0559 Water Backflow PreventionORDINANCE NO. 559 AN ORDINANCE AMENDING THE ORDINANCE CODE OF THE CITY OF OKEECHOBEE FLORIDA; AMENDING CHAPTER 18, ARTICLE II CREATING SECTION 18-37 RELATING TO WATER SERVICE BACKFLOW PREVENTION DEVICES; PROHIBITING CROSS-CONNECTIONS. PROVIDING THAT A BACKFLOW PREVENTION DEVICE MAY BE REQUIRED BY THE DIRECTOR OF UTILITIES, INSTALLED AT CONSUMER'S EXPENSE; PROVIDING FOR TERMINATION OF WATER SERVICE IF CONSUMER RE- FUSES TO ALLOW INSTALLATION, MAINTENANCE OR INSPECTION OF BACKFLOW PREVENTION DEVICE; PROVIDING A CONFLICTS CLAUSE, SEVERABILITY CLAUSE, CODIFICATION CLAUSE; PROVIDING AN EFFECTIVE DATE AND FOR OTHER PUR- POSES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OKEECHOBEE, FLORIDA, as follows: SECTION I: Chapter 18, Article II is hereby amended to add a new Section 18-37, said Section shall read as follows: CHAPTER 18 ARTICLE II. WATER Section 18-37. Backflow prevention devices required; all cross-connections prohibited. Backflow prevention devices shall be required by the director of utilities at all premises likely to have cross-connections as described in American Water- works Association M-14 Backflow Prevention Manual, 1972 Edition. This manual sets forth potential cross-connection between the consumer's water system and certain types of equipment, specialized installations and water uses which of ford opportunity for backflow into the public water system All such facili- ties and systems as set forth in the Manual shall have backflow prevention de- vices unless it is demonstrated to the satisfaction of the director of utili- ties that no opportunity exists for backflow of water from the consumer's sys- tem into the public water supply system of the city. In addition, backflow prevention devices shall be installed at the service connection or within any premises where, in the discretion of the director of utilities, the nature and extent of the activities on the premises, or the materials used in connection with the activities or materials stored on the premises, would present an im- mediate and 'dangerous hazard to health, should a cross-connection occur, even though such cross-connection does not exist at the time the backflow preven- tion device is to be installed. The type of protective device to be installed shall depend on the degree of hazard which exists,_ or may occur, in the discretion of the director of utili- ties, and any protective device installed shall be approved by the director of utilities. A double check valve assembly, atmospheric vacuum breaker, pressure vacuum breaker or a reduced pressure backflow preventer will have to meet or ex- ceed any of the following standards and specialized installation methods : 1.) University of Southern California Foundation for Cross connection Control and Hydraulic Research Specifications of Backflow Preven- tion Devices, No. 69-2, or the most current issue. 2.) American Waterworks Association Standard C506-782 (revision of 10 C506-69). An air gap separation or a reduced pressure principle backflow prevention de- vice shall be installed where the water supply may be contaminated with sewage, industrial waste of a toxic nature, or other contamination which would cause a health or water system hazard, iq the discretion of the director of utilities. In the case of a substance which may be objectionable but not hazardous to health, a double check valve assembly, air gap separation, atmospheric vacuum breaker, pressure vacuum breaker or a reduced pressure principle backflow pre- vention device shall be installed. Backflow prevention devices shall be installed on the consumer's side of the water meter at the location designated b the director of utilities. The de- vice shall be located so as to be readily accessible for maintenance and test- ing, and where no Part of the device will be submerged. Backflowprrevention devices shall be installed by the city at the consumer's ex- pense in accordance with plans and specifications approved by the director of 1It; 1 i r4 Backflow prevention devices shall be inspected annual) and tested by the d~artment of utilities at thb consumer's expense, not to exceed fifty dollars ($50.00) per inspection, or more often where successive inspections indicate repeated failure or high degree of hazard. The devices shall be re aired over- hauled or replaced the citY,_at the consumer's expense, whenever such devices are found to be defective. Inspections, tests and records, thereof, shall be maintained by the department of utilities (a) Violations and Penalties: Failure of the consumer to permit the installation maintenance, testing or inspection of backflow prevention devices, by the city. all as required in this chapter, shall be grounds for termination of the water service to the premises, by the city, as provided in Section 18-4 herein In the case of an immediate hazard to the public health, the water service may be terminated without notice to the consumer immediate) although a hearing before the director of utilities shall be immediate) scheduled upon request of the consumer, to determine the justness and fairness of the water service termina- tion. In enforcing the provisions of this chapter, the director of utilities may call upon the chief of the police department to assist him in enforcing any of the provisions of this chapter. The owner or general agent of a building or remises where a violation of any provision of this ordinance has been committed or still exists, or the lessee or tenant of the entire building or leased remises where such violation has been committed or shall exist or the owner, general agent, lessee or tenant of an part of a building or premises in which such violation has been committed or shall exist or the general agent of an other person who commits, takes art in or assists in such violation or maintains an building or remises in which such violation shall exist, shall be guilt of violating this section which violation shall be punishable as provided in Section 1-9 of this Code (b) Cross-Connections Prohibited: All cross connections whether or not such cross-connections are controlled b automatic devices such as check valves orb hand operated mechanisms such as i ou, 2 gate valves or stop cocks, are hereby prohibited from future installations and on existing installations. All cross-connections shall be removed and replaced with approved backflow prevention devices. 10 The director of utilities or his duly authorized agent, in cooperation with the appropriate health department officials and local plumbing inspectors, will make periodic inspections of premises served by the water supply to check for the presence of cross-connections An cross-connections found during such inspections shall be ordered removed by the director of utilities or inspector. If an immediate hazard to health is caused by the cross-connec- tion, water service to the premises may be discontinued, in the discretion of the director of utilities until the cross-connection has been removed by the consumer. SECTION II: All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. SECTION III: Should any section or provision of this ordinance or any portion there- of, any paragraph, sentence or word be declared by a court or competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part thereof other than the part declared to be invalid. SECTION IV: Specific authority is hereby granted to codify Section I of this ordinance. SECTION V: This ordinance shall take effect as provided by law.
