0439 Prohibition of Disorderly ConductORDINANCE NO. 439 AN ORDINANCE OF THE CITY OF OKEECHOBEE, PROHIBITING DISORDERLY CONDUCT AND DRINKING IN PUBLIC PLACES; PROVIDING PENALTIES; AND PROVIDING AN EFFECTIVE DATE. • WHEREAS, the City of Okeechobee desires an attractive and nuisance free city; and WHEREAS, the public alleyways, public sidewalks and public streets are designed for the tran,sp.orta.tion of traffic and pedestrians and the public parks and public recreation areas are designed for the enjoyment of citizens of the community; and WHEREAS, a number of citizens have taken to drinking beer, wine and other alcoholic beverages along and upon the public streets, alleyways, parks, common ways, recreation areas and disposing of their containers thereon in a way to litter the public areas; and WHEREAS, the consumption of these alcoholic beverages contributes to pubic drunkenness and disorderly conduct which infringes upon the rights of the general populace to the free and unfettered enjoyment of the public road- ways, sidewalks, common ways, parks and recreation areas; and WHEREAS, the City Council of the City of Okeechobee deems it appropriate for the protection of the general hea7.th, safety and welfare of the community to regulate the consumption of alcoholic beverages in public places and other activities which affect the general public. BE IT ORDAINED by the Council of the City of Okeechobee, Florida as follows: SECTION I: The drinking of beer, wine or other alcoholic beverages upon the public streets, alleyways, sidewalks, or other rights of way or in any of the public recreation areas or city parks is hereby prohibited at all times. SECTION IT: No person in the city shall be intoxicated and endanger the safety of another person or property or cause a public disturbance of any kind. SECTION III: Any person violating the provisions of this ordinance shall be guilty of a nuisance and punishable as provided in Section 1-8 of this code.
