0586 Social SecurityORDINANCE NO. 586 AN ORDINANCE AMENDING ORDINANCE NO. 286 OF THE CODE OF • ORDINANCES OF THE CITY OF OKEECHOBEE, FLORIDA, RELATING TO COVERAGE FOR CITY EMPLOYEES AND OFFICIALS UNDER THE SYSTEM OF FEDERAL OLD AGE AND SURVIVORS INSURANCE; PROVIDING FOR EXEMPTION OF FEE-BASED EMPLOYEES FROM SUCH COVERAGE; PROVIDING FOR INCLUSION OF ELECTED OFFICIALS UNDER SUCH COVERAGE; PROVIDING FOR A REFERENDUM VOTE OF AFFECTED, ELIGIBLE EMPLOYEES AND OFFICIALS TO DETERMINE WHETHER A MAJORITY FAVOR SUCH COVERAGE; AUTHORIZING THE MAYOR TO EXECUTE NECESSARY AGREEMENTS WITH THE STATE AGENCY FOR THE PURPOSE OF EXTENDING SUCH COVERAGE TO THE AFFECTED, ELIGIBLE EMPLOYEES AND OFFICIALS; REPEALING ORDINANCE NO. 562; PROVIDING AN EFFECTIVE DATE. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OKEECHOBEE FLORIDA, AS FOLLOWS: Section One. Section 1 of Ordinance No. 286 of the City of Okeechobee, Florida is hereby amended to read as follows: "Section 1. It is hereby declared to be the policy and purpose of the City of Okeechobee, Florida, to extend effective as of January 1, 1958, to the employees and officials thereof, not excluded by law nor excepted herein, the benefits of the system of Old Age and Survivors Insurance as authorized by the Federal Social Se~,urity Act and amendments thereto, and by Chapter 650, Florida Statutes, as amended; and to cover by such plan all services which constitute employment as defined in Section 650.02, Florida Statutes, performed in the employ of said City by employees and officials thereof, except: 1. Section Two. Section 5 of Ordinance No. 286 of the City of Okeechobee, Florida is hereby amended to read as follows: "Section 5. There shall be appropriated from available funds, derived from -Gerr~ra}---Pond ad valorem tax revenues, water and sewerservice revenues, service charges and fees, such amounts, at such times, as may be required to pay promptly the contributions and assessments required of the City as employer by applicable State or Federal laws or regulations, which shall be paid over to the lawfully designated State agency at the times and in the manner provided by law and regulation." Section Three. The City of Okeechobee, Florida, shall immediately upon adoption of this Ordinance conduct a referendum election of the eligible employees or officials affected by this amendatory Ordinance to determine whether a majority of said employees or officials favor . social security coverage pursuant to this plan. Said referendum shall be conducted under the supervision of the City Administrator and shall be by written ballot. A vote of the majority of said affected employees or officials shall determine whether said employees shall be • covered under the plan. Section Four. The coverage provided herein shall be effective as of October 1, 1982, provided a majority of the affected, eligible employees vote in favor thereof in the referendum provided for in Section Three above. Section Five. The Mayor is hereby authorized and directed to execute all necessary agreements and amendments thereto with the State Agency of the State of Florida for the purpose of extending the benefits provided by said system of Old Age and Survivors Insurance to the employees and officials of the City as provided herein. Section Six. Ordinance No. 562, adopted November 19, 1985 is hereby repealed. Section Seven. This Ordinance shall take effect immediately upon its adoption, subject of the provisions of Section Four above.
