0577 Alcoholic Beverage SalesORDINANCE NO. 577 AN ORDINANCE AMENDING CHAPTER 3, SECTION 3-3 OF THE CODE • OF ORDINANCES OF THE CITY OF OKEECHOBEE, FLORIDA, WHICH SECTION RESTRICTS THE LOCATION OF BUSINESSES ENGAGED IN THE SALE OF ALCOHOLIC BEVERAGES; PROVIDING FOR EXEMPTION FROM THE REQUIREMENTS OF SECTION 3-3 FOR THOSE ESTABLISHMENTS SELLING WINE FOR CONSUMPTION OFF PREMISES ONLY; PROVIDING FOR EXEMPTION FROM THE REQUIREMENTS OF SECTION 3-3 FOR THOSE ESTABLISHMENTS OPERATING UNDER A VALID CITY OCCUPATIONAL LICENSE FOR OPERATION OF A RESTAURANT AND WHICH SELL MALT BEVERAGES AND WINE FOR CONSUMPTION ON THE PREMISES ONLY; PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OKEECHOBEE, FLORIDA AS FOLLOWS: SECTION I: Chapter 3. Section 3-3, of the Code of Ordinances of the City of Okeechobee is hereby amended to read as follows: Sec.3-3. Distance from church, school, or child care center. (a) No place of business for the sale of alcoholic beverages shall be located within seven hundred (700) feet of property owned or utilized by any established church, school, or child care center, which said distance shall be measured along a straight line from the nearest point on the property line of said business to the nearest point on the property line of the property owned or utilized by said church, school, or child care center; provided that this section shall riot apply to establishments selling malt beverages and wine for consumption off the premises only, nor to those establishments which operate under a valid City Occu ational license for operation of a restaurant and which sell malt beverages and wine for consumption on the premises on y.
