or any other obstruction. If the violator neglects or refuses to remove the same forthwith after notice being given, the dlteeter-a€-pablle-werks director of public utilities may remove the same and the expenses attending the removal shall be paid by the violator. CHAPTER 18 w ARTICLE III. SEWERS AND SEWAGE DISPOSAL Section 18-40. Definitions as amended to define superintendent as director of public utilities and the definition shall read as follows: CHAPTER 18 ARTICLE III. SEWERS AND SEWAGE DISPOSAL Section 18-40.
