AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF
OKEECHOBEE, FLORIDA; AMENDING CHAPTER 18, ARTICLE II, SECTION
18-15 TO AUTHORIZE PAYMENT OF SYSTEM CAPACITY CHARGES; AMEND-
ING CHAPTER 18, ARTICLE II, SECTION 18-17 TO PROVIDE CONNEC-
TION FEES FOR SERVICE OUTSIDE THE CITY LIMITS; CREATING SEC-
TION 18-34 TO PROVIDE SYSTEM CAPACITY CHARGES FOR PERSONS WITH-
IN AND WITHOUT THE CITY LIMITS; AMENDING ARTICLE III, SECTION
18-40 TO PROVIDE CONNECTION FEES FOR SEWER SERVICE OUTSIDE THE
CITY LIMITS; CREATING SECTION 18-47 TO PROVIDE SYSTEM CAPACITY
CHARGES FOR THE COST OF EXPANSION OF THE CITY'S SEWAGE TREAT-
MENT PLANT; PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OKEE-
CHOBEE, FLORIDA AS FOLLOWS:
SECTION I: Chapter 18, Article II, Section 18-15 of the City Code of
Ordinances is hereby amended to read as follows:

ARTICLE II WATER
Section 18-15 Connection to city system authorized
Where the same is available, the owner of every lot or parcel of land within
the city shall have the plumbing of any building or buildings thereon to be
connected with the municipal waterworks system of the city and use the facili-
ties of such water system. All such connections shall be made in accordance
with the rules and regulations which shall be adopted from time to time by the
City Council, and upon payment of the connection fee prescribed by Section 18-17
and system capacity charge prescribed by Section 18-35.
SECTION II: Chapter 18, Article II, Section 18-17 of the City Code of
Ordinances is hereby amended to read as follows:

The fee for making water service connections by the city shall be:

Connection fees for meters larger than two (2) inches shall be negotiated
by the Department of Public Works and the price shall be based upon the cost
of materials and labor.
SECTION III: Chapter 18, Article II is hereby amended to add Sections 18-34
and 18-35, which sections shall read as follows:

ARTICLE II WATER
Section 18-34 There is hereby established a system capacity charge for
new customers connecting to the city's established water system. The purpose
of the charge is to establish a fund to replace the water capacity taken by
new customers by expansion and enlargement of the water system, therefore, such
funds are to be deposited into a special trust fund which is hereby created
• under the name WATER SYSTEM ENLARGEMENT AND EXPANSION TRUST FUND and the funds
deposited therein are to be used only for the purpose of expansion and enlarge-
ment of the water treatment and distribution system and only after authorization
for the use of such funds by a majority vote of the City Council. These funds
may be invested as other funds of the city and may be co-mingled in order to
obtain the maximum amount of interest provided, however, that separate books of
account be established to precisely identify the funds of this trust account.
The interest accruing from the investment of these funds shall accrue to the
trust fund and shall be used for no other purpose and the expansion and enlarge-
ment of the City of Okeechobee water system.
Section 18-35 SYSTEM CAPACITY CHARGE
A system capacity charge shall be paid by all new customers on the City of
Okeechobee water system in the following amounts:

System capacity charges on water meters larger than three (3) inches shall be
set by the City Engineer and Director of the Department of Public Works and shall
be based on the amount necessary to expand and enlarge the city's water treatment
and distribution system to replace the capacity being taken by the new customer.
SECTION IV: Chapter 18, Article III, Section 18-40 is hereby amended to
read as follows:

Section 18-40 Connection fees
A connection and tappage fee for connection to the city's sewer system and the
system capacity charges provided in Section 18-48 shall be paid to the Finance
Department at the time of application for a sewer connection. The connection
and tappage fee shall be as follows:

SECTION V: Chapter 18, Article III is hereby amended to add a new Section
18-47 to create a trust fund for a sanitary sewer system capacity charge and
creating Section 18-48 establishing charges for sewer system capacity replace-
ment and these sections shall read as follows:

Section 18-47 There is hereby created a special trust fund to be known as
SANITARY SEWER TREATMENT PLANT TRUST FUND into which fund is to be deposited all
monies raised as result of charges made in connection with Section 18-48
herein. These funds are to be used only for the purpose of expansion and
enlargement of the city's sewer treatment plant as authorized by a majority
vote of the Okeechobee City Council. These funds may be invested as other
funds of the city and may be co-mingled in order to obtain the maximum
• amount of interest provided, however, separate books of account shall be
established to precisely identify the funds of this trust account. The
interest accruing from the investment of these funds shall accrue to the
trust fund and shall be used for no other purpose than the expansion and
enlargement of the city's sanitary sewer treatment plant.
Section 18-48 System Capacity Charge
A system capacity charge shall be paid by all new customers on the City of
Okeechobee sanitary sewer system in the following amounts:
a) Residential customers with 5/8" x 3/4" Inside Citv Outside City

SECTION VI: This ordinance shall take effect upon its adoption.
