AN ORDINANCE CLOSING AND VACATING A PORTION OF
SOUTHEAST THIRD AVENUE BETWEEN THE SOUTH RIGHT-OF-WAY
LINE OF SOUTHEAST SEVENTH STREET AND THE SOUTH BOUNDARY
LINES OF BLOCKS L AND M, CENTRAL PARK; CLOSING AND
VACATING A PORTION OF SOUTHEAST FOURTH AVENUE BETWEEN
THE SOUTH RIGHT-OF-WAY LINE OF SOUTHEAST SEVENTH STREET
AND THE SOUTH BOUNDARY LINES OF BLOCKS K AND L, CENTRAL
PARK; RESERVING UNTO THE CITY A PERPETUAL, NON-
EXCLUSIVE EASEMENT FOR DRAINAGE PURPOSES OVER A PORTION
OF THE SAID SOUTHEAST FOURTH AVENUE; PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OKEECHOBEE,
FLORIDA, AS FOLLOWS:
SECTION I: The following streets are hereby closed, vacated
and abandoned by the City of Okeechobee, to wit:
a. That portion of Southeast Third (3rd) Avenue lying
between the south right-of-way line of Southeast Seventh
(7th) Street and the south boundary lines of BLOCKS L and
M, CENTRAL PARK, as shown in Plat Book 2, Page 39, Public
Records of Okeechobee County, Florida.
b. That portion of Southeast Fourth (4th) Avenue lying
between the south right-of-way line of Southeast Seventh
(7th) Street and the south boundary lines of BLOCKS K and
L, CENTRAL PARK, as shown in Plat Book 2, Page 39, Public
Records of Okeechobee County, Florida.
SECTION II: The City of Okeechobee, Florida, hereby reserves
unto itself, its successors and assigns, a perpetual, non-
exclusive easement for drainage purposes over and upon the
following described portion of Southeast Fourth (4th)
Avenue:
A fifty (50) feet wide easement lying east of the following
line: Beginning at the northeast corner of LOT 1, BLOCK L,
CENTRAL PARK, and proceeding south along the east boundary
of said LOT 1, continuing south along the east boundary of
LOT 12, BLOCK L, CENTRAL PARK, to the southeast corner of
said LOT 12 or to the point of intersection with the
existing drainage canal which runs west to east through
said BLOCK L, whichever shall be first encountered.
Said easement shall be for the purpose of constructing,
repairing and maintaining existing or future drainage
improvements within said easement as the City of Okeechobee
shall deem appropriate or necessary.
SECTION 111: The City Clerk shall cause this Ordinance to be
recorded in the public records of Okeechobee County,
Florida.
SECTION IV: This ordinance shall take effect immediately upon
its adoption.
