AN ORDINANCE VACATING AND CLOSING THE ALLEY
IN BLOCK 51, CITY OF OKEECHOBEE, FLORIDA;
PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
OKEECHOBEE, FLORIDA AS FOLLOWS:
Section I: All of that alley located in Block 51, CITY OF
OKEECHOBEE, shall be hereby closed and vacated.
Section II: This Ordinance shall take effect upon its adoption.
Introduced on first reading and set for public hearing on
this 1st day of April 1986.

The following bids were received for the renovation of Fire Truck

Chief Tomey addressed the Council stating he has $18,000. budgeted
for the refurbishing of Truck number 4. The low bid of Southern Coach
of $21,500, has an optional bid of $24,500 for the aluminum body. Chief
Tomey recommended the Council accept the optional bid from Southern
Coach for the renovation of Fire Truck number 4. Council asked if Chief
Tomey had the additional money within his budget that could be used.
Chief Tomey stated he had budgeted $6,000 for the new fire hose which he
could put into next year's budget, also extra money in the budget for an
air pack.
Following further discussion Councilman Douglas made a motion to
accept the bid of Southern Coach for the aluminum body in the amount of
$24,500. Councilman Rubin seconded the motion. Mayor Chapman asked for
a vote on the motion. Councilman Douglas yes, Councilman Rubin yes,
Councilman Thomas yes, Councilman Collins yes. Motion carried.

Asst. Director of Public Utilities, Steve Figley, stated that Mr.
Fortner checked with the two companys and other cities using the
equipment, as requeted by the Council at the last regular meeting, and
the equipment was highley recommended.
Following discussion, Councilman Thomas made a motion to approve
the low bid of McLaughlin Mfg. Co, Greenville, S.C. in the amount of
$12,958.57. Councilmen Collins and Douglas seconded the motion. Mayor
Chapman asked for a vote on the motion. Councilman Douglas yes,
Councilman Rubin yes, Councilman Thomas yes, Councilman Collins
yes. Motion carried.

Department budget revisions. Mayor Chapman asked for a vote on the

Mr. Hughes addressed the Council with a complaint of traffic
conditions on Highway 70 East and 10th Avenue and requested the Council
ask that the Police Chief see to it that these noisy trucks be stopped.
Mayor Chapman asked Chief Mobley to request his employees try to put a
stop to the noise created by these vehicles.

CLOSE THE ALLEY IN BLOCKS 112 AND 113. NORTHEAST SECTION
Attorney Bryant stated the ordinance was not prepared at this time
for the alley closing. He went on to explain the main concern is
liability of the City for the line to be under a building. If the City
closes the alley at this time it will be entirely on Watford's
property. The City will need access to the water line. Mr. Watford
might agree to enter into a utility easement agreement with the City.
Mr. Watford stated there was the possibility of the water line being on
his property and not in the alley. Council discussed the situation and
agreed the first thing to do was to locate the water line. Councilman
Collins made a motion that the City have the water line located first
before the ordinance was drawn up for the alley closing. Councilman
Douglas seconded the motion. Mayor Chapman asked for a vote on the
motion. Councilman Collins yes, Councilman Rubin yes, Councilman
Douglas yes, Councilman Thomas yes. Motion carried.

AUTHORIZE NEGOTIATION OF A NEW AGREEMENT WITH THE OKEECHOBEE
REHABILITATION FACILITY FOR MAINTENANCE OF PLANTING BEDS IN
CERTAIN AREAS OF THE CITY
Administrative Assistant Davis exlained the new agreement
with the Rehabilitation Facilty and then asked Council if they
would like to have a monthly progress report from the
Rehabilitation Facility (like the Humane Society and Police
Departments monthly reports). Council agreed.
Councilman Thomas made a motion approving negotliations
concerning the new agreement with the Rehabilation Facility.
Councilman Rubin seconded the motion. Mayor Chapman asked for a
vote on the motion. Councilman Thomas yes. Councilman Rubin
yes, Councilman Collins yes. Motion carried.

Administrative Assistant Davis explained that all necessary
requirements have been met concerning the alley closing request.
Councilman Thomas made a motion that the attorney draft the
necessary ordinance for the alley closing in block 51.
Councilman Collins seconded the motion. Mayor Chapman asked for
a vote on the motion. Councilman Thomas yes. Councilman Collins
yes. Councilman Rubin yes. Motion carried.
Application #2: John E. and Joyce Watford, Blocks 112 and
113, northeast section.
Council noted the Director of Public Utilities comments
concerning utility easements on the application and asked
Director Fortner to explain. Director Fortner explained that
Mr. Watford presently has a building over the 6 inch water main
in the alley of Block 113. The existing building was
constructed over the existing water main. The addition should
not be permitted in the alley unless Mr. Watford pays the cost
of relocating the 6 inch water main from the alley to N.E. 4th
Street which is approximately 400 feet. The work to meet City
specifications and DER's approval.
Councilman Collins made a motion that Attorney Bryant draw
up the required ordinance with the following stipulations: that
Mr. Watford pays the cost of the having the water main relocated
to N.E. 4th Street, and the work to meet City's specifications
with DER's approval. Councilman Thomas seconded the motion.
Mayor Chapman asked for a vote on the motion. Councilman Thomas
yes. Councilman Collins yes. Councilman Rubin yes. Motion
carried.

On Tuesday, March 18, 1986, the City Council discussed and
took action on your alley closing request.
The City Council has approved the motion that the City Attorney
draft the necessary ordinance for the alley closing in Block 51,
provided the stipulation that the $170 legal and advertising fee
has been paid by the applicant.
Upon receipt of the legal and advertising fee, we will proceed
with your alley closing request.
